L\u2019indemnit\u00e9 d\u2019occupation entre provision et condition<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Introduction sans titre.<br \/>Le Tribunal judiciaire de Toulon, P\u00f4le JCP, dans une ordonnance de r\u00e9f\u00e9r\u00e9 du 27 mars 2026 (n\u00b025\/03053), a \u00e9t\u00e9 saisi d\u2019un litige opposant un bailleur, office public de l\u2019habitat, \u00e0 ses locataires, un couple vivant avec trois enfants. Les parties \u00e9taient li\u00e9es par un bail du 6 septembre 2012 contenant une clause r\u00e9solutoire. Un commandement de payer visant cette clause avait \u00e9t\u00e9 signifi\u00e9 le 2 septembre 2025, pour un arri\u00e9r\u00e9 locatif. Les locataires n\u2019ayant pas apur\u00e9 la dette dans le d\u00e9lai de deux mois, le bailleur a assign\u00e9 le 12 novembre 2025 afin de voir constater la r\u00e9siliation de plein droit et obtenir l\u2019expulsion. Lors de l\u2019audience du 27 janvier 2026, la dette actualis\u00e9e s\u2019\u00e9levait \u00e0 754,35 euros, somme non contest\u00e9e. Un constat d\u2019accord sign\u00e9 le 21 novembre 2025 pr\u00e9voyait un \u00e9ch\u00e9ancier de 16 mensualit\u00e9s de 50 euros, mais n\u2019avait pas \u00e9t\u00e9 soumis \u00e0 homologation. Les locataires sollicitaient le maintien dans les lieux avec un plan d\u2019apurement. La question de droit \u00e9tait de savoir si le juge des r\u00e9f\u00e9r\u00e9s, apr\u00e8s avoir constat\u00e9 l\u2019acquisition de la clause r\u00e9solutoire, pouvait accorder des d\u00e9lais de paiement en application de l\u2019article 24 V de la loi du 6 juillet 1989, suspendre les effets de cette clause et subordonner l\u2019expulsion \u00e0 la d\u00e9faillance de l\u2019\u00e9ch\u00e9ancier. Le tribunal a r\u00e9pondu par l\u2019affirmative : il a constat\u00e9 la r\u00e9siliation de plein droit au 2 novembre 2025, condamn\u00e9 solidairement les locataires au paiement de la dette et d\u2019une indemnit\u00e9 d\u2019occupation, autoris\u00e9 un apurement en 15 mensualit\u00e9s de 50 euros, suspendu les effets de la clause r\u00e9solutoire pendant les d\u00e9lais, et pr\u00e9cis\u00e9 qu\u2019en cas de paiement int\u00e9gral la clause serait r\u00e9put\u00e9e ne pas avoir jou\u00e9, tandis qu\u2019en cas de d\u00e9faut elle reprendrait effet sans nouvelle d\u00e9cision.<\/p>\n<h2 id=\"i-la-conciliation-entre-constat-de-la-resiliation-et-octroi-de-delais-de-paiemen\">I. La conciliation entre constat de la r\u00e9siliation et octroi de d\u00e9lais de paiement par le juge des r\u00e9f\u00e9r\u00e9s<\/h2>\n<p><\/p>\n<h3 id=\"a-la-regularite-du-constat-de-lacquisition-de-la-clause-resolutoire\">A. La r\u00e9gularit\u00e9 du constat de l\u2019acquisition de la clause r\u00e9solutoire<\/h3>\n<p>Le tribunal a commenc\u00e9 par v\u00e9rifier la r\u00e9gularit\u00e9 formelle de la proc\u00e9dure. Il rel\u00e8ve que le commandement de payer du 2 septembre 2025 reproduit les dispositions l\u00e9gales et la clause r\u00e9solutoire, et que l\u2019assignation a \u00e9t\u00e9 notifi\u00e9e au repr\u00e9sentant de l\u2019\u00c9tat dans les d\u00e9lais. La dette locative, arr\u00eat\u00e9e au 26 janvier 2026 \u00e0 754,35 euros, n\u2019est pas contest\u00e9e. Le juge constate alors que <em>&#8221; le locataire n\u2019a pas apur\u00e9 l&#8217;int\u00e9gralit\u00e9 de la dette dans ce d\u00e9lai ni par la suite et encore moins sollicit\u00e9 de d\u00e9lai par les voies l\u00e9gales. L&#8217;acquisition de la clause r\u00e9solutoire du contrat de bail est acquise \u00e0 la date du 02 novembre 2025 \u00e0 minuit &#8220;<\/em>. Ce