Pour un salari\u00e9 d\u00e9j\u00e0 absent depuis plusieurs semaines, le point sensible n&#8217;est pas seulement la dur\u00e9e inscrite sur le certificat m\u00e9dical. La difficult\u00e9 arrive souvent au moment de la prolongation : la CPAM peut contr\u00f4ler la justification m\u00e9dicale de l&#8217;arr\u00eat, les indemnit\u00e9s journali\u00e8res peuvent \u00eatre suspendues, et l&#8217;employeur peut cesser de compl\u00e9ter le salaire si le dossier n&#8217;est plus s\u00e9curis\u00e9.<\/p>\n<p>La situation est fr\u00e9quente apr\u00e8s un burn-out, une d\u00e9pression, une op\u00e9ration, un accident ou une maladie qui n\u00e9cessite plusieurs prolongations. Le salari\u00e9 pense \u00eatre prot\u00e9g\u00e9 parce que son m\u00e9decin a renouvel\u00e9 l&#8217;arr\u00eat. Or la caisse conserve un pouvoir de contr\u00f4le. L&#8217;employeur, lui, ne conna\u00eet pas le diagnostic, mais il voit l&#8217;absence se prolonger, demande les justificatifs, v\u00e9rifie l&#8217;attestation de salaire et peut contester certaines cons\u00e9quences sur la paie.<\/p>\n<p>L&#8217;enjeu est donc pratique : savoir ce que la CPAM peut demander, ce que l&#8217;employeur peut voir, comment r\u00e9agir \u00e0 une convocation du m\u00e9decin-conseil, et quelles preuves pr\u00e9parer si les IJSS ou le compl\u00e9ment employeur sont bloqu\u00e9s.<\/p>\n<h2>Ce qui change pour les arr\u00eats longs en 2026<\/h2>\n<p>Le mouvement de r\u00e9forme vise \u00e0 mieux contr\u00f4ler les arr\u00eats de travail et leurs prolongations. \u00c0 partir du 1er septembre 2026, les nouvelles r\u00e8gles limitent notamment la dur\u00e9e maximale de certains arr\u00eats prescrits en une seule fois, avec un plafond diff\u00e9rent selon qu&#8217;il s&#8217;agit d&#8217;un premier arr\u00eat ou d&#8217;une prolongation.<\/p>\n<p>Pour le salari\u00e9, cela ne signifie pas qu&#8217;un arr\u00eat long devient impossible. Cela signifie surtout que le dossier m\u00e9dical et administratif doit \u00eatre coh\u00e9rent \u00e0 chaque \u00e9tape. Une prolongation mal r\u00e9dig\u00e9e, transmise en retard ou insuffisamment comprise par la caisse peut d\u00e9clencher un blocage.<\/p>\n<p>Le premier r\u00e9flexe consiste \u00e0 s\u00e9parer trois sujets :<\/p>\n<ul>\n<li>la validit\u00e9 m\u00e9dicale de l&#8217;arr\u00eat, appr\u00e9ci\u00e9e par le m\u00e9decin et le service du contr\u00f4le m\u00e9dical ;<\/li>\n<li>le droit aux indemnit\u00e9s journali\u00e8res, appr\u00e9ci\u00e9 par la CPAM ;<\/li>\n<li>les cons\u00e9quences dans l&#8217;entreprise, notamment le maintien de salaire, la visite de reprise, la protection contre certaines ruptures et l&#8217;organisation du poste.<\/li>\n<\/ul>\n<p>Ces trois sujets sont li\u00e9s, mais ils ne se confondent pas. Un arr\u00eat m\u00e9dicalement justifi\u00e9 peut quand m\u00eame poser un probl\u00e8me administratif si les d\u00e9lais de transmission ou les pi\u00e8ces ne sont pas respect\u00e9s. \u00c0 l&#8217;inverse, un employeur ne peut pas exiger le diagnostic pour d\u00e9cider seul que l&#8217;arr\u00eat serait injustifi\u00e9.<\/p>\n<h2>Apr\u00e8s trois mois d&#8217;arr\u00eat, que peut contr\u00f4ler la CPAM ?<\/h2>\n<p>La CPAM peut v\u00e9rifier que les conditions d&#8217;indemnisation sont remplies. Le Code de la s\u00e9curit\u00e9 sociale impose notamment au b\u00e9n\u00e9ficiaire d&#8217;observer les prescriptions du praticien, de se soumettre aux contr\u00f4les du service du contr\u00f4le m\u00e9dical, de respecter les heures de sortie autoris\u00e9es, de s&#8217;abstenir de toute activit\u00e9 non autoris\u00e9e et d&#8217;informer la caisse en cas de reprise anticip\u00e9e.