La question devient alors tr\u00e8s concr\u00e8te : faut-il accepter seulement l&#8217;indemnit\u00e9 de d\u00e9part ou de mise \u00e0 la retraite, ou peut-on r\u00e9clamer une indemnit\u00e9 de licenciement et des dommages-int\u00e9r\u00eats devant le conseil de prud&#8217;hommes ?<\/p>\n<p>La r\u00e9ponse d\u00e9pend du vrai motif de rupture et des preuves disponibles. L&#8217;\u00e9tiquette utilis\u00e9e dans les documents de fin de contrat ne suffit pas toujours. Si le d\u00e9part \u00e0 la retraite est volontaire, clair et non \u00e9quivoque, le r\u00e9gime de la retraite s&#8217;applique. Si le salari\u00e9 d\u00e9montre que la rupture a en r\u00e9alit\u00e9 \u00e9t\u00e9 impos\u00e9e, provoqu\u00e9e par des manquements graves de l&#8217;employeur ou d\u00e9cid\u00e9e sans respecter les r\u00e8gles de mise \u00e0 la retraite, le d\u00e9bat peut basculer vers le licenciement sans cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<h2>D\u00e9part volontaire, mise \u00e0 la retraite ou licenciement d\u00e9guis\u00e9 : trois situations \u00e0 distinguer<\/h2>\n<p>Le d\u00e9part volontaire \u00e0 la retraite suppose que le salari\u00e9 choisisse de quitter l&#8217;entreprise pour b\u00e9n\u00e9ficier d&#8217;une pension de vieillesse. Dans ce cas, l&#8217;<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGITEXT000006072050\">article L. 1237-9 du code du travail<\/a> pr\u00e9voit une indemnit\u00e9 de d\u00e9part \u00e0 la retraite, calcul\u00e9e selon l&#8217;anciennet\u00e9 et la r\u00e9mun\u00e9ration brute. C&#8217;est le sc\u00e9nario le plus simple : le salari\u00e9 d\u00e9cide, informe l&#8217;employeur et per\u00e7oit l&#8217;indemnit\u00e9 due.<\/p>\n<p>La mise \u00e0 la retraite est diff\u00e9rente. Elle vient de l&#8217;employeur. L&#8217;<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGITEXT000006072050\">article L. 1237-5 du code du travail<\/a> encadre strictement cette possibilit\u00e9, notamment lorsque le salari\u00e9 n&#8217;a pas encore 70 ans. Avant certains \u00e2ges, l&#8217;employeur doit interroger le salari\u00e9 sur son intention de partir. Si le salari\u00e9 r\u00e9pond non, ou si la proc\u00e9dure n&#8217;est pas respect\u00e9e, l&#8217;employeur ne peut pas imposer la retraite comme une simple formalit\u00e9.<\/p>\n<p>Le licenciement d\u00e9guis\u00e9 appara\u00eet lorsque la retraite sert de pr\u00e9sentation commode \u00e0 une rupture qui, en r\u00e9alit\u00e9, r\u00e9pond \u00e0 un autre motif : conflit interne, r\u00e9organisation, suppression de poste, pression manag\u00e9riale, reproches disciplinaires, inaptitude mal trait\u00e9e ou volont\u00e9 de se s\u00e9parer d&#8217;un salari\u00e9 \u00e2g\u00e9. Dans ce cas, le salari\u00e9 peut demander au juge de restituer sa vraie qualification \u00e0 la rupture.<\/p>\n<h2>Quand le d\u00e9part \u00e0 la retraite peut \u00eatre contest\u00e9<\/h2>\n<p>Un d\u00e9part \u00e0 la retraite peut \u00eatre discut\u00e9 lorsque la volont\u00e9 du salari\u00e9 n&#8217;\u00e9tait pas claire. C&#8217;est souvent le point central du dossier. Le juge recherche si le salari\u00e9 a exprim\u00e9 une d\u00e9cision libre, certaine et non \u00e9quivoque de quitter l&#8217;entreprise pour liquider ses droits \u00e0 la retraite.