La fixation provisionnelle de l\u2019indemnit\u00e9 d\u2019occupation<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Le 27 mars 2026, le Tribunal judiciaire de Toulon, P\u00f4le JCP, statuant en r\u00e9f\u00e9r\u00e9 (n\u00b025\/02379), a \u00e9t\u00e9 saisi d\u2019un litige locatif. Un bail d\u2019habitation avait \u00e9t\u00e9 conclu le 8 juin 2023, contenant une clause r\u00e9solutoire. Le 16 juillet 2025, le bailleur a fait d\u00e9livrer un commandement de payer visant cette clause. Le locataire n\u2019a pas r\u00e9gl\u00e9 l\u2019int\u00e9gralit\u00e9 de la dette dans le d\u00e9lai de deux mois. Le bailleur a alors assign\u00e9 le locataire en r\u00e9f\u00e9r\u00e9 pour faire constater l\u2019acquisition de la clause r\u00e9solutoire, obtenir son expulsion et le paiement des sommes dues. Le locataire, b\u00e9n\u00e9ficiant d\u2019un diagnostic social, a sollicit\u00e9 des d\u00e9lais de paiement et son maintien dans les lieux. La question de droit portait sur la possibilit\u00e9 pour le juge des r\u00e9f\u00e9r\u00e9s d\u2019accorder des d\u00e9lais de paiement apr\u00e8s l\u2019acquisition de la clause r\u00e9solutoire, tout en constatant cette acquisition et en ordonnant une expulsion conditionnelle. Le tribunal a constat\u00e9 l\u2019acquisition de la clause r\u00e9solutoire au 16 septembre 2025, condamn\u00e9 le locataire au paiement d\u2019une provision de 3.725,12 euros, lui a accord\u00e9 trente-six mensualit\u00e9s de 103 euros, suspendu les effets de la clause pendant ces d\u00e9lais, et dit qu\u2019en cas de non-respect, la clause reprendrait son effet et l\u2019expulsion serait ordonn\u00e9e sans nouvelle d\u00e9cision. Il a \u00e9galement fix\u00e9 une indemnit\u00e9 d\u2019occupation provisionnelle.<\/p>\n<h2 id=\"i-la-conciliation-entre-lacquisition-de-la-clause-resolutoire-et-le-pouvoir-judi\">I. La conciliation entre l\u2019acquisition de la clause r\u00e9solutoire et le pouvoir judiciaire d\u2019octroi de d\u00e9lais<\/h2>\n<p><\/p>\n<h3 id=\"a-la-constatation-rigoureuse-de-la-resiliation-de-plein-droit\">A. La constatation rigoureuse de la r\u00e9siliation de plein droit<\/h3>\n<p>Le tribunal a d\u2019abord v\u00e9rifi\u00e9 la r\u00e9gularit\u00e9 du commandement de payer du 16 juillet 2025, conform\u00e9ment aux exigences l\u00e9gales. Il rel\u00e8ve que la clause r\u00e9solutoire a jou\u00e9 \u00e0 l\u2019expiration du d\u00e9lai de deux mois, soit le 16 septembre 2025 \u00e0 minuit. Cette solution s\u2019inscrit dans la logique des baux d\u2019habitation : le jeu de la clause r\u00e9solutoire est automatique d\u00e8s lors que le commandement est r\u00e9gulier et que le locataire n\u2019a pas pay\u00e9 ou sollicit\u00e9 de d\u00e9lais dans les formes l\u00e9gales. Le juge constate ainsi que <em>&#8220;le bail s&#8217;est trouv\u00e9 r\u00e9sili\u00e9 de plein droit le 16 septembre 2025 \u00e0 minuit par acquisition de la clause r\u00e9solutoire&#8221;<\/em>. Il ne s\u2019agit pas d\u2019une d\u00e9cision constitutive, mais d\u2019un simple constat. La Cour d\u2019appel de Grenoble, le 11 mars 2025 (n\u00b024\/02632), avait d\u00e9j\u00e0 rappel\u00e9 que <em>&#8220;la clause r\u00e9solutoire \u00e9tait donc acquise au 6 d\u00e9cembre 2023 et non pas au 16 novembre 2023 comme retenu par le premier juge&#8221;<\/em>, soulignant la n\u00e9cessit\u00e9 de fixer avec pr\u00e9cision la date de l\u2019acquisition. En l\u2019esp\u00e8ce, le tribunal suit cette logique en datant la r\u00e9siliation au 16 septembre 2025. Cette rigueur est indispensable pour d\u00e9terminer le point de d\u00e9part de l\u2019indemnit\u00e9 d\u2019occupation.<\/p>\n<h3 id=\"b-loctroi-conditionnel-de-delais-de-paiement-malgre-la-resiliation-acquise\">B. L\u2019octroi conditionnel de d\u00e9lais de paiement malgr\u00e9 la r\u00e9siliation acquise<\/h3>\n<p>Le tribunal a cependant fait usage de la facult\u00e9 offerte par l\u2019article 24 V de la loi du 6 juillet 1989. Il rappelle le texte : <em>&#8220;Le juge peut, \u00e0 la demande du locataire, du bailleur ou d&#8217;office, \u00e0 la condition que le locataire soit en situation de r\u00e9gler sa dette locative et qu&#8217;il ait repris le versement int\u00e9gral du loyer courant avant la date de l&#8217;audience, accorder des d\u00e9lais de