Le bailleur, ayant invoqu\u00e9 une clause r\u00e9solutoire apr\u00e8s commandement, saisit le juge des r\u00e9f\u00e9r\u00e9s pour constater la r\u00e9siliation et obtenir l&#8217;expulsion. Les locataires opposent un d\u00e9g\u00e2t des eaux sur un logement ant\u00e9rieur ayant ob\u00e9r\u00e9 leur capacit\u00e9 de paiement. La juridiction doit d\u00e9terminer si les conditions de la r\u00e9siliation de plein droit sont r\u00e9unies et statuer sur les demandes provisionnelles. La cour infirme partiellement l&#8217;ordonnance de premi\u00e8re instance pour constater la r\u00e9siliation et ordonner l&#8217;expulsion.<\/p>\n<p>La r\u00e9gularit\u00e9 de la mise en \u0153uvre de la clause r\u00e9solutoire<\/p>\n<p>Le juge des r\u00e9f\u00e9r\u00e9s peut constater une r\u00e9siliation de plein droit lorsque la clause est r\u00e9guli\u00e8rement mise en \u0153uvre. La cour rappelle le cadre l\u00e9gal strict encadrant ces clauses en mati\u00e8re de bail d&#8217;habitation. &#8220;Le I de l&#8217;article 24 du m\u00eame texte dispose [&#8230;] que &#8216;toute clause pr\u00e9voyant la r\u00e9siliation de plein droit du contrat de location pour d\u00e9faut de paiement du loyer [&#8230;] ne produit effet que deux mois apr\u00e8s un commandement de payer demeur\u00e9 infructueux'&#8221; (Motifs). La clause contractuelle reproduisait exactement cette exigence l\u00e9gale.<\/p>\n<p>L&#8217;appr\u00e9ciation stricte du d\u00e9faut de paiement dans le d\u00e9lai l\u00e9gal<\/p>\n<p>La cour proc\u00e8de \u00e0 une v\u00e9rification minutieuse des paiements effectu\u00e9s durant le d\u00e9lai de deux mois. Elle constate que les locataires n&#8217;ont pas apur\u00e9 la totalit\u00e9 des sommes dues \u00e0 l&#8217;expiration de ce d\u00e9lai. &#8220;Il ressort du dernier d\u00e9compte de cr\u00e9ance [&#8230;] qu&#8217;ils restaient toujours \u00e0 devoir la somme de 1 401, 29 \u20ac au 31 mai 2023, terme de mai 2023 \u00e9chu&#8221; (Motifs). Le fait qu&#8217;un d\u00e9g\u00e2t des eaux sur un autre logement ait pu g\u00eaner leur tr\u00e9sorerie est jug\u00e9 inop\u00e9rant pour faire \u00e9chec \u00e0 la r\u00e9siliation. Cette analyse rejoint une jurisprudence constante sur l&#8217;exigence d&#8217;un paiement int\u00e9gral dans le d\u00e9lai. &#8220;La soci\u00e9t\u00e9 C.M.J.F.G ne justifie pas d&#8217;un paiement dans le mois suivant la date de signification du commandement&#8221; (Tribunal judiciaire de Paris, le 20 mai 2025, n\u00b024\/57427). La port\u00e9e de cette solution est de rappeler le caract\u00e8re imp\u00e9ratif du d\u00e9lai et l&#8217;exigence d&#8217;un apurement complet de la dette.<\/p>\n<p>La distinction des r\u00e9gimes applicables \u00e0 la cr\u00e9ance locative et \u00e0 l&#8217;indemnit\u00e9 d&#8217;occupation<\/p>\n<p>La contestation s\u00e9rieuse affectant le principe de la cr\u00e9ance locative<\/p>\n<p>La cour op\u00e8re une distinction fondamentale entre la r\u00e9siliation du bail et le recouvrement des loyers impay\u00e9s. Pour accorder une provision, l&#8217;existence de l&#8217;obligation ne doit pas \u00eatre s\u00e9rieusement contestable. Or, les locataires justifient que le d\u00e9g\u00e2t des eaux a ob\u00e9r\u00e9 leur capacit\u00e9 \u00e0 payer. &#8220;13 Habitat ne fait, comme en premi\u00e8re instance, aucune observation sur ce point&#8221; (Motifs). La cour en d\u00e9duit que le principe m\u00eame de la cr\u00e9ance est affect\u00e9 d&#8217;une contestation s\u00e9rieuse. La valeur de cette analyse r\u00e9side dans la protection du d\u00e9biteur face \u00e0 une demande provisionnelle lorsque le bien-fond\u00e9 de la dette est discutable.<\/p>\n<p>La condamnation \u00e0 une indemnit\u00e9 d&#8217;occupation apr\u00e8s r\u00e9siliation constat\u00e9e<\/p>\n<p>En revanche, la situation change radicalement une fois la r\u00e9siliation constat\u00e9e. Les occupants priv\u00e9s de titre doivent une indemnit\u00e9 d&#8217;occupation. La cour condamne donc solidairement les locataires \u00e0 payer une provision sur cette indemnit\u00e9 \u00e0 compter de la r\u00e9siliation. Cette d\u00e9cision illustre la dissociation entre le contrat r\u00e9sili\u00e9 et l&#8217;obligation de quitter les lieux. La port\u00e9e est pratique : le bailleur peut recouvrer une indemnit\u00e9 pendant la phase d&#8217;occupation post-r\u00e9siliation, m\u00eame si les loyers ant\u00e9rieurs sont contest\u00e9s.