<\/p>\n<p>Plusieurs signaux doivent alerter :<\/p>\n<ul>\n<li>l&#8217;employeur a pr\u00e9par\u00e9 les documents de d\u00e9part avant une demande claire du salari\u00e9 ;<\/li>\n<li>le salari\u00e9 a envoy\u00e9 des courriels de protestation avant ou juste apr\u00e8s la rupture ;<\/li>\n<li>le d\u00e9part intervient apr\u00e8s un conflit, une mise \u00e0 l&#8217;\u00e9cart, une d\u00e9gradation des conditions de travail ou une pression li\u00e9e \u00e0 l&#8217;\u00e2ge ;<\/li>\n<li>l&#8217;employeur a \u00e9voqu\u00e9 une suppression de poste, une rupture amiable ou une sanction avant de parler de retraite ;<\/li>\n<li>le salari\u00e9 n&#8217;a jamais demand\u00e9 explicitement \u00e0 partir \u00e0 la retraite ;<\/li>\n<li>les documents de fin de contrat ne correspondent pas aux \u00e9changes ant\u00e9rieurs.<\/li>\n<\/ul>\n<p>Dans une affaire r\u00e9cente suivie par la jurisprudence sociale, une cour d&#8217;appel a rappel\u00e9 que le juge peut analyser un d\u00e9part \u00e0 la retraite \u00e9quivoque comme une prise d&#8217;acte de la rupture, avec les effets d&#8217;un licenciement sans cause r\u00e9elle et s\u00e9rieuse si les manquements de l&#8217;employeur le justifient. Cette logique impose de regarder les circonstances r\u00e9elles de la rupture, et pas seulement l&#8217;intitul\u00e9 du solde de tout compte.<\/p>\n<h2>Peut-on cumuler indemnit\u00e9 de retraite et indemnit\u00e9 de licenciement ?<\/h2>\n<p>Il faut distinguer plusieurs sommes.<\/p>\n<p>L&#8217;indemnit\u00e9 de d\u00e9part ou de mise \u00e0 la retraite r\u00e9mun\u00e8re un mode particulier de rupture li\u00e9 \u00e0 la retraite. L&#8217;indemnit\u00e9 de licenciement, pr\u00e9vue par l&#8217;<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGITEXT000006072050\">article L. 1234-9 du code du travail<\/a>, est due au salari\u00e9 en CDI licenci\u00e9, sauf faute grave, s&#8217;il compte au moins huit mois d&#8217;anciennet\u00e9 ininterrompus.<\/p>\n<p>Si la rupture reste juridiquement un d\u00e9part volontaire \u00e0 la retraite, le salari\u00e9 ne peut pas transformer automatiquement l&#8217;indemnit\u00e9 de retraite en indemnit\u00e9 de licenciement. En revanche, si le juge requalifie la rupture en licenciement, il peut ouvrir droit aux indemnit\u00e9s attach\u00e9es au licenciement : indemnit\u00e9 l\u00e9gale ou conventionnelle de licenciement, indemnit\u00e9 compensatrice de pr\u00e9avis si elle est due, cong\u00e9s pay\u00e9s aff\u00e9rents, et \u00e9ventuellement dommages-int\u00e9r\u00eats pour licenciement sans cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<p>Le vrai d\u00e9bat porte alors sur l&#8217;imputation des sommes d\u00e9j\u00e0 vers\u00e9es. L&#8217;employeur soutiendra souvent que l&#8217;indemnit\u00e9 de retraite d\u00e9j\u00e0 pay\u00e9e doit venir en d\u00e9duction. Le salari\u00e9 devra expliquer pourquoi la somme per\u00e7ue ne r\u00e9pare pas le m\u00eame pr\u00e9judice, ou pourquoi le r\u00e9gime applicable \u00e0 la rupture requalifi\u00e9e justifie un rappel. Cette discussion est technique et d\u00e9pend des bulletins, du solde de tout compte, de la convention collective, du montant d\u00e9j\u00e0 pay\u00e9 et de la qualification finalement retenue.