L&#8217;autorisation de la vente amiable comme issue pragmatique<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>Par un jugement rendu le 30 mars 2026, le juge de l&#8217;ex\u00e9cution du tribunal judiciaire d&#8217;Amiens, statuant en mati\u00e8re de saisies immobili\u00e8res, devait se prononcer sur la validit\u00e9 d&#8217;une proc\u00e9dure engag\u00e9e par un \u00e9tablissement bancaire \u00e0 l&#8217;encontre de d\u00e9biteurs saisis. Un acte notari\u00e9 de pr\u00eat immobilier du 20 avril 2023 servait de titre ex\u00e9cutoire au cr\u00e9ancier, lequel avait prononc\u00e9 la d\u00e9ch\u00e9ance du terme apr\u00e8s des mises en demeure infructueuses. Les d\u00e9biteurs contestaient cette d\u00e9ch\u00e9ance, invoquant le caract\u00e8re abusif de la clause contractuelle la pr\u00e9voyant, et sollicitaient l&#8217;annulation du commandement de payer valant saisie immobili\u00e8re d\u00e9livr\u00e9 le 5 juillet 2025. Ils soutenaient \u00e9galement le caract\u00e8re disproportionn\u00e9 de la mesure au regard du montant modeste des \u00e9ch\u00e9ances impay\u00e9es.<\/p>\n<p>La proc\u00e9dure avait \u00e9t\u00e9 introduite par assignation du 6 octobre 2025. Devant le juge de l&#8217;ex\u00e9cution, les d\u00e9biteurs faisaient valoir que la clause d&#8217;exigibilit\u00e9 anticip\u00e9e, ne subordonnant la d\u00e9ch\u00e9ance du terme qu&#8217;\u00e0 une mise en demeure de quinze jours, devait \u00eatre d\u00e9clar\u00e9e abusive et r\u00e9put\u00e9e non \u00e9crite, conform\u00e9ment \u00e0 la jurisprudence r\u00e9cente de la Cour de justice de l&#8217;Union europ\u00e9enne et de la Cour de cassation. Ils en d\u00e9duisaient que le commandement de payer \u00e9tait priv\u00e9 de fondement valable et que la saisie immobili\u00e8re \u00e9tait disproportionn\u00e9e. Le cr\u00e9ancier bancaire soutenait au contraire la r\u00e9gularit\u00e9 de la clause et la validit\u00e9 de la proc\u00e9dure.<\/p>\n<p>La question de droit centrale portait sur l&#8217;office du juge de l&#8217;ex\u00e9cution saisi d&#8217;une contestation relative au caract\u00e8re abusif d&#8217;une clause de d\u00e9ch\u00e9ance du terme dans un contrat de pr\u00eat immobilier, et sur les cons\u00e9quences \u00e0 tirer de cette qualification sur la validit\u00e9 de la proc\u00e9dure de saisie immobili\u00e8re. Le juge devait d\u00e9terminer si l&#8217;annulation de la d\u00e9ch\u00e9ance du terme entra\u00eenait n\u00e9cessairement la nullit\u00e9 du commandement de payer et l&#8217;impossibilit\u00e9 de poursuivre la saisie, ou si le cr\u00e9ancier pouvait encore se pr\u00e9valoir des \u00e9ch\u00e9ances impay\u00e9es pour maintenir la mesure.<\/p>\n<p>Le juge de l&#8217;ex\u00e9cution a d\u00e9clar\u00e9 abusive et r\u00e9put\u00e9e non \u00e9crite la clause de d\u00e9ch\u00e9ance du terme du contrat de pr\u00eat, et a prononc\u00e9 la nullit\u00e9 de la d\u00e9ch\u00e9ance du terme. Il a toutefois d\u00e9bout\u00e9 les d\u00e9biteurs de leur demande de nullit\u00e9 du commandement de payer, constatant que la cr\u00e9ance au titre des \u00e9ch\u00e9ances impay\u00e9es s&#8217;\u00e9levait \u00e0 3 617,42 euros. Il a \u00e9cart\u00e9 le moyen tir\u00e9 de la disproportion de la saisie, au motif que les d\u00e9biteurs ne rapportaient pas la preuve de l&#8217;existence de mesures moins attentatoires \u00e0 leurs droits. Enfin, il a autoris\u00e9 la vente amiable du bien immobilier saisi.