Le juge, face \u00e0 l&#8217;absence de d\u00e9compte actualis\u00e9, ordonne la r\u00e9ouverture des d\u00e9bats et sursoit \u00e0 statuer. La d\u00e9cision souligne ainsi les exigences probatoires strictes en mati\u00e8re de clause r\u00e9solutoire et de demande provisionnelle devant le juge des r\u00e9f\u00e9r\u00e9s.<\/p>\n<p>L&#8217;exigence d&#8217;un d\u00e9compte probant pour la clause r\u00e9solutoire<\/p>\n<p>La v\u00e9rification de l&#8217;acquisition de la clause est subordonn\u00e9e \u00e0 une preuve certaine. Le contrat pr\u00e9voit une r\u00e9siliation de plein droit apr\u00e8s un commandement de payer rest\u00e9 infructueux. Un tel acte a bien \u00e9t\u00e9 d\u00e9livr\u00e9 pour un montant pr\u00e9cis de loyers et charges. Cependant, la demande bute sur une insuffisance documentaire post\u00e9rieure \u00e0 cet acte. &#8220;La demanderesse ne produit pas de d\u00e9compte post\u00e9rieur au commandement de payer, ce qui ne permet pas au juge des r\u00e9f\u00e9r\u00e9s de v\u00e9rifier que la clause r\u00e9solutoire est acquise&#8221; (Motifs de la d\u00e9cision). Cette carence emp\u00eache toute constatation de la persistance du d\u00e9faut de paiement apr\u00e8s l&#8217;expiration du d\u00e9lai. La port\u00e9e est claire : la seule existence d&#8217;une clause et d&#8217;un commandement ne suffit pas. Le juge exige une tra\u00e7abilit\u00e9 compl\u00e8te de la cr\u00e9ance jusqu&#8217;\u00e0 l&#8217;audience pour constater la r\u00e9solution de plein droit. Cette rigueur prot\u00e8ge le locataire contre une expulsion pour un motif non \u00e9tay\u00e9.<\/p>\n<p>L&#8217;impossibilit\u00e9 de statuer sur le montant provisionnel<\/p>\n<p>La d\u00e9termination d&#8217;une somme due en r\u00e9f\u00e9r\u00e9 requiert une \u00e9vidence incontestable. Le commandement indique un montant de dette arr\u00eat\u00e9 \u00e0 une date donn\u00e9e. La demande en paiement provisionnel n\u00e9cessite pourtant une actualisation \u00e0 l&#8217;instant du jugement. L&#8217;absence de document r\u00e9cent rend cette op\u00e9ration impossible. Les motifs pr\u00e9cisent que l&#8217;absence de d\u00e9compte ne permet pas de v\u00e9rifier &#8220;le montant de la dette locative dont le paiement provisionnel est demand\u00e9&#8221; (Motifs de la d\u00e9cision). Cette exigence rejoint une jurisprudence constante en la mati\u00e8re. Le tribunal judiciaire de Bordeaux a ainsi d\u00e9j\u00e0 jug\u00e9 que &#8220;les pi\u00e8ces vers\u00e9es aux d\u00e9bats ne permettent pas de d\u00e9terminer le montant de la somme due par le locataire et le bien-fond\u00e9 de la demande en paiement qui ne peut \u00eatre en r\u00e9f\u00e9r\u00e9 qu&#8217;une somme provisionnelle&#8221; (Tribunal judiciaire de Bordeaux, le 16 septembre 2025, n\u00b025\/00051). La valeur de la d\u00e9cision comment\u00e9e est de r\u00e9affirmer ce principe essentiel. Le juge des r\u00e9f\u00e9r\u00e9s ne peut suppl\u00e9er aux d\u00e9faillances probatoires du demandeur. La solution de r\u00e9ouverture des d\u00e9bats offre une derni\u00e8re opportunit\u00e9 de r\u00e9gularisation.