<\/p>\n<h2>Quels d\u00e9lais pour agir devant les prud&#8217;hommes ?<\/h2>\n<p>Le d\u00e9lai est un point sensible. Les actions portant sur la rupture du contrat de travail sont en principe enferm\u00e9es dans des d\u00e9lais courts. Il ne faut pas attendre la liquidation d\u00e9finitive de la retraite, un recalcul de pension ou une r\u00e9ponse tardive de l&#8217;employeur pour consulter.<\/p>\n<p>En pratique, le salari\u00e9 doit r\u00e9unir rapidement :<\/p>\n<ul>\n<li>le courrier ou courriel cens\u00e9 \u00e9tablir la demande de d\u00e9part \u00e0 la retraite ;<\/li>\n<li>la r\u00e9ponse de l&#8217;employeur et les documents de fin de contrat ;<\/li>\n<li>le certificat de travail, le re\u00e7u pour solde de tout compte et l&#8217;attestation France Travail ;<\/li>\n<li>les bulletins de paie des douze derniers mois ;<\/li>\n<li>la convention collective applicable ;<\/li>\n<li>les \u00e9changes montrant une pression, une mise \u00e0 l&#8217;\u00e9cart, un conflit ou une suppression de poste ;<\/li>\n<li>les justificatifs de retraite et de pension, lorsque la rupture a un impact financier durable.<\/li>\n<\/ul>\n<p>Le re\u00e7u pour solde de tout compte m\u00e9rite une attention particuli\u00e8re. Sa signature n&#8217;emp\u00eache pas n\u00e9cessairement toute action, mais elle peut compliquer la contestation de certaines sommes si le salari\u00e9 ne le d\u00e9nonce pas dans les d\u00e9lais. Il faut donc \u00e9viter de signer sans r\u00e9serve lorsque la rupture est d\u00e9j\u00e0 contest\u00e9e.<\/p>\n<h2>Comment chiffrer la r\u00e9clamation<\/h2>\n<p>Le chiffrage ne se limite pas \u00e0 comparer deux intitul\u00e9s d&#8217;indemnit\u00e9. Il faut reconstruire le sc\u00e9nario juridique le plus favorable et le plus d\u00e9fendable.<\/p>\n<p>Premier niveau : v\u00e9rifier l&#8217;indemnit\u00e9 d\u00e9j\u00e0 vers\u00e9e. Le montant d\u00e9pend de l&#8217;anciennet\u00e9, du salaire de r\u00e9f\u00e9rence, des primes, de la convention collective et du caract\u00e8re volontaire ou impos\u00e9 de la retraite.<\/p>\n<p>Deuxi\u00e8me niveau : calculer ce qui aurait \u00e9t\u00e9 d\u00fb en cas de licenciement. L&#8217;indemnit\u00e9 l\u00e9gale ou conventionnelle de licenciement peut \u00eatre plus \u00e9lev\u00e9e que l&#8217;indemnit\u00e9 de retraite, surtout pour un salari\u00e9 ancien, cadre, ou b\u00e9n\u00e9ficiant d&#8217;une convention collective favorable.<\/p>\n<p>Troisi\u00e8me niveau : examiner le pr\u00e9avis. Si la rupture est requalifi\u00e9e en licenciement sans cause r\u00e9elle et s\u00e9rieuse, l&#8217;indemnit\u00e9 compensatrice de pr\u00e9avis peut devenir un poste important, avec les cong\u00e9s pay\u00e9s correspondants.<\/p>\n<p>Quatri\u00e8me niveau : \u00e9valuer les dommages-int\u00e9r\u00eats. L&#8217;<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGITEXT000006072050\">article L. 1235-3 du code du travail<\/a> fixe un bar\u00e8me en cas de licenciement sans cause r\u00e9elle et s\u00e9rieuse. L&#8217;\u00e2ge du salari\u00e9, son anciennet\u00e9, ses perspectives de reclassement, la perte de revenus, la proximit\u00e9 de la retraite \u00e0 taux plein et la situation post-rupture peuvent peser dans l&#8217;appr\u00e9ciation du pr\u00e9judice.