<\/p>\n<h2 id=\"i-la-neutralisation-de-la-clause-de-decheance-du-terme-et-ses-effets-limites-sur\">I. La neutralisation de la clause de d\u00e9ch\u00e9ance du terme et ses effets limit\u00e9s sur la validit\u00e9 du commandement<\/h2>\n<p>Le juge de l&#8217;ex\u00e9cution a fait application de la jurisprudence r\u00e9cente sur les clauses abusives en mati\u00e8re de cr\u00e9dit immobilier. Il a estim\u00e9 que la clause litigieuse, qui permettait au pr\u00eateur d&#8217;exiger le remboursement imm\u00e9diat apr\u00e8s une simple mise en demeure de quinze jours, cr\u00e9ait un d\u00e9s\u00e9quilibre significatif au d\u00e9triment du consommateur. Il a ainsi prononc\u00e9 son annulation et d\u00e9clar\u00e9 la d\u00e9ch\u00e9ance du terme inop\u00e9rante. Cette solution ne remettait cependant pas en cause la validit\u00e9 du commandement de payer, qui pouvait \u00eatre fond\u00e9 sur les seules \u00e9ch\u00e9ances impay\u00e9es.<\/p>\n<h3 id=\"a-le-caractere-abusif-de-la-clause-dexigibilite-anticipee\">A. Le caract\u00e8re abusif de la clause d&#8217;exigibilit\u00e9 anticip\u00e9e<\/h3>\n<p>Le juge a examin\u00e9 la clause ins\u00e9r\u00e9e dans les conditions g\u00e9n\u00e9rales du contrat de pr\u00eat. Celle-ci stipulait qu&#8217;en cas de d\u00e9faillance dans le remboursement, le pr\u00eateur pouvait se pr\u00e9valoir de l&#8217;exigibilit\u00e9 imm\u00e9diate du pr\u00eat apr\u00e8s une mise en demeure rest\u00e9e infructueuse pendant quinze jours. Le juge s&#8217;est r\u00e9f\u00e9r\u00e9 \u00e0 la jurisprudence de la Cour de justice de l&#8217;Union europ\u00e9enne du 8 d\u00e9cembre 2022 (C-600\/21) selon laquelle une telle clause peut \u00eatre abusive si elle n&#8217;a pas fait l&#8217;objet d&#8217;une n\u00e9gociation individuelle et cr\u00e9e un d\u00e9s\u00e9quilibre significatif. Il a \u00e9galement cit\u00e9 la Cour de cassation qui a jug\u00e9 que doit \u00eatre consid\u00e9r\u00e9e comme abusive la clause autorisant la banque \u00e0 exiger imm\u00e9diatement la totalit\u00e9 des sommes dues sans mise en demeure pr\u00e9alable ni pr\u00e9avis d&#8217;une dur\u00e9e raisonnable. La Cour de cassation a depuis pr\u00e9cis\u00e9 que <em>&#8220;Une clause de d\u00e9ch\u00e9ance du terme est abusive et r\u00e9put\u00e9e non \u00e9crite notamment si la facult\u00e9 laiss\u00e9e au professionnel de d\u00e9clarer exigible la totalit\u00e9 du pr\u00eat ne d\u00e9pend pas de l&#8217;inex\u00e9cution par le consommateur d&#8217;une obligation qui pr\u00e9sente un caract\u00e8re essentiel dans le cadre du rapport contractuel en cause, ce qu&#8217;il appartient au juge d&#8217;appr\u00e9cier&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/68e74c8d0ebbd151ceb999da\" rel=\"nofollow\" target=\"_blank\">(Cass. Autre, 8 octobre 2025, n\u00b025-70.016)<\/a><\/strong>. En l&#8217;esp\u00e8ce, la clause pr\u00e9voyait un d\u00e9lai tr\u00e8s bref de quinze jours apr\u00e8s une simple mise en demeure, sans \u00e9gard \u00e0 la gravit\u00e9 de l&#8217;inex\u00e9cution. Le juge a donc d\u00e9clar\u00e9 la clause abusive et r\u00e9put\u00e9e non \u00e9crite, et annul\u00e9 la d\u00e9ch\u00e9ance du terme prononc\u00e9e par la banque.<\/p>\n<h3 id=\"b-le-maintien-du-commandement-de-payer-fonde-sur-les-echeances-impayees\">B. Le maintien du commandement de payer fond\u00e9 sur les \u00e9ch\u00e9ances impay\u00e9es<\/h3>\n<p>Malgr\u00e9 l&#8217;annulation de la d\u00e9ch\u00e9ance du terme, le juge a fermement refus\u00e9 d&#8217;annuler le commandement de payer valant saisie immobili\u00e8re. Il a relev\u00e9 que l&#8217;article R 321-3, 3\u00b0 du Code des proc\u00e9dures civiles d&#8217;ex\u00e9cution impose la pr\u00e9cision du d\u00e9compte des sommes r\u00e9clam\u00e9es \u00e0 peine de nullit\u00e9 sur d\u00e9monstration d&#8217;un grief. Or le commandement distinguait clairement les \u00e9ch\u00e9ances impay\u00e9es du capital et des int\u00e9r\u00eats, et les d\u00e9biteurs n&#8217;invoquaient aucun pr\u00e9judice. Le juge a \u00e9galement rappel\u00e9 que les emprunteurs restent tenus au paiement des \u00e9ch\u00e9ances impay\u00e9es, qui constituent une cr\u00e9ance certaine, liquide et exigible. Ainsi, la nullit\u00e9 de la d\u00e9ch\u00e9ance du terme ne privait pas le cr\u00e9ancier de son droit de recouvrer les mensualit\u00e9s dues, et le commandement de payer restait valable sur ce fondement. Cette solution s&#8217;inscrit dans la logique protectrice du consommateur sans pour autant paralyser toute action du cr\u00e9ancier en pr\u00e9sence d&#8217;impay\u00e9s av\u00e9r\u00e9s.