Le tribunal judiciaire de Grenoble, statuant en p\u00f4le social, a rendu un jugement le 10 juin 2026. Une professionnelle du paysage, expos\u00e9e durant dix-sept ans \u00e0 divers produits phytosanitaires, a d\u00e9velopp\u00e9 un cancer de la vessie. Sa demande de reconnaissance en maladie professionnelle fut initialement rejet\u00e9e par la caisse et deux comit\u00e9s d’experts. Le tribunal, saisi, a finalement reconnu l’origine professionnelle de sa pathologie. La juridiction a ainsi accord\u00e9 le b\u00e9n\u00e9fice du r\u00e9gime des maladies professionnelles hors tableau, en \u00e9tablissant un lien de causalit\u00e9 direct et essentiel avec le travail.<\/p>\n

La d\u00e9monstration probatoire du lien de causalit\u00e9<\/p>\n

Le tribunal op\u00e8re un r\u00e9examen complet des \u00e9l\u00e9ments de preuve. Il \u00e9carte les avis d’experts d\u00e9favorables qui estimaient l’absence de donn\u00e9es scientifiques suffisantes. La juridiction constate en effet que ces avis “alors que n\u2019avait pas encore \u00e9t\u00e9 rendue publique la publication scientifique men\u00e9e par l\u2019institut ind\u00e9pendant [I] publi\u00e9e dans la revue [15] le 10 juin 2025” (Motifs). Cette nouvelle \u00e9tude, r\u00e9v\u00e9lant un risque accru de tumeurs de la vessie chez l’animal, invalide le fondement des conclusions pr\u00e9c\u00e9dentes.<\/p>\n

L’appr\u00e9ciation souveraine des juges du fond s’exerce ensuite. Ils rel\u00e8vent une exposition intense et prolong\u00e9e \u00e0 des produits class\u00e9s canc\u00e9rog\u00e8nes probables. “Le [7] a class\u00e9 le glyphosate dans la cat\u00e9gorie 2A des agents canc\u00e9rog\u00e8nes probables pour l\u2019homme” (Motifs). La combinaison de cette classification, de la dur\u00e9e d’exposition et de l’absence d’autre facteur de risque connu permet au tribunal de forger son intime conviction. Il en d\u00e9duit l’existence d’un lien direct et essentiel entre la pathologie et le travail.<\/p>\n

La port\u00e9e de la reconnaissance hors tableau<\/p>\n

Cette d\u00e9cision illustre l’effectivit\u00e9 du dispositif de l’article L.461-1 du code de la s\u00e9curit\u00e9 sociale. Elle confirme que la proc\u00e9dure hors tableau permet une protection adapt\u00e9e \u00e0 l’\u00e9volution des connaissances scientifiques. Le juge n’est pas li\u00e9 par les avis d’experts initiaux et peut tenir compte de donn\u00e9es nouvelles post\u00e9rieures \u00e0 ces avis. Il assure ainsi une protection dynamique des travailleurs face aux risques \u00e9mergents ou non encore officiellement r\u00e9pertori\u00e9s.<\/p>\n

L’arr\u00eat renforce \u00e9galement les obligations de l’employeur en mati\u00e8re de pr\u00e9vention. Une exposition prolong\u00e9e \u00e0 des produits dangereux, m\u00eame sans tableau sp\u00e9cifique, engage sa responsabilit\u00e9. Comme le rel\u00e8ve une jurisprudence ant\u00e9rieure, “l’exposition \u00e0 des produits canc\u00e9rig\u00e8nes pour le poumon pendant plus de 12 ans au sein de l’entreprise […] est de nature \u00e0 caract\u00e9riser un lien de causalit\u00e9 direct et essentiel” (Cour d’appel de Grenoble, le 4 d\u00e9cembre 2025, n\u00b024\/02578).
