Un salari\u00e9 contestait la r\u00e9duction de son horaire hebdomadaire contractuel de quarante-deux \u00e0 trente-neuf heures. Les juges du fond avaient rejet\u00e9 ses demandes. La cour d\u2019appel infirme partiellement ce jugement. Elle admet la modification unilat\u00e9rale initiale et condamne l\u2019employeur \u00e0 un rappel de salaire et \u00e0 des dommages-int\u00e9r\u00eats pour ex\u00e9cution d\u00e9loyale du contrat.<\/p>\n<p>La distinction entre modification du contrat et changement des conditions de travail<\/p>\n<p>La modification substantielle du contrat requiert imp\u00e9rativement l\u2019accord du salari\u00e9 concern\u00e9. La cour rappelle ce principe fondamental en opposant modification contractuelle et simple changement des conditions de travail. &#8220;contrairement au changement des conditions de travail qui rel\u00e8ve du pouvoir de direction de l&#8217;employeur, la modification du contrat de travail n\u00e9cessite l&#8217;accord pr\u00e9alable du salari\u00e9.&#8221; (Motifs, 1). L\u2019enjeu est la protection du contrat, acte fondateur de la relation, contre l\u2019exercice unilat\u00e9ral du pouvoir de direction. La port\u00e9e de ce point est de r\u00e9affirmer le caract\u00e8re consensuel de toute alt\u00e9ration d\u2019un \u00e9l\u00e9ment essentiel du contrat. La valeur r\u00e9side dans la stabilisation de la relation contractuelle et la s\u00e9curit\u00e9 juridique du salari\u00e9.<\/p>\n<p>L\u2019appr\u00e9ciation in concreto de l\u2019existence d\u2019une modification contractuelle<\/p>\n<p>La qualification juridique d\u00e9pend d\u2019une analyse concr\u00e8te des circonstances de l\u2019esp\u00e8ce. La cour examine successivement la p\u00e9riode ant\u00e9rieure \u00e0 2019 et la demande \u00e9crite du salari\u00e9 de juillet 2019. Pour la premi\u00e8re p\u00e9riode, elle constate l\u2019absence de preuve d\u2019un accord du salari\u00e9 sur la r\u00e9duction d\u2019horaire. &#8220;Il y a donc bien une modification du contrat de travail \u00e0 partir de janvier 2019 sans que l&#8217;accord, indispensable, du salari\u00e9 ne soit \u00e9tabli.&#8221; (Motifs, 1). Le sens est de placer la charge de la preuve de l\u2019accord sur l\u2019employeur qui invoque la modification. La port\u00e9e est pratique : l\u2019employeur doit conserver les traces de cet accord et ne peut se fonder sur une simple absence de r\u00e9clamation.<\/p>\n<p>La preuve de l\u2019accord du salari\u00e9 et ses cons\u00e9quences sur la cr\u00e9ance salariale<\/p>\n<p>L\u2019\u00e9crit produit par le salari\u00e9 lui-m\u00eame constitue la preuve de son accord \u00e0 compter d\u2019octobre 2019. La cour analyse le courriel et le calendrier annot\u00e9 pour en d\u00e9duire une acceptation. &#8220;Par cons\u00e9quent il y a bien une modification du contrat de travail accept\u00e9e par les deux parties \u00e0 effet \u00e0 octobre 2019&#8221; (Motifs, 1). La valeur de ce point est de reconna\u00eetre la force probante d\u2019une demande du salari\u00e9, qui vaut accord pour l\u2019avenir. La port\u00e9e est de limiter dans le temps la cr\u00e9ance de rappel de salaire, uniquement due pour la p\u00e9riode sans accord \u00e9tabli, soit d\u2019avril \u00e0 septembre 2019.<\/p>\n<p>La sanction de l\u2019ex\u00e9cution d\u00e9loyale du contrat de travail<\/p>\n<p>Le manquement de l\u2019employeur \u00e0 son obligation de loyaut\u00e9 est sanctionn\u00e9 par des dommages-int\u00e9r\u00eats distincts du rappel de salaire. La cour retient cette faute contractuelle pour la p\u00e9riode de modification unilat\u00e9rale. &#8220;Il peut par cons\u00e9quent \u00eatre reproch\u00e9 une ex\u00e9cution d\u00e9loyale du contrat de travail \u00e0 l&#8217;employeur pour une dur\u00e9e de 6 mois&#8221; (Motifs, 2). Le sens est de p\u00e9naliser le comportement de l\u2019employeur qui a source du litige. La port\u00e9e est significative : au-del\u00e0 du simple paiement du d\u00fb, une indemnisation pour trouble dans l\u2019ex\u00e9cution du contrat est possible.