paiement dans la limite de trois ann\u00e9es&#8221;<\/em>. Il constate que le locataire a repris le paiement du loyer courant (le mois de d\u00e9cembre 2025 a \u00e9t\u00e9 pay\u00e9) et qu\u2019il est en capacit\u00e9 d\u2019apurer sa dette gr\u00e2ce \u00e0 la reprise des APL. Il lui accorde trente-six mensualit\u00e9s de 103 euros. Cette d\u00e9cision est conforme \u00e0 la jurisprudence de la Cour d\u2019appel de Paris (30 janvier 2025, n\u00b024\/07377) qui \u00e9nonce que le juge peut accorder des d\u00e9lais <em>&#8220;\u00e0 la condition que le locataire soit en situation de r\u00e9gler sa dette locative et qu&#8217;il ait repris le versement int\u00e9gral du loyer courant avant la date de l&#8217;audience&#8221;<\/em>. Le tribunal innove cependant en maintenant la constatation de la r\u00e9siliation tout en suspendant ses effets. Il \u00e9vite ainsi une contradiction apparente entre l\u2019acquisition de la clause et l\u2019octroi de d\u00e9lais, solution pragmatique d\u00e9j\u00e0 admise en jurisprudence.<\/p>\n<h2 id=\"ii-les-consequences-pratiques-du-dispositif-hybride-expulsion-sous-condition-et-\">II. Les cons\u00e9quences pratiques du dispositif hybride : expulsion sous condition et indemnit\u00e9 d\u2019occupation<\/h2>\n<p><\/p>\n<h3 id=\"a-le-mecanisme-original-de-lexpulsion-conditionnelle-suspendue-a-la-defaillance\">A. Le m\u00e9canisme original de l\u2019expulsion conditionnelle suspendue \u00e0 la d\u00e9faillance<\/h3>\n<p>Le tribunal ne se contente pas d\u2019octroyer des d\u00e9lais. Il pr\u00e9voit que, si le locataire respecte l\u2019\u00e9ch\u00e9ancier, <em>&#8220;la clause de r\u00e9siliation de plein droit sera r\u00e9put\u00e9e ne pas avoir jou\u00e9&#8221;<\/em>. En revanche, en cas de d\u00e9faut de paiement, <em>&#8220;la clause r\u00e9solutoire reprendra son effet et le bailleur, sans qu&#8217;une nouvelle d\u00e9cision judiciaire soit prise, sera en droit d&#8217;invoquer la r\u00e9siliation de plein droit du bail&#8221;<\/em>. Cette technique de la clause r\u00e9solutoire conditionnelle est originale : elle permet d\u2019\u00e9viter une nouvelle saisine du juge en cas de non-respect des d\u00e9lais. Le tribunal ordonne alors l\u2019expulsion et la d\u00e9ch\u00e9ance du terme. Ce dispositif est efficace mais soul\u00e8ve une difficult\u00e9 th\u00e9orique : la r\u00e9siliation \u00e9tant constat\u00e9e au 16 septembre 2025, la suspension des effets ne peut r\u00e9troagir sur la p\u00e9riode ant\u00e9rieure aux d\u00e9lais. Le juge combine donc une r\u00e9siliation pass\u00e9e avec un espoir de r\u00e9siliation an\u00e9antie sous condition r\u00e9solutoire. Cette construction, bien que pragmatique, pourrait \u00eatre critiqu\u00e9e pour son manque de nettet\u00e9 juridique.<\/p>\n<h3 id=\"b-la-fixation-provisionnelle-de-lindemnite-doccupation\">B. La fixation provisionnelle de l\u2019indemnit\u00e9 d\u2019occupation<\/h3>\n<p>Le tribunal condamne le locataire, occupant sans droit ni titre depuis le 16 septembre 2025, \u00e0 payer une indemnit\u00e9 d\u2019occupation provisionnelle \u00e9gale au montant du loyer et des charges, non indexable et sans int\u00e9r\u00eat. Il pr\u00e9cise que cette indemnit\u00e9 prendra effet \u00e0 compter de la r\u00e9siliation, mais que, pendant la dur\u00e9e des d\u00e9lais, elle est suspendue. En cas de d\u00e9faillance, l\u2019indemnit\u00e9 sera r\u00e9actualis\u00e9e au montant du dernier loyer \u00e9chu. Le juge retient le caract\u00e8re non contestable de cette provision en r\u00e9f\u00e9r\u00e9, s\u2019appuyant sur la nature mixte de l\u2019indemnit\u00e9 d\u2019occupation. Il \u00e9carte toute indexation ou int\u00e9r\u00eat, s\u2019agissant d\u2019une obligation non contractuelle. Cette solution est classique. La provision de 3.725,12 euros inclut d\u00e9j\u00e0 la fraction de l\u2019indemnit\u00e9 d\u2019occupation \u00e9chue entre la r\u00e9siliation et l\u2019ordonnance. Le tribunal limite ainsi l\u2019effet r\u00e9troactif de la suspension des effets de la clause r\u00e9solutoire. La construction est coh\u00e9rente mais complexe, car elle distingue la p\u00e9riode avant l\u2019\u00e9ch\u00e9ancier (indemnit\u00e9 due) et la p\u00e9riode pendant l\u2019\u00e9ch\u00e9ancier (indemnit\u00e9 suspendue conditionnellement).
