La compensation des cr\u00e9ances r\u00e9ciproques et le montant final<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Par un arr\u00eat rendu le 29 avril 2026, la Cour d&#8217;appel de Nancy, 5\u00e8me Chambre, a \u00e9t\u00e9 saisie d&#8217;un litige opposant deux soci\u00e9t\u00e9s commerciales \u00e0 la suite de la r\u00e9siliation amiable d&#8217;un bail portant sur des locaux \u00e0 usage de bureaux et d&#8217;entrep\u00f4t. Le bailleur avait consenti un bail au preneur en 2016, et un \u00e9tat des lieux d&#8217;entr\u00e9e mentionnait un \u00e9tat neuf. Le bail a \u00e9t\u00e9 r\u00e9sili\u00e9 amiablement le 16 juillet 2021, et un \u00e9tat des lieux de sortie a r\u00e9v\u00e9l\u00e9 des d\u00e9gradations, notamment des t\u00e2ches d&#8217;hydrocarbures sur le sol en b\u00e9ton quartz\u00e9, un enfoncement sur le portillon et un poin\u00e7onnement sur la porte sectionnelle.<\/p>\n<p>En premi\u00e8re instance, le tribunal judiciaire de Nancy, par jugement du 27 f\u00e9vrier 2025, a condamn\u00e9 le bailleur \u00e0 restituer au preneur la somme de 5 381,41 euros au titre des sommes ind\u00fbment conserv\u00e9es lors de la rupture amiable, et a rejet\u00e9 les demandes du bailleur au titre des r\u00e9parations. Le bailleur a relev\u00e9 appel, soutenant que les d\u00e9gradations relevaient de la responsabilit\u00e9 du preneur et r\u00e9clamant une indemnisation de 16 220 euros pour la reprise du sol. Le preneur a conclu \u00e0 la confirmation du jugement, admettant seulement le nettoyage pour 930 euros et contestant toute am\u00e9lioration du bien.<\/p>\n<p>La question de droit soumise \u00e0 la cour \u00e9tait celle de l&#8217;\u00e9tendue des r\u00e9parations locatives mises \u00e0 la charge du preneur \u00e0 la sortie des lieux, et du montant de l&#8217;indemnisation due, en tenant compte de la compensation avec les cr\u00e9ances du preneur. La Cour d&#8217;appel de Nancy a infirm\u00e9 le jugement entrepris et a condamn\u00e9 le preneur \u00e0 verser au bailleur la somme de 6 021,59 euros avec int\u00e9r\u00eats au taux l\u00e9gal, outre 2 500 euros au titre des frais irr\u00e9p\u00e9tibles.<\/p>\n<h2 id=\"i-la-confirmation-du-principe-de-responsabilite-du-preneur-pour-les-degradations\">I. La confirmation du principe de responsabilit\u00e9 du preneur pour les d\u00e9gradations locatives<\/h2>\n<p><\/p>\n<h3 id=\"a-lapplication-des-articles-1730-et-1732-du-code-civil-et-la-limite-de-la-vetust\">A. L&#8217;application des articles 1730 et 1732 du code civil et la limite de la v\u00e9tust\u00e9<\/h3>\n<p>La cour rappelle que, conform\u00e9ment \u00e0 l&#8217;article 1730 du code civil, le preneur doit rendre la chose telle qu&#8217;il l&#8217;a re\u00e7ue suivant l&#8217;\u00e9tat des lieux, sauf v\u00e9tust\u00e9 ou force majeure. L&#8217;article 1732 dispose en outre que le preneur r\u00e9pond des d\u00e9gradations survenues pendant sa jouissance, sauf \u00e0 prouver qu&#8217;elles ont eu lieu sans sa faute. Ces dispositions imposent au locataire une obligation de restitution en bon \u00e9tat. En l&#8217;esp\u00e8ce, un \u00e9tat des lieux d&#8217;entr\u00e9e contradictoire a \u00e9t\u00e9 \u00e9tabli le 12 mai 2016, mentionnant un \u00e9tat <em>&#8220;neuf&#8221;<\/em> pour le sol en b\u00e9ton quartz\u00e9. L&#8217;\u00e9tat des lieux de sortie du 16 juillet 2021 constate des t\u00e2ches d&#8217;hydrocarbures sur l&#8217;ensemble de la surface, ainsi que des dommages sur les portes et la descente d&#8217;eau pluviale. La cour \u00e9carte l&#8217;exon\u00e9ration par la v\u00e9tust\u00e9 pour les t\u00e2ches au sol, la locataire n&#8217;\u00e9tablissant pas que ces d\u00e9sordres r\u00e9sulteraient d&#8217;un usage normal ou de l&#8217;anciennet\u00e9 du rev\u00eatement. Elle se fonde sur le courriel de la soci\u00e9t\u00e9 Onet indiquant que la porosit\u00e9 de la dalle ne permet pas de garantir l&#8217;enl\u00e8vement des t\u00e2ches, mais retient que ce d\u00e9faut de porosit\u00e9 n&#8217;est pas d\u00e9terminant face \u00e0 l&#8217;usage anormal d&#8217;une cuve \u00e0 fuel. La solution s&#8217;inscrit dans la ligne de la jurisprudence constante : <em>&#8220;le preneur r\u00e9pond des d\u00e9gradations ou des pertes qui arrivent pendant sa jouissance, \u00e0 moins qu&#8217;il ne prouve qu&#8217;elles ont eu lieu sans sa faute&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67cbe0839c75bf6f6ddf7781\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de N\u00eemes, 7 mars 2025, n\u00b023\/00742)<\/a><\/strong>. Le preneur ne d\u00e9montrant aucune cause \u00e9trang\u00e8re, sa responsabilit\u00e9 est engag\u00e9e.<\/p>\n<h3 id=\"b-lappreciation-de-la-nature-des-degradations-et-le-rejet-de-la-vetuste-pour-les\">B. L&#8217;appr\u00e9ciation de la nature des d\u00e9gradations et le rejet de la v\u00e9tust\u00e9 pour les portes<\/h3>\n<p>La cour distingue les d\u00e9gradations selon leur gravit\u00e9. Pour le sol, les t\u00e2ches d&#8217;hydrocarbures r\u00e9sultent de l&#8217;installation et de l&#8217;usage d&#8217;une cuve \u00e0 fuel par le preneur. La cour rel\u00e8ve que le local \u00e9tait destin\u00e9 \u00e0 un usage d&#8217;entrep\u00f4t, mais que l&#8217;usage de la cuve a exc\u00e9d\u00e9 l&#8217;entretien normal. Elle estime que cet usage anormal a caus\u00e9 un pr\u00e9judice au bailleur, justifiant la r\u00e9fection du rev\u00eatement. En revanche, pour la porte sectionnelle et le portillon, les dommages (enfoncement de deux lames, poin\u00e7onnement) sont qualifi\u00e9s <em>&#8220;d&#8217;ordre esth\u00e9tique&#8221;<\/em> et n&#8217;affectent pas le fonctionnement. La cour consid\u00e8re que le maintien du preneur pendant cinq ans dans les lieux <em>&#8220;peut, au regard du faible impact de ces dommages, s&#8217;apparenter \u00e0 de la v\u00e9tust\u00e9&#8221;<\/em>. Elle rejette donc l&#8217;indemnisation demand\u00e9e sur ces postes. Cette appr\u00e9ciation nuanc\u00e9e des d\u00e9sordres montre que la v\u00e9tust\u00e9 peut exon\u00e9rer le preneur pour des d\u00e9gradations mineures, alors que les dommages substantiels caus\u00e9s par un usage anormal restent \u00e0 sa charge. Ainsi, la cour op\u00e8re un contr\u00f4le concret de l&#8217;\u00e9tendue de l&#8217;obligation de restitution.