raisonnement est conforme \u00e0 la jurisprudence constante selon laquelle le jeu de la clause r\u00e9solutoire est acquis d\u00e8s lors que le locataire n\u2019a pas pay\u00e9 dans le mois suivant le commandement, sans que des versements post\u00e9rieurs puissent y rem\u00e9dier. La Cour d\u2019appel de Montpellier rappelle ainsi que <em>&#8221; les sommes vers\u00e9es post\u00e9rieurement au d\u00e9lai de un mois suivant la date du commandement sont sans incidence sur l&#8217;acquisition de la clause r\u00e9solutoire &#8220;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67c1566b0e3f1fdf031a2995\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Montpellier, 27 f\u00e9vrier 2025, n\u00b024\/02618)<\/a><\/strong>. De m\u00eame, la Cour d\u2019appel de Grenoble juge que <em>&#8221; c&#8217;est \u00e0 bon droit que le premier juge a retenu la clause r\u00e9solutoire acquise au 8 octobre 2023 &#8220;<\/em> lorsque le commandement n\u2019a pas \u00e9t\u00e9 suivi d\u2019effet dans le d\u00e9lai <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67e39cf22b19620bb73a2229\" rel=\"nofollow\" target=\"_blank\">(Cour d\u2019appel de Grenoble, 25 mars 2025, n\u00b024\/02447)<\/a><\/strong>. Le tribunal de Toulon applique donc strictement les conditions l\u00e9gales de la clause r\u00e9solutoire.<\/p>\n<h3 id=\"b-loctroi-de-delais-de-paiement-comme-correctif-a-lanteriorite-de-la-resiliation\">B. L\u2019octroi de d\u00e9lais de paiement comme correctif \u00e0 l\u2019anteriorit\u00e9 de la r\u00e9siliation<\/h3>\n<p>Malgr\u00e9 ce constat, le juge des r\u00e9f\u00e9r\u00e9s accorde aux locataires des d\u00e9lais de paiement sur le fondement de l\u2019article 24 V de la loi du 6 juillet 1989. Ce texte permet au juge, \u00e0 la demande du locataire, du bailleur ou d\u2019office, d\u2019accorder des d\u00e9lais de paiement dans la limite de trois ann\u00e9es, \u00e0 condition que le locataire ait repris le versement int\u00e9gral du loyer courant avant l\u2019audience et soit en situation de r\u00e9gler sa dette. En l\u2019esp\u00e8ce, le tribunal rel\u00e8ve que <em>&#8221; le locataire r\u00e8gle syst\u00e9matiquement le loyer depuis de nombreux mois &#8220;<\/em> et que ses ressources mensuelles (2 534 euros) permettent un remboursement de 50 euros par mois. Il autorise ainsi un apurement en 15 mensualit\u00e9s de 50 euros, en sus du loyer courant. Cette d\u00e9cision est remarquable car elle intervient apr\u00e8s le constat de la r\u00e9siliation, ce qui pourrait sembler contradictoire. Le juge prend soin de suspendre les effets de la clause r\u00e9solutoire pendant les d\u00e9lais, \u00e9vitant ainsi toute antinomie. Il utilise la facult\u00e9 offerte par l\u2019article 24 V, qui vise pr\u00e9cis\u00e9ment \u00e0 permettre au locataire de retrouver un \u00e9quilibre financier tout en conservant son logement. Cette conciliation entre le constat de la r\u00e9siliation et l\u2019octroi de d\u00e9lais est au c\u0153ur de la pratique des juges du fond, qui tendent \u00e0 privil\u00e9gier le maintien dans les lieux lorsque les perspectives de remboursement sont s\u00e9rieuses.