Le bailleur justifie d&#8217;un commandement de payer et de la saisine pr\u00e9alable de la commission de coordination. Le juge constate la r\u00e9siliation de plein droit du bail mais accorde au locataire des d\u00e9lais de paiement pour le solde de sa dette. Il suspend temporairement les effets de la clause r\u00e9solutoire et fixe une indemnit\u00e9 d&#8217;occupation.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la demande en r\u00e9siliation<\/p>\n<p>Le respect des formalit\u00e9s pr\u00e9alables \u00e0 l&#8217;assignation. Le juge v\u00e9rifie d&#8217;abord le strict respect des conditions de recevabilit\u00e9 de l&#8217;action en r\u00e9siliation. La loi impose aux bailleurs personnes morales une saisine pr\u00e9alable de la commission de coordination des actions de pr\u00e9vention. &#8220;En application du m\u00eame article, les bailleurs personnes morales autres qu&#8217;une soci\u00e9t\u00e9 civile constitu\u00e9e exclusivement entre parents et alli\u00e9s jusqu&#8217;au quatri\u00e8me degr\u00e9 inclus ne peuvent faire d\u00e9livrer, sous peine d&#8217;irrecevabilit\u00e9 de la demande, une assignation aux fins de constat de r\u00e9siliation du bail avant l&#8217;expiration d&#8217;un d\u00e9lai de deux mois suivant la saisine&#8221; (Motifs de la d\u00e9cision). Cette formalit\u00e9 substantielle prot\u00e8ge le locataire en favorisant une solution amiable. La d\u00e9cision confirme ainsi une jurisprudence constante sur ce point. &#8220;L\u2019action en demande de r\u00e9siliation de bail et expulsion du locataire n\u2019est pas recevable&#8221; (Tribunal judiciaire de Tours, le 21 mai 2025, n\u00b023\/05557). La justification de cette saisine dans les d\u00e9lais l\u00e9gaux est donc une condition sine qua non.<\/p>\n<p>La r\u00e9gularit\u00e9 du commandement de payer invoquant la clause r\u00e9solutoire. Le juge examine ensuite la validit\u00e9 du m\u00e9canisme de r\u00e9siliation de plein droit pr\u00e9vu au contrat. Le bailleur doit avoir pr\u00e9alablement signifi\u00e9 un commandement de payer visant express\u00e9ment cette clause. &#8220;Un commandement de payer visant la clause r\u00e9solutoire et rappelant les dispositions de l&#8217;article 24 de la Loi N\u00b089-462 du 6 juillet 1989 et de l&#8217;article 6 de la Loi du 31 mai 1990 a \u00e9t\u00e9 signifi\u00e9 au locataire le 20 janvier 2025&#8221; (Motifs de la d\u00e9cision). Ce formalisme imp\u00e9ratif assure l&#8217;information claire du locataire sur les cons\u00e9quences de son d\u00e9faut de paiement. La constatation de la persistance des impay\u00e9s plus de deux mois apr\u00e8s ce commandement rend la r\u00e9siliation acquise de plein droit. Cette analyse consacre l&#8217;effectivit\u00e9 des clauses r\u00e9solutoires sous r\u00e9serve du respect d&#8217;un formalisme protecteur.<\/p>\n<p>L&#8217;am\u00e9nagement judiciaire des cons\u00e9quences de la r\u00e9siliation<\/p>\n<p>Le report de paiement et la suspension temporaire de la r\u00e9siliation. Le juge use ensuite de son pouvoir d&#8217;am\u00e9nagement pour att\u00e9nuer les effets de la r\u00e9siliation. Il peut accorder des d\u00e9lais de paiement au locataire. &#8220;Le juge peut, dans la limite de trois ann\u00e9es, reporter ou \u00e9chelonner le paiement des sommes dues, compte tenu de la situation du d\u00e9biteur et en consid\u00e9ration des besoins du cr\u00e9ancier lorsque le locataire est en situation de r\u00e9gler sa dette locative&#8221; (Motifs de la d\u00e9cision). Cette mesure de cl\u00e9mence est conditionn\u00e9e \u00e0 la capacit\u00e9 du locataire \u00e0 s&#8217;acquitter de ses obligations futures. Le juge suspend alors les effets de la clause r\u00e9solutoire pendant la dur\u00e9e des d\u00e9lais accord\u00e9s. Cette suspension pr\u00e9serve paradoxalement la relation locative malgr\u00e9 la r\u00e9siliation constat\u00e9e.<\/p>\n<p>La mise en place d&#8217;un dispositif incitatif au paiement et \u00e0 la lib\u00e9ration des lieux. La d\u00e9cision instaure enfin un r\u00e9gime strict en cas de nouveau manquement. Le non-paiement d&#8217;une seule \u00e9ch\u00e9ance entra\u00eene la reprise des effets de la clause. &#8220;En cas de non-paiement d&#8217;une seule \u00e9ch\u00e9ance dans les d\u00e9lais en plus du loyer courant, la clause r\u00e9solutoire reprendra son plein effet&#8221; (Motifs de la d\u00e9cision). L&#8217;int\u00e9gralit\u00e9 de la dette devient imm\u00e9diatement exigible et l&#8217;expulsion est autoris\u00e9e. Le juge fixe \u00e9galement une indemnit\u00e9 d&#8217;occupation due jusqu&#8217;\u00e0 la lib\u00e9ration effective des lieux. Ce dispositif \u00e9quilibre la protection du locataire et les droits du bailleur.