<\/p>\n<h2 id=\"ii-la-proportionnalite-de-la-saisie-immobiliere-et-la-voie-de-la-vente-amiable\">II. La proportionnalit\u00e9 de la saisie immobili\u00e8re et la voie de la vente amiable<\/h2>\n<p>Le juge a ensuite \u00e9t\u00e9 confront\u00e9 \u00e0 la contestation des d\u00e9biteurs sur le caract\u00e8re disproportionn\u00e9 de la saisie immobili\u00e8re au regard du montant modeste des \u00e9ch\u00e9ances impay\u00e9es. Il a rejet\u00e9 ce moyen en rappelant que la charge de la preuve incombe au d\u00e9biteur et que celui-ci ne d\u00e9montrait pas l&#8217;existence d&#8217;autres voies d&#8217;ex\u00e9cution moins attentatoires. Il a n\u00e9anmoins autoris\u00e9 la vente amiable, reconnaissant ainsi un certain \u00e9quilibre entre les droits du cr\u00e9ancier et la situation des d\u00e9biteurs.<\/p>\n<h3 id=\"a-le-rejet-du-caractere-disproportionne-de-la-mesure-dexecution-forcee\">A. Le rejet du caract\u00e8re disproportionn\u00e9 de la mesure d&#8217;ex\u00e9cution forc\u00e9e<\/h3>\n<p>Les d\u00e9biteurs soutenaient que la saisie immobili\u00e8re, mesure d&#8217;ex\u00e9cution particuli\u00e8rement grave, \u00e9tait disproportionn\u00e9e au regard de la somme de 3 617,42 euros. Le juge a rappel\u00e9 le principe selon lequel, aux termes des articles L 111-7 du Code des proc\u00e9dures civiles d&#8217;ex\u00e9cution et 1353 du Code civil, le cr\u00e9ancier a le choix des mesures propres \u00e0 assurer l&#8217;ex\u00e9cution de sa cr\u00e9ance, et il appartient au d\u00e9biteur de prouver que ces mesures exc\u00e8dent ce qui est n\u00e9cessaire. En l&#8217;esp\u00e8ce, le juge a constat\u00e9 que les d\u00e9biteurs, tout en contestant la d\u00e9ch\u00e9ance du terme, ne formulaient aucune proposition de paiement des arri\u00e9r\u00e9s ni de demande de d\u00e9lais. Ils ne d\u00e9montraient pas non plus l&#8217;existence d&#8217;autres biens saisissables ou de mesures alternatives. Le juge a soulign\u00e9 une contradiction assum\u00e9e des d\u00e9biteurs : ils contestaient la validit\u00e9 de la d\u00e9ch\u00e9ance du terme mais ne s&#8217;acquittaient plus de leurs \u00e9ch\u00e9ances, accumulant une dette sup\u00e9rieure \u00e0 11 000 euros. Dans ces conditions, le moyen de disproportion a \u00e9t\u00e9 \u00e9cart\u00e9.<\/p>\n<h3 id=\"b-lautorisation-de-la-vente-amiable-comme-issue-pragmatique\">B. L&#8217;autorisation de la vente amiable comme issue pragmatique<\/h3>\n<p>Par une d\u00e9cision nuanc\u00e9e, le juge a accueilli la demande subsidiaire des d\u00e9biteurs tendant \u00e0 l&#8217;autorisation d&#8217;une vente amiable du bien saisi. Il a relev\u00e9 que ceux-ci produisaient un mandat de vente exclusif dat\u00e9 du 28 janvier 2026, bien que tardif au regard de l&#8217;assignation du 6 octobre 2025. Le juge a reconnu que le prix de proposition \u00e9tait sup\u00e9rieur au seul avis de valeur, mais a estim\u00e9 que la volont\u00e9 de vendre n&#8217;emportait pas pleinement sa conviction. Il a n\u00e9anmoins fait droit \u00e0 la demande afin de pr\u00e9server les droits des d\u00e9biteurs et de maximiser les chances de recouvrement pour le cr\u00e9ancier. Le prix plancher a \u00e9t\u00e9 fix\u00e9 \u00e0 200 000 euros, et un d\u00e9lai de quatre mois a \u00e9t\u00e9 accord\u00e9, avec renvoi \u00e0 une audience ult\u00e9rieure pour v\u00e9rifier la r\u00e9alisation de la vente.
