Le bailleur social demande la r\u00e9siliation du bail pour impay\u00e9s de loyers et le paiement des sommes dues. Les locataires sollicitent l&#8217;octroi de d\u00e9lais de paiement et la suspension de la clause r\u00e9solutoire. Le juge doit trancher l&#8217;application dans le temps de la loi du vingt-sept juillet deux mille vingt-trois et statuer sur les demandes de mesures d&#8217;apurement.<\/p>\n<p>Le principe de non-r\u00e9troactivit\u00e9 de la loi nouvelle<\/p>\n<p>La d\u00e9cision affirme la primaut\u00e9 du principe de non-r\u00e9troactivit\u00e9 en mati\u00e8re contractuelle. Le juge \u00e9carte l&#8217;application imm\u00e9diate de la loi nouvelle au bail conclu ant\u00e9rieurement \u00e0 son entr\u00e9e en vigueur. Il rappelle que la loi du vingt-sept juillet deux mille vingt-trois ne comporte aucune disposition d\u00e9rogeant \u00e0 l&#8217;article deux du code civil. &#8220;Ainsi, il n&#8217;y a pas lieu de faire application aux contrats conclus ant\u00e9rieurement au 29 juillet 2023 de l&#8217;article 10 de cette loi, en ce qu&#8217;il fixe \u00e0 six semaines &#8211; et non plus deux mois le d\u00e9lai minimal accord\u00e9 au locataire pour apurer sa dette&#8221; (Motifs, 1.2). Le contrat demeure r\u00e9gi par la loi ancienne et les stipulations conventionnelles. Cette solution est conforme \u00e0 la jurisprudence de la Cour de cassation qui a jug\u00e9 que l&#8217;article dix de la loi nouvelle &#8220;ne s&#8217;applique pas imm\u00e9diatement aux contrats en cours, qui demeurent r\u00e9gis par les stipulations des parties, telles qu&#8217;encadr\u00e9es par la loi en vigueur au jour de la conclusion du bail&#8221; (Cass. Autre, le 13 juin 2024, n\u00b024-70.002). La port\u00e9e de ce point est essentielle pour la s\u00e9curit\u00e9 juridique des relations contractuelles. Elle garantit la stabilit\u00e9 des conventions face aux modifications l\u00e9gislatives intervenant en cours d&#8217;ex\u00e9cution.<\/p>\n<p>La substitution du d\u00e9lai contractuel au d\u00e9lai l\u00e9gal nouveau<\/p>\n<p>Le juge proc\u00e8de \u00e0 la substitution du d\u00e9lai conventionnel pour appr\u00e9cier la r\u00e9gularit\u00e9 du commandement. Le bail pr\u00e9voyait un d\u00e9lai de deux mois pour apurer la dette apr\u00e8s commandement. Le bailleur a appliqu\u00e9 le nouveau d\u00e9lai l\u00e9gal de six semaines dans son commandement. Le juge estime que le d\u00e9lai contractuel de deux mois doit pr\u00e9valoir. &#8220;Il convient donc de substituer le d\u00e9lai de deux mois au d\u00e9lai de six semaines vis\u00e9 au commandement de payer&#8221; (Motifs, 1.2). L&#8217;irr\u00e9gularit\u00e9 du commandement n&#8217;est toutefois pas sanctionn\u00e9e par la nullit\u00e9. Le juge rel\u00e8ve que la dette n&#8217;a de toute fa\u00e7on pas \u00e9t\u00e9 pay\u00e9e dans l&#8217;intervalle entre six semaines et deux mois. Ainsi, le bailleur peut valablement se pr\u00e9valoir de la clause r\u00e9solutoire dont les conditions sont r\u00e9unies. La valeur de cette analyse est pragmatique. Elle \u00e9vite une annulation purement formelle du commandement lorsque l&#8217;issue sur le fond serait identique. Elle pr\u00e9serve l&#8217;efficacit\u00e9 de la proc\u00e9dure tout en rappelant la r\u00e8gle de droit.<\/p>\n<p>L&#8217;am\u00e9nagement judiciaire au profit du locataire en difficult\u00e9<\/p>\n<p>La d\u00e9cision illustre les pouvoirs d&#8217;am\u00e9nagement conf\u00e9r\u00e9s au juge par la loi du vingt-sept juillet deux mille vingt-trois. Le juge constate que les conditions l\u00e9gales pour b\u00e9n\u00e9ficier de ces mesures sont remplies. Il note la reprise du paiement int\u00e9gral du loyer courant avant l&#8217;audience. &#8220;En l&#8217;esp\u00e8ce, eu \u00e9gard aux versements r\u00e9alis\u00e9s depuis le mois de novembre 2024 d&#8217;un montant sup\u00e9rieur \u00e0 celui du loyer courant, la condition de reprise du paiement int\u00e9gral du loyer courant avant la date de l&#8217;audience est r\u00e9put\u00e9e satisfaite&#8221; (Motifs, 1.2). Le juge appr\u00e9cie \u00e9galement la capacit\u00e9 des locataires \u00e0 assumer un plan d&#8217;apurement. Il accorde des d\u00e9lais de paiement de trente-six mois et suspend les effets de la clause r\u00e9solutoire. Cette solution s&#8217;inscrit dans le droit fil de la jurisprudence des cours d&#8217;appel appliquant la loi nouvelle. Une cour a jug\u00e9 que &#8220;le juge peut accorder des d\u00e9lais de paiement au locataire en situation de r\u00e9gler sa dette et qui a repris le versement int\u00e9gral du loyer courant avant la date de l&#8217;audience&#8221; (Cour d&#8217;appel de Pau, le 6 mars 2025, n\u00b023\/02948). La port\u00e9e de ce point est de concilier le recouvrement de la cr\u00e9ance avec la protection du logement du locataire de bonne foi.<\/p>\n<p>Le r\u00e9gime strict de la suspension conditionnelle<\/p>\n<p>Le juge d\u00e9finit un r\u00e9gime strict et pr\u00e9cis pour la suspension de la clause r\u00e9solutoire. La suspension est subordonn\u00e9e au respect scrupuleux du plan de paiement. Toute d\u00e9faillance, m\u00eame sur une seule \u00e9ch\u00e9ance, entra\u00eene la r\u00e9siliation de plein droit. &#8220;DIT qu&#8217;en revanche, pour le cas o\u00f9 une mensualit\u00e9, qu&#8217;elle soit due au titre du loyer et des charges courants ou de l&#8217;arri\u00e9r\u00e9, resterait impay\u00e9e quinze jours apr\u00e8s l&#8217;envoi d&#8217;une mise en demeure [&#8230;] le bail sera consid\u00e9r\u00e9 comme r\u00e9sili\u00e9 de plein droit depuis le 23 mai 2025&#8221; (Dispositif). Le juge pr\u00e9cise les cons\u00e9quences d&#8217;une telle d\u00e9faillance, incluant l&#8217;exigibilit\u00e9 imm\u00e9diate du solde et la possibilit\u00e9 d&#8217;expulsion. La valeur de ce dispositif est d&#8217;offrir une s\u00e9curit\u00e9 au bailleur. Il \u00e9tablit un m\u00e9canisme automatique de sanction en cas d&#8217;inex\u00e9cution, \u00e9vitant une nouvelle saisine du juge.