<\/p>\n<p>En pratique, le contr\u00f4le peut prendre plusieurs formes :<\/p>\n<ul>\n<li>convocation aupr\u00e8s du m\u00e9decin-conseil ;<\/li>\n<li>demande d&#8217;\u00e9l\u00e9ments m\u00e9dicaux au m\u00e9decin traitant ;<\/li>\n<li>v\u00e9rification de la coh\u00e9rence entre l&#8217;arr\u00eat, les sorties autoris\u00e9es et les activit\u00e9s d\u00e9clar\u00e9es ;<\/li>\n<li>examen de la dur\u00e9e et des prolongations successives ;<\/li>\n<li>contr\u00f4le d&#8217;une reprise partielle ou d&#8217;une activit\u00e9 non autoris\u00e9e.<\/li>\n<\/ul>\n<p>Le salari\u00e9 ne doit pas ignorer une convocation. Une absence non justifi\u00e9e au contr\u00f4le peut entra\u00eener une suspension des IJSS. Il faut donc conserver la convocation, pr\u00e9venir rapidement en cas d&#8217;impossibilit\u00e9 r\u00e9elle, demander un report si n\u00e9cessaire et garder la preuve de toute r\u00e9ponse.<\/p>\n<h2>L&#8217;employeur peut-il conna\u00eetre le motif m\u00e9dical ?<\/h2>\n<p>Non. L&#8217;employeur re\u00e7oit les volets qui lui permettent de justifier l&#8217;absence et de traiter la paie. Il n&#8217;a pas \u00e0 conna\u00eetre le diagnostic. Le secret m\u00e9dical continue de prot\u00e9ger le salari\u00e9, y compris lorsque l&#8217;arr\u00eat dure plusieurs mois.<\/p>\n<p>L&#8217;employeur peut demander :<\/p>\n<ul>\n<li>le justificatif d&#8217;arr\u00eat ou de prolongation ;<\/li>\n<li>les dates d&#8217;absence ;<\/li>\n<li>les \u00e9l\u00e9ments n\u00e9cessaires au traitement de la paie ;<\/li>\n<li>les informations utiles \u00e0 une visite de reprise ou de pr\u00e9-reprise, par les canaux pr\u00e9vus.<\/li>\n<\/ul>\n<p>En revanche, il ne peut pas exiger que le salari\u00e9 r\u00e9v\u00e8le sa pathologie, le traitement suivi ou le d\u00e9tail du dossier m\u00e9dical. Si la discussion d\u00e9rape vers le motif m\u00e9dical, il faut r\u00e9pondre par \u00e9crit de mani\u00e8re courte : l&#8217;arr\u00eat a \u00e9t\u00e9 prescrit par un m\u00e9decin, transmis \u00e0 la CPAM et \u00e0 l&#8217;employeur, et les informations m\u00e9dicales rel\u00e8vent du secret m\u00e9dical.<\/p>\n<p>Cette distinction est importante. Beaucoup de litiges naissent d&#8217;un m\u00e9lange entre la preuve de l&#8217;absence et le contenu m\u00e9dical de l&#8217;arr\u00eat. Le salari\u00e9 doit justifier son absence. Il n&#8217;a pas \u00e0 se justifier sur son diagnostic devant son sup\u00e9rieur hi\u00e9rarchique.<\/p>\n<h2>IJSS suspendues : les erreurs qui aggravent le dossier<\/h2>\n<p>La suspension des indemnit\u00e9s journali\u00e8res ne tombe pas toujours sans pr\u00e9venir. Elle est souvent pr\u00e9c\u00e9d\u00e9e d&#8217;une convocation, d&#8217;un courrier, d&#8217;une demande de pi\u00e8ces ou d&#8217;un contr\u00f4le. Les erreurs les plus fr\u00e9quentes sont simples.<\/p>\n<p>Premi\u00e8re erreur : ne pas retirer ou ouvrir les courriers de la CPAM. Le salari\u00e9 d\u00e9couvre ensuite la suspension sur son compte bancaire, alors que le d\u00e9lai utile pour r\u00e9pondre \u00e9tait d\u00e9j\u00e0 engag\u00e9.<\/p>\n<p>Deuxi\u00e8me erreur : r\u00e9pondre oralement seulement. Un appel t\u00e9l\u00e9phonique peut aider, mais il ne remplace pas un \u00e9crit dat\u00e9. Apr\u00e8s un \u00e9change avec la caisse, il faut confirmer par message depuis le compte ameli ou par courrier, en conservant une copie.<\/p>\n<p>Troisi\u00e8me erreur : laisser l&#8217;employeur interpr\u00e9ter seul la suspension. Si les IJSS sont suspendues, le compl\u00e9ment employeur peut \u00eatre affect\u00e9. Mais cela ne donne pas automatiquement \u00e0 l&#8217;employeur le droit de sanctionner le salari\u00e9, de qualifier l&#8217;absence d&#8217;injustifi\u00e9e ou de rompre le contrat sans examiner la situation.