Le bailleur sollicite l&#8217;expulsion des locataires et le paiement des sommes dues. Les d\u00e9fendeurs, non comparants, n&#8217;opposent aucune d\u00e9fense. Le juge accueille les demandes du requ\u00e9rant apr\u00e8s avoir v\u00e9rifi\u00e9 le respect des formalit\u00e9s pr\u00e9alables.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la demande en r\u00e9siliation<\/p>\n<p>Le juge v\u00e9rifie d&#8217;abord le strict respect des formalit\u00e9s protectrices instaur\u00e9es par la loi. Le requ\u00e9rant justifie avoir notifi\u00e9 le commandement de payer \u00e0 la commission comp\u00e9tente en novembre 2024. &#8220;En l&#8217;esp\u00e8ce, [le bailleur] justifie avoir notifi\u00e9 le commandement de payer \u00e0 la CCAPEX le 15 novembre 2024.&#8221; (Motifs, Sur la recevabilit\u00e9) Cette saisine pr\u00e9alable est une condition de recevabilit\u00e9 de l&#8217;assignation. L&#8217;ordonnance rappelle ainsi la port\u00e9e obligatoire de cette d\u00e9marche pr\u00e9contentieuse pour tout bailleur. La valeur de ce contr\u00f4le est de nature proc\u00e9durale et conditionne l&#8217;acc\u00e8s au juge. Ensuite, la r\u00e9gularit\u00e9 de l&#8217;assignation elle-m\u00eame est examin\u00e9e. Le juge constate qu&#8217;une copie de l&#8217;assignation a \u00e9t\u00e9 d\u00e9nonc\u00e9e \u00e0 la pr\u00e9fecture six semaines avant l&#8217;audience. &#8220;une copie des assignations a \u00e9t\u00e9 d\u00e9nonc\u00e9e \u00e0 la Pr\u00e9fecture du Gard par voie \u00e9lectronique le 20 mai 2025&#8221; (Motifs, Sur la recevabilit\u00e9) Cette formalit\u00e9, prescrite \u00e0 peine d&#8217;irrecevabilit\u00e9, a \u00e9t\u00e9 correctement accomplie. Le sens de cette exigence est d&#8217;assurer une information des autorit\u00e9s publiques sur les proc\u00e9dures d&#8217;expulsion. Sa port\u00e9e est stricte, toute irr\u00e9gularit\u00e9 entra\u00eenant le rejet de la demande sans examen au fond.<\/p>\n<p>Les effets de la clause r\u00e9solutoire et ses suites<\/p>\n<p>Le juge constate la r\u00e9solution de plein droit du bail par l&#8217;effet de la clause r\u00e9solutoire. Le commandement de payer, demeur\u00e9 infructueux plus de six semaines, a produit ses effets. &#8220;le contrat de location se trouve donc r\u00e9sili\u00e9 depuis cette date.&#8221; (Motifs, Sur la r\u00e9siliation du bail) La solution consacre le m\u00e9canisme contractuel de la clause r\u00e9solutoire pr\u00e9vue par la loi de 1989. Sa valeur est de rappeler l&#8217;efficacit\u00e9 de ce dispositif lorsque ses conditions sont r\u00e9unies. Les locataires sont d\u00e8s lors qualifi\u00e9s d&#8217;occupants sans titre. Cette qualification entra\u00eene logiquement leur expulsion et le paiement d&#8217;une indemnit\u00e9 d&#8217;occupation. &#8220;l&#8217;occupation sans droit, ni titre constitue un trouble illicite pr\u00e9judiciable&#8221; (Motifs, Sur l&#8217;indemnit\u00e9 d&#8217;occupation) Le sens de cette condamnation est de r\u00e9parer le pr\u00e9judice subi par le propri\u00e9taire priv\u00e9 de son bien. La port\u00e9e en est la condamnation au paiement d&#8217;une somme \u00e9quivalente au loyer jusqu&#8217;\u00e0 la lib\u00e9ration des lieux. Enfin, le juge rejette tacitement l&#8217;application des dispositifs de d\u00e9lais de paiement. Les locataires, absents, n&#8217;ont pas justifi\u00e9 d&#8217;une reprise des paiements courants. &#8220;Les d\u00e9fendeurs, non comparants ni repr\u00e9sent\u00e9s, ne justifient pas de la reprise du paiement int\u00e9gral du loyer courant&#8221; (Motifs, Sur les d\u00e9lais de paiement) La solution souligne le caract\u00e8re facultatif de l&#8217;octroi de d\u00e9lais, subordonn\u00e9 \u00e0 une demande et \u00e0 une reprise de paiement. Sa valeur est d&#8217;encadrer strictement cette mesure de faveur, qui ne peut \u00eatre accord\u00e9e d&#8217;office.
