Le copropri\u00e9taire d\u00e9fendeur n\u2019ayant pas comparu, le juge a statu\u00e9 sur le fond en application de l\u2019article 472 du code de proc\u00e9dure civile. La juridiction a accueilli la demande principale mais a rejet\u00e9 une partie des frais de recouvrement r\u00e9clam\u00e9s et allou\u00e9 des dommages-int\u00e9r\u00eats.<\/p>\n<p>La preuve des cr\u00e9ances de copropri\u00e9t\u00e9<\/p>\n<p>La charge de la preuve incombe int\u00e9gralement au syndicat demandeur. Le juge rappelle que le syndicat doit \u00e9tablir le caract\u00e8re certain, liquide et exigible de sa cr\u00e9ance. Il lui appartient de produire le proc\u00e8s-verbal de l&#8217;assembl\u00e9e g\u00e9n\u00e9rale approuvant les comptes de l&#8217;exercice correspondant et rendant la cr\u00e9ance certaine, liquide et exigible, un d\u00e9compte de r\u00e9partition de charges ainsi qu&#8217;un d\u00e9compte individuel permettant de v\u00e9rifier l&#8217;ad\u00e9quation entre les montants \u00e0 r\u00e9partir par types de charges et les sommes demand\u00e9es au copropri\u00e9taire. Cette exigence proc\u00e8de du droit commun de la preuve et vise \u00e0 garantir la s\u00e9curit\u00e9 juridique des rapports entre le syndicat et les copropri\u00e9taires. La d\u00e9cision pr\u00e9cise \u00e9galement que les d\u00e9cisions d&#8217;assembl\u00e9e g\u00e9n\u00e9rale s&#8217;imposent tant qu&#8217;elles n&#8217;ont pas \u00e9t\u00e9 annul\u00e9es, ce qui renforce l&#8217;autorit\u00e9 de la gestion collective. Cette analyse rejoint celle d&#8217;une autre juridiction qui a jug\u00e9 que les charges r\u00e9sultent des comptes approuv\u00e9s en assembl\u00e9es g\u00e9n\u00e9rales des copropri\u00e9taires et non annul\u00e9s \u00e0 l\u2019heure actuelle par des d\u00e9cisions d\u00e9finitives (Tribunal judiciaire de Paris, le 12 juin 2025, n\u00b020\/03705). La port\u00e9e de ce point est essentielle pour le recouvrement contentieux, car elle d\u00e9finit strictement les pi\u00e8ces justificatives admissibles.<\/p>\n<p>La d\u00e9finition et le contr\u00f4le des frais de recouvrement<\/p>\n<p>Les frais expos\u00e9s pour le recouvrement ne sont imputables au copropri\u00e9taire d\u00e9faillant que sous conditions strictes. Le juge interpr\u00e8te restrictivement la liste de l\u2019article 10-1 de la loi du 10 juillet 1965. Il estime que les frais de recouvrement ne sont n\u00e9cessaires au sens de l&#8217;article 10-1 pr\u00e9cit\u00e9 que s&#8217;ils ne rel\u00e8vent pas de la gestion courante du syndic et traduisent des diligences r\u00e9elles, inhabituelles et n\u00e9cessaires. En l\u2019esp\u00e8ce, la multiplicit\u00e9 des mises en demeure a \u00e9t\u00e9 jug\u00e9e non strictement n\u00e9cessaire, et l\u2019absence de preuve de leur r\u00e9ception valable a conduit \u00e0 leur rejet. Seuls les frais li\u00e9s \u00e0 un commandement de payer et \u00e0 une hypoth\u00e8que l\u00e9gale ont \u00e9t\u00e9 retenus. Cette approche limite les abus potentiels et prot\u00e8ge le copropri\u00e9taire contre des frais excessifs. Elle op\u00e8re une distinction nette entre la gestion administrative courante et les actes exceptionnels de recouvrement.
