L&#8217;EXIGENCE D\u2019UNE PREUVE RIGOUREUSE DE L\u2019EXISTENCE DU CONTRAT DE VENTE<\/h2>\n<p><\/p>\n<h3 id=\"a-la-charge-de-la-preuve-et-les-modes-de-preuve-admis\">A. La charge de la preuve et les modes de preuve admis<\/h3>\n<p>Le tribunal judiciaire du Havre, dans son jugement du 30 mars 2026, rappelle que celui qui r\u00e9clame l\u2019ex\u00e9cution d\u2019une obligation doit la prouver, conform\u00e9ment \u00e0 l\u2019article 1353 du code civil. La demanderesse soutient avoir acquis un v\u00e9hicule Citro\u00ebn au prix de mille euros aupr\u00e8s du d\u00e9fendeur. S\u2019agissant d\u2019une somme inf\u00e9rieure \u00e0 mille cinq cents euros, l\u2019article 1er du d\u00e9cret n\u00b0 80-533 du 15 juillet 1980 modifi\u00e9 autorise une preuve par tous moyens. Cependant, la libert\u00e9 probatoire ne dispense pas la partie de rapporter des \u00e9l\u00e9ments suffisamment pr\u00e9cis et concordants. En l\u2019esp\u00e8ce, la demanderesse verse un formulaire de certificat de cession non dat\u00e9 et non sign\u00e9 par elle-m\u00eame. Ce document ne peut \u00e9tablir, \u00e0 lui seul, la conclusion du contrat. La demanderesse ne produit aucun re\u00e7u de paiement, ni aucun autre \u00e9crit \u00e9manant du vendeur. La juridiction souligne ainsi que la simple all\u00e9gation d\u2019un paiement en esp\u00e8ces, sans commencement de preuve par \u00e9crit, ne satisfait pas \u00e0 l\u2019exigence de l\u2019article 1353 du code civil. Le tribunal applique donc strictement les r\u00e8gles de la charge de la preuve, m\u00eame dans le cadre d\u2019une proc\u00e9dure orale o\u00f9 le d\u00e9fendeur ne compara\u00eet pas.<\/p>\n<h3 id=\"b-la-force-probante-du-certificat-de-cession-et-labsence-de-commencement-de-preu\">B. La force probante du certificat de cession et l\u2019absence de commencement de preuve<\/h3>\n<p>Le formulaire de cession produit ne comporte ni la date de la vente ni la signature de l\u2019acqu\u00e9reur. Or, selon une jurisprudence constante, le certificat de cession constitue un document essentiel pour attester du transfert de propri\u00e9t\u00e9 d\u2019un v\u00e9hicule d\u2019occasion. En l\u2019absence de signature de l\u2019acheteur, cet \u00e9crit ne vaut ni commencement de preuve par \u00e9crit ni aveu de la part du vendeur. La Cour d\u2019appel de Toulouse, dans un arr\u00eat du 8 avril 2025 (n\u00b023\/02166), avait retenu la validit\u00e9 d\u2019un certificat de cession sign\u00e9 par les deux parties et rev\u00eatu d\u2019un tampon commercial. Ici, la demanderesse ne d\u00e9montre pas avoir sign\u00e9 le document, et le vendeur est d\u00e9faillant. Le tribunal en d\u00e9duit que le formulaire ne peut suffire \u00e0 prouver la r\u00e9alit\u00e9 de la vente. Cette solution s\u2019inscrit dans une logique de protection des parties contre les risques de fraude, en exigeant une manifestation claire et non \u00e9quivoque du consentement. En outre, le jugement p\u00e9nal rendu le 8 avril 2025 par le tribunal correctionnel du Havre, qui condamne le d\u00e9fendeur pour faux et escroquerie, ne saurait pallier l\u2019absence de preuve civile du contrat, car une d\u00e9cision p\u00e9nale n\u2019a autorit\u00e9 absolue au civil que sur l\u2019existence du fait mat\u00e9riel et la culpabilit\u00e9, non sur les relations contractuelles entre parties priv\u00e9es <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/67adc54bff4fdee7ba5c51f8\" rel=\"nofollow\" target=\"_blank\">(Cass. 3e civ., 13 f\u00e9vrier 2025, n\u00b018-25.531)<\/a><\/strong>.<\/p>\n<h2 id=\"ii-la-position-du-tribunal-un-rejet-fonde-sur-linsuffisance-des-elements-de-preu\">II. LA POSITION DU TRIBUNAL : UN REJET FOND\u00c9 SUR L\u2019INSUFFISANCE DES \u00c9L\u00c9MENTS DE PREUVE<\/h2>\n<p><\/p>\n<h3 id=\"a-labsence-de-preuve-du-paiement-du-prix-et-de-la-conclusion-du-contrat\">A. L\u2019absence de preuve du paiement du prix et de la conclusion du contrat<\/h3>\n<p>La demanderesse reconna\u00eet ne pas d\u00e9tenir de re\u00e7u de paiement. Elle verse une plainte p\u00e9nale d\u00e9pos\u00e9e le 7 juin 2024, mais celle-ci n\u2019a donn\u00e9 lieu \u00e0 aucune poursuite effective contre le d\u00e9fendeur, malgr\u00e9 d\u2019autres condamnations. Le tribunal \u00e9carte \u00e9galement la d\u00e9claration d\u2019une proche du d\u00e9fendeur, recueillie lors de l\u2019audience correctionnelle, selon laquelle la demanderesse aurait \u00e9t\u00e9 victime des m\u00eames agissements. Une telle d\u00e9claration, \u00e9manant d\u2019un membre de la famille, ne constitue pas une preuve objective de la vente et du paiement. Le juge civil exige des \u00e9l\u00e9ments concrets, tels qu\u2019un virement bancaire, un ch\u00e8que ou un \u00e9crit \u00e9manant du vendeur. En l\u2019\u00e9tat, la demanderesse ne rapporte aucun fait juridique \u00e9tablissant la r\u00e9alit\u00e9 de l\u2019obligation. D\u00e8s lors, le tribunal estime que la demande de dommages-int\u00e9r\u00eats fond\u00e9e sur l\u2019inex\u00e9cution contractuelle (article 1217 du code civil) n\u2019est pas fond\u00e9e. Il rejette donc l\u2019int\u00e9gralit\u00e9 des pr\u00e9tentions de la demanderesse.<\/p>\n<h3 id=\"b-les-consequences-procedurales-et-accessoires-du-deboute\">B. Les cons\u00e9quences proc\u00e9durales et accessoires du d\u00e9bout\u00e9<\/h3>\n<p>La demanderesse, partie succombante, est condamn\u00e9e aux d\u00e9pens en application de l\u2019article 696 du code de proc\u00e9dure civile. Le tribunal rejette \u00e9galement sa demande au titre de l\u2019article 700 du m\u00eame code, apr\u00e8s avoir constat\u00e9 l\u2019absence de toute preuve de son pr\u00e9judice et l\u2019iniquit\u00e9 qu\u2019il y aurait \u00e0 faire supporter ses frais par le d\u00e9fendeur. Cette solution est logique : la rigueur probatoire impos\u00e9e \u00e0 la demanderesse conduit \u00e0 son \u00e9chec sur le fond, et les demandes accessoires suivent le sort du principal. Le jugement, rendu par d\u00e9faut en l\u2019absence du d\u00e9fendeur, est r\u00e9put\u00e9 contradictoire et assorti de l\u2019ex\u00e9cution provisoire de droit.