<\/p>\n<h2 id=\"ii-la-determination-du-montant-de-lindemnisation-et-la-compensation\">II. La d\u00e9termination du montant de l&#8217;indemnisation et la compensation<\/h2>\n<p><\/p>\n<h3 id=\"a-levaluation-du-prejudice-et-le-rejet-du-devis-excessif\">A. L&#8217;\u00e9valuation du pr\u00e9judice et le rejet du devis excessif<\/h3>\n<p>Pour \u00e9valuer le pr\u00e9judice r\u00e9sultant des d\u00e9gradations du sol, la cour \u00e9carte le devis de 16 220 euros produit par le bailleur, jug\u00e9 disproportionn\u00e9 car il pr\u00e9voit une am\u00e9lioration (couche de masse et anti-d\u00e9rapant) non pr\u00e9vue au bail initial. Elle retient le devis Intersol, qui pr\u00e9voit la r\u00e9fection du dallage avec incorporation d&#8217;un durcisseur de surface \u00e0 base de quartz, correspondant \u00e0 l&#8217;\u00e9tat d&#8217;origine. Le montant retenu est de 12 649 euros HT. La cour ajoute 650 euros HT pour la descente d&#8217;eau pluviale, non contest\u00e9, et un arri\u00e9r\u00e9 de charges de 104,91 euros. Elle rappelle que le droit \u00e0 indemnisation du bailleur n&#8217;est pas subordonn\u00e9 \u00e0 l&#8217;ex\u00e9cution des travaux, m\u00eame si le local a \u00e9t\u00e9 relou\u00e9. La solution illustre le principe de r\u00e9paration int\u00e9grale du pr\u00e9judice, mais limit\u00e9e \u00e0 ce qui \u00e9tait pr\u00e9vu contractuellement, sans enrichissement sans cause. La cour refuse ainsi la prise en charge d&#8217;une am\u00e9lioration non consentie par le bail.<\/p>\n<h3 id=\"b-la-compensation-des-creances-reciproques-et-le-montant-final\">B. La compensation des cr\u00e9ances r\u00e9ciproques et le montant final<\/h3>\n<p>En parall\u00e8le, le preneur est cr\u00e9ancier du bailleur \u00e0 hauteur de 4 230 euros au titre du d\u00e9p\u00f4t de garantie, de 1 576,16 euros pour un virement du mois d&#8217;ao\u00fbt 2021, et d&#8217;un second virement identique, soit 7 382,32 euros. La cour op\u00e8re une compensation entre les cr\u00e9ances respectives. Le bailleur \u00e9tant cr\u00e9ancier de 13 403,91 euros (12 649 + 650 + 104,91), et d\u00e9biteur de 7 382,32 euros, la somme due par le preneur s&#8217;\u00e9l\u00e8ve \u00e0 6 021,59 euros. Cette technique comptable permet d&#8217;apurer les comptes entre parties \u00e0 l&#8217;issue du bail. La condamnation est assortie des int\u00e9r\u00eats au taux l\u00e9gal \u00e0 compter du prononc\u00e9 de l&#8217;arr\u00eat, conform\u00e9ment \u00e0 l&#8217;article 1231-7 du code civil. La cour infirme ainsi le jugement de premi\u00e8re instance qui avait retenu une solution inverse en faveur du preneur. Sauf disposition contraire de la loi, ces int\u00e9r\u00eats courent \u00e0 compter du prononc\u00e9 du jugement \u00e0 moins que le juge n&#8217;en d\u00e9cide autrement.<\/p>\n<p>En cas de confirmation pure et simple par le juge d&#8217;appel d&#8217;une d\u00e9cision allouant une indemnit\u00e9 en r\u00e9paration d&#8217;un dommage, celle-ci porte de plein droit int\u00e9r\u00eat au taux l\u00e9gal \u00e0 compter du jugement de premi\u00e8re instance. Dans les autres cas, l&#8217;indemnit\u00e9 allou\u00e9e en appel porte int\u00e9r\u00eat \u00e0 compter de la d\u00e9cision d&#8217;appel.