<\/p>\n<p>Quatri\u00e8me erreur : reprendre une activit\u00e9 sans clarification. M\u00eame une activit\u00e9 ponctuelle, b\u00e9n\u00e9vole ou ind\u00e9pendante peut poser difficult\u00e9 si elle est incompatible avec les prescriptions m\u00e9dicales ou non autoris\u00e9e.<\/p>\n<h2>Que faire d\u00e8s la convocation du m\u00e9decin-conseil ?<\/h2>\n<p>Il faut traiter la convocation comme une \u00e9tape d\u00e9cisive du dossier.<\/p>\n<p>Le salari\u00e9 doit d&#8217;abord v\u00e9rifier la date, le lieu, l&#8217;horaire et les modalit\u00e9s. S&#8217;il ne peut pas se pr\u00e9senter pour une raison m\u00e9dicale ou mat\u00e9rielle s\u00e9rieuse, il doit demander un report imm\u00e9diatement et garder la preuve de cette demande.<\/p>\n<p>Il doit ensuite pr\u00e9parer un dossier simple :<\/p>\n<ul>\n<li>arr\u00eats initiaux et prolongations ;<\/li>\n<li>comptes rendus m\u00e9dicaux utiles, si le m\u00e9decin les remet ;<\/li>\n<li>ordonnances et certificats de suivi ;<\/li>\n<li>justificatifs d&#8217;hospitalisation, de r\u00e9\u00e9ducation ou de soins ;<\/li>\n<li>\u00e9l\u00e9ments montrant l&#8217;impossibilit\u00e9 de reprendre le poste ;<\/li>\n<li>\u00e9changes avec l&#8217;employeur sur l&#8217;organisation du travail, si ces \u00e9changes \u00e9clairent la situation.<\/li>\n<\/ul>\n<p>Le but n&#8217;est pas de raconter toute l&#8217;histoire professionnelle. Le but est de montrer que l&#8217;arr\u00eat reste justifi\u00e9, que les prescriptions sont suivies et que les obligations de l&#8217;assur\u00e9 sont respect\u00e9es.<\/p>\n<p>Si le contr\u00f4le conclut \u00e0 une reprise possible alors que le m\u00e9decin traitant estime l&#8217;inverse, il faut demander rapidement les voies de contestation indiqu\u00e9es dans la d\u00e9cision. Les d\u00e9lais peuvent \u00eatre courts. Il ne faut pas attendre la paie suivante pour agir.<\/p>\n<h2>Prolongation refus\u00e9e ou IJSS coup\u00e9es : quels recours ?<\/h2>\n<p>La r\u00e9ponse d\u00e9pend de l&#8217;origine du blocage.<\/p>\n<p>Si la CPAM suspend les IJSS apr\u00e8s contr\u00f4le, il faut demander la d\u00e9cision \u00e9crite, identifier le motif exact et contester dans le d\u00e9lai indiqu\u00e9. La contestation doit viser le bon objet : contr\u00f4le m\u00e9dical, condition administrative, activit\u00e9 non autoris\u00e9e, absence au contr\u00f4le, heures de sortie ou transmission tardive.<\/p>\n<p>Si l&#8217;employeur cesse le compl\u00e9ment de salaire, il faut v\u00e9rifier la convention collective, l&#8217;anciennet\u00e9, les r\u00e8gles de maintien de salaire, les IJSS re\u00e7ues ou suspendues, et les informations transmises \u00e0 l&#8217;entreprise. Le refus de compl\u00e9ment n&#8217;a pas toujours la m\u00eame base juridique selon que la CPAM a suspendu les indemnit\u00e9s ou selon que l&#8217;employeur invoque un d\u00e9faut de justificatif.<\/p>\n<p>Si l&#8217;employeur engage une proc\u00e9dure disciplinaire ou une rupture pendant l&#8217;arr\u00eat, il faut isoler les faits reproch\u00e9s. Un arr\u00eat maladie ne prot\u00e8ge pas contre toute rupture, mais il interdit les d\u00e9cisions discriminatoires li\u00e9es \u00e0 l&#8217;\u00e9tat de sant\u00e9. La chronologie devient alors d\u00e9terminante : date des arr\u00eats, date des courriers, motifs invoqu\u00e9s, demandes de l&#8217;employeur et \u00e9ventuelles pressions sur le retour.<\/p>\n<h2>Quelles pi\u00e8ces conserver avant de contester ?<\/h2>\n<p>Le dossier doit \u00eatre construit avant le conflit, pas apr\u00e8s.