<\/p>\n<h2 id=\"ii-loriginalite-dun-dispositif-conditionnel-suspendu-a-lexecution-de-lecheancier\">II. L\u2019originalit\u00e9 d\u2019un dispositif conditionnel suspendu \u00e0 l\u2019ex\u00e9cution de l\u2019\u00e9ch\u00e9ancier<\/h2>\n<p><\/p>\n<h3 id=\"a-la-suspension-des-effets-de-la-clause-resolutoire-et-la-reputation-de-non-joui\">A. La suspension des effets de la clause r\u00e9solutoire et la r\u00e9putation de non-jouissance<\/h3>\n<p>Le tribunal ne se contente pas d\u2019accorder des d\u00e9lais : il en organise les cons\u00e9quences juridiques avec pr\u00e9cision. Il dispose que <em>&#8221; pendant les d\u00e9lais ainsi accord\u00e9s, les effets de la clause de r\u00e9siliation de plein droit sont suspendus &#8220;<\/em> et que <em>&#8221; si le locataire se lib\u00e8re du montant selon les modalit\u00e9s sus-indiqu\u00e9es, la clause de r\u00e9siliation de plein droit sera r\u00e9put\u00e9e ne pas avoir jou\u00e9 &#8220;<\/em>. Cette technique de la condition r\u00e9solutoire permet au locataire d\u2019effacer r\u00e9troactivement la r\u00e9siliation, ce qui est une solution \u00e9quitable. En cas de paiement int\u00e9gral, le bail est r\u00e9tabli comme s\u2019il n\u2019avait jamais \u00e9t\u00e9 rompu. \u00c0 l\u2019inverse, si le locataire ne respecte pas l\u2019\u00e9ch\u00e9ancier, <em>&#8221; la clause r\u00e9solutoire reprendra son effet et le bailleur, sans qu\u2019une nouvelle d\u00e9cision judiciaire soit prise, sera en droit d\u2019invoquer la r\u00e9siliation de plein droit du bail \u00e0 compter de la date de la d\u00e9ch\u00e9ance du terme &#8220;<\/em>. Ce m\u00e9canisme \u00e9vite un nouveau proc\u00e8s et donne une force ex\u00e9cutoire imm\u00e9diate \u00e0 l\u2019expulsion. Il s\u2019inscrit dans la logique des dispositions de l\u2019article 24 V qui permettent au juge de subordonner la suspension des effets de la clause \u00e0 l\u2019ex\u00e9cution de l\u2019\u00e9ch\u00e9ancier. Le tribunal reprend ici une pratique courante, mais la r\u00e9daction de son dispositif est particuli\u00e8rement claire et d\u00e9taill\u00e9e, offrant une s\u00e9curit\u00e9 juridique aux deux parties.<\/p>\n<h3 id=\"b-lindemnite-doccupation-entre-provision-et-condition\">B. L\u2019indemnit\u00e9 d\u2019occupation entre provision et condition<\/h3>\n<p>Par ailleurs, le tribunal condamne solidairement les locataires au paiement d\u2019une indemnit\u00e9 d\u2019occupation \u00e0 compter de la r\u00e9siliation, soit le 2 novembre 2025. Cependant, cette indemnit\u00e9 est provisoire et non indexable, et son montant est fix\u00e9 par r\u00e9f\u00e9rence au dernier loyer augment\u00e9 des charges. Le juge pr\u00e9cise que la fraction d\u00e9j\u00e0 \u00e9chue de cette indemnit\u00e9 jusqu\u2019au 26 janvier 2026 est incluse dans la condamnation au titre de l\u2019arri\u00e9r\u00e9. Mais surtout, il conditionne l\u2019exigibilit\u00e9 de l\u2019indemnit\u00e9 d\u2019occupation future \u00e0 la d\u00e9faillance du locataire : <em>&#8221; Le locataire b\u00e9n\u00e9ficiant d\u2019un \u00e9ch\u00e9ancier, l\u2019indemnit\u00e9 d\u2019occupation prendra effet \u00e0 compter de la d\u00e9ch\u00e9ance du terme par le bailleur. En ce cas, l\u2019indemnit\u00e9 d\u2019occupation sera r\u00e9actualis\u00e9e au montant du dernier loyer \u00e9chu, charges incluses. &#8220;<\/em> Ce dispositif original signifie que tant que le locataire respecte l\u2019\u00e9ch\u00e9ancier, il ne paie que le loyer courant et les mensualit\u00e9s de la dette, sans indemnit\u00e9 d\u2019occupation. En cas de d\u00e9faut, l\u2019indemnit\u00e9 d\u2019occupation devient exigible r\u00e9troactivement et pour l\u2019avenir. Cette construction juridique est habile : elle concilie la n\u00e9cessit\u00e9 de prot\u00e9ger le bailleur contre l\u2019occupation sans titre avec l\u2019objectif social de maintien dans les lieux. Le juge utilise sa facult\u00e9 d\u2019am\u00e9nager les effets de la clause r\u00e9solutoire, comme le permet l\u2019article 24 V.