<\/p>\n<h2>Les arguments de l&#8217;employeur \u00e0 anticiper<\/h2>\n<p>L&#8217;employeur oppose g\u00e9n\u00e9ralement quatre arguments.<\/p>\n<p>Il soutient d&#8217;abord que le salari\u00e9 voulait r\u00e9ellement partir \u00e0 la retraite. Pour r\u00e9pondre, il faut produire les \u00e9l\u00e9ments qui montrent une h\u00e9sitation, une pression ou une contestation contemporaine de la rupture.<\/p>\n<p>Il affirme ensuite que les sommes ont d\u00e9j\u00e0 \u00e9t\u00e9 r\u00e9gl\u00e9es. Le salari\u00e9 doit alors pr\u00e9senter un tableau clair : sommes pay\u00e9es, sommes dues selon la qualification correcte, diff\u00e9rence r\u00e9clam\u00e9e, fondement juridique.<\/p>\n<p>Il peut aussi invoquer l&#8217;anciennet\u00e9 du conflit ou la prescription. La chronologie doit donc \u00eatre pr\u00e9cise, dat\u00e9e et v\u00e9rifiable.<\/p>\n<p>Enfin, il peut soutenir que la retraite rend impossible tout pr\u00e9judice li\u00e9 \u00e0 la perte d&#8217;emploi. Cet argument doit \u00eatre discut\u00e9. La retraite ne neutralise pas automatiquement les cons\u00e9quences d&#8217;une rupture injustifi\u00e9e : perte de r\u00e9mun\u00e9ration jusqu&#8217;\u00e0 la liquidation, d\u00e9cote, retraite anticip\u00e9e subie, perte de chance de finir la carri\u00e8re dans de meilleures conditions, ou privation d&#8217;une indemnit\u00e9 conventionnelle plus favorable.<\/p>\n<h2>Que faire si l&#8217;employeur pousse au d\u00e9part<\/h2>\n<p>Le salari\u00e9 qui sent une pression ne doit pas se limiter \u00e0 une discussion orale. Il faut laisser des traces \u00e9crites sobres et factuelles. Un message peut rappeler que le salari\u00e9 n&#8217;a pas demand\u00e9 \u00e0 partir, qu&#8217;il souhaite conna\u00eetre les raisons exactes de la rupture envisag\u00e9e, ou qu&#8217;il refuse une mise \u00e0 la retraite impos\u00e9e si les conditions l\u00e9gales ne sont pas r\u00e9unies.<\/p>\n<p>Il faut aussi \u00e9viter les formules ambigu\u00ebs. \u00c9crire \u201cje prends ma retraite puisque vous ne me laissez pas le choix\u201d peut aider \u00e0 d\u00e9montrer une pression, mais peut aussi \u00eatre utilis\u00e9 par l&#8217;employeur comme preuve d&#8217;un d\u00e9part volontaire. Le bon r\u00e9flexe consiste \u00e0 demander conseil avant d&#8217;envoyer un courrier d\u00e9finitif.<\/p>\n<p>Lorsque la rupture est d\u00e9j\u00e0 intervenue, il faut r\u00e9agir vite : analyser les documents, d\u00e9noncer le solde de tout compte si n\u00e9cessaire, v\u00e9rifier la convention collective, calculer les indemnit\u00e9s, puis d\u00e9cider s&#8217;il faut saisir le conseil de prud&#8217;hommes.<\/p>\n<h2>Paris et \u00cele-de-France : pr\u00e9parer un dossier prud&#8217;homal lisible<\/h2>\n<p>\u00c0 Paris et en \u00cele-de-France, les dossiers de fin de carri\u00e8re concernent souvent des salari\u00e9s avec une forte anciennet\u00e9, des r\u00e9mun\u00e9rations variables, des primes, des forfaits jours ou des conventions collectives complexes.