<\/p>\n<p>Il faut conserver les arr\u00eats de travail, les prolongations, les preuves de transmission \u00e0 la CPAM et \u00e0 l&#8217;employeur, les captures du compte ameli, les courriers de la caisse, les convocations au contr\u00f4le m\u00e9dical, les d\u00e9cisions de suspension, les bulletins de paie, les attestations de salaire, les virements d&#8217;IJSS et les \u00e9changes avec l&#8217;entreprise.<\/p>\n<p>Il faut aussi conserver les \u00e9l\u00e9ments li\u00e9s au poste : fiche de poste, planning, charge de travail, demandes de reprise progressive, \u00e9changes sur le t\u00e9l\u00e9travail ou l&#8217;am\u00e9nagement, avis du m\u00e9decin du travail, convocation \u00e0 une visite de reprise ou de pr\u00e9-reprise.<\/p>\n<p>Ces pi\u00e8ces permettent de r\u00e9pondre \u00e0 trois questions :<\/p>\n<ul>\n<li>l&#8217;arr\u00eat \u00e9tait-il r\u00e9guli\u00e8rement prescrit et transmis ?<\/li>\n<li>le salari\u00e9 a-t-il respect\u00e9 ses obligations pendant l&#8217;arr\u00eat ?<\/li>\n<li>l&#8217;employeur a-t-il tir\u00e9 des cons\u00e9quences excessives ou discriminatoires de la situation ?<\/li>\n<\/ul>\n<p>Sans ces \u00e9l\u00e9ments, la contestation devient plus difficile. Avec eux, il est souvent possible de reconstituer la chronologie et de cibler le bon recours.<\/p>\n<h2>Paris et \u00cele-de-France : anticiper le contentieux prud&#8217;homal<\/h2>\n<p>\u00c0 Paris et en \u00cele-de-France, les litiges li\u00e9s aux arr\u00eats longs se pr\u00e9sentent souvent sous deux formes : une contestation sociale devant la caisse, puis un volet prud&#8217;homal contre l&#8217;employeur.<\/p>\n<p>Le volet CPAM concerne les IJSS, la d\u00e9cision du service m\u00e9dical ou une demande de remboursement. Le volet prud&#8217;homal concerne le salaire, le maintien conventionnel, la sanction, la rupture du contrat, la discrimination li\u00e9e \u00e0 l&#8217;\u00e9tat de sant\u00e9 ou l&#8217;absence de reprise organis\u00e9e correctement.<\/p>\n<p>Il faut donc \u00e9viter de m\u00e9langer les courriers. Un recours contre la CPAM ne remplace pas une mise en demeure \u00e0 l&#8217;employeur. Une contestation prud&#8217;homale ne corrige pas automatiquement une suspension d&#8217;IJSS. Les deux d\u00e9marches peuvent \u00eatre n\u00e9cessaires, mais elles n&#8217;ont pas le m\u00eame destinataire ni le m\u00eame objet.<\/p>\n<p>Pour les salari\u00e9s suivis par un m\u00e9decin du travail en \u00cele-de-France, la visite de pr\u00e9-reprise peut aussi devenir utile lorsque l&#8217;arr\u00eat se prolonge. Elle permet d&#8217;anticiper les am\u00e9nagements possibles, d&#8217;\u00e9viter une reprise brutale et de documenter les difficult\u00e9s li\u00e9es au poste.<\/p>\n<h2>Le bon r\u00e9flexe : \u00e9crire vite, mais \u00e9crire juste<\/h2>\n<p>Face \u00e0 un arr\u00eat long, il ne faut pas multiplier les messages d\u00e9fensifs. Il faut \u00e9crire peu, mais utile.<\/p>\n<p>\u00c0 la CPAM, le message doit r\u00e9pondre au motif pr\u00e9cis du contr\u00f4le ou de la suspension. \u00c0 l&#8217;employeur, le message doit rappeler les dates, la transmission des justificatifs, le secret m\u00e9dical et les demandes li\u00e9es \u00e0 la paie ou \u00e0 la reprise. Au m\u00e9decin traitant ou au m\u00e9decin du travail, il faut demander les documents utiles \u00e0 la continuit\u00e9 du dossier.<\/p>\n<p>L&#8217;objectif n&#8217;est pas de convaincre tout le monde dans un seul courrier. L&#8217;objectif est de cr\u00e9er une chronologie propre : prescription, transmission, contr\u00f4le, r\u00e9ponse, d\u00e9cision, contestation.<\/p>\n<p>Dans un arr\u00eat maladie long, cette chronologie vaut souvent autant que le fond m\u00e9dical.
