Un salari\u00e9, ing\u00e9nieur affaires, contestait son <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-licenciement-faute-paris\/\" target=\"_blank\" title=\"licenciement pour faute\">licenciement pour faute<\/a> grave prononc\u00e9 en d\u00e9cembre 2021. La cour d\u2019appel, saisie de son appel, devait v\u00e9rifier la r\u00e9alit\u00e9 et la gravit\u00e9 des griefs invoqu\u00e9s. Elle confirme le bien-fond\u00e9 du licenciement mais r\u00e9forme le jugement sur les indemnit\u00e9s dues.<\/p>\n<p>La qualification de la faute grave retenue<\/p>\n<p>La cour op\u00e8re un tri rigoureux parmi les nombreux griefs formul\u00e9s par l\u2019employeur. Elle \u00e9carte ceux qui ne sont pas suffisamment \u00e9tay\u00e9s par des preuves pr\u00e9cises et concordantes. Les propos tenus par le salari\u00e9 envers ses coll\u00e8gues, bien que d\u00e9plac\u00e9s, sont jug\u00e9s ne pas d\u00e9passer les limites de la libert\u00e9 d\u2019expression. &#8220;Les propos qui y sont tenus par Monsieur et tels qu&#8217;ils ont \u00e9t\u00e9 traduits par l&#8217;intim\u00e9e ne d\u00e9passent pas les limites impos\u00e9es \u00e0 la libert\u00e9 d&#8217;expression et ne peuvent donc \u00eatre sanctionn\u00e9s per se.&#8221; (Motifs, \u00a7 sur le grief de \u00ab Propos inadapt\u00e9s \u00bb). De m\u00eame, l\u2019absence ponctuelle de r\u00e9ponse \u00e0 des courriels ou des erreurs dans la r\u00e9daction de devis sans cons\u00e9quence ne sont pas retenues comme fautes. Ce filtrage d\u00e9montre l\u2019exigence de preuve concr\u00e8te pesant sur l\u2019employeur. La cour ne se contente pas des all\u00e9gations mais v\u00e9rifie syst\u00e9matiquement leur mat\u00e9rialit\u00e9 et leur port\u00e9e r\u00e9elle.<\/p>\n<p>Trois manquements sont en revanche retenus comme \u00e9tablis. Le refus de se rendre \u00e0 une r\u00e9union convoqu\u00e9e par la hi\u00e9rarchie constitue un acte d\u2019insubordination. Une n\u00e9gligence dans la gestion d\u2019un dossier client a caus\u00e9 un retard de chantier et un pr\u00e9judice financier. Enfin, le non-respect d\u2019une proc\u00e9dure interne r\u00e9cente concernant les notes de frais est constat\u00e9. Paris isol\u00e9ment, chacun de ces faits pourrait ne pas constituer une faute grave. La cour proc\u00e8de donc \u00e0 une appr\u00e9ciation globale et cumulative pour qualifier la faute. &#8220;Ces faits, pris dans leur ensemble, justifient le licenciement&#8221; (Motifs, \u00a7 Motivation). Cette approche permet de caract\u00e9riser une rupture de la relation de confiance justifiant la rupture imm\u00e9diate du contrat. La jurisprudence rappelle que la faute grave peut r\u00e9sulter d\u2019une accumulation de manquements. &#8220;Dans ces conditions, le refus de M. [I] de se rendre sur son nouveau lieu d&#8217;affectation constitue une faute contractuelle, qui, au regard de l&#8217;avertissement d\u00e9j\u00e0 donn\u00e9 pour les m\u00eames faits et de la persistance du refus malgr\u00e9 les explications donn\u00e9es par l&#8217;employeur, rendait impossible le maintien du salari\u00e9 dans l&#8217;entreprise pendant la dur\u00e9e du pr\u00e9avis. Le licenciement pour faute grave est justifi\u00e9.&#8221; (Cour d\u2019appel de Versailles, le 23 mars 2023, n\u00b020\/01999). La d\u00e9cision s\u2019inscrit dans cette logique o\u00f9 c\u2019est la convergence des comportements qui rend la continuation du contrat impossible.<\/p>\n<p>Les cons\u00e9quences indemnitaires de la rupture<\/p>\n<p>Ayant valid\u00e9 la cause r\u00e9elle et s\u00e9rieuse du licenciement, la cour d\u00e9boute le salari\u00e9 de sa demande d\u2019indemnit\u00e9s pour licenciement injustifi\u00e9. Elle rejette \u00e9galement son argumentation sur un \u00e9ventuel motif \u00e9conomique d\u00e9guis\u00e9. Les \u00e9l\u00e9ments produits, tels que des tracts syndicaux ou des pertes post\u00e9rieures au licenciement, sont jug\u00e9s insuffisants pour renverser la charge de la preuve. &#8220;Cette pi\u00e8ce et le fait que Monsieur [K] [J] n&#8217;a pas \u00e9t\u00e9 remplac\u00e9 dans son poste, sont insuffisants pour d\u00e9montrer le motif \u00e9conomique de son licenciement&#8221; (Motifs, \u00a7 sur le motif \u00e9conomique). Cette analyse souligne la difficult\u00e9 pour un salari\u00e9 de prouver un tel d\u00e9tournement de proc\u00e9dure sans \u00e9l\u00e9ments probants et directs.<\/p>\n<p>Cependant, la qualification de faute grave n\u2019entra\u00eene pas une privation totale d\u2019indemnit\u00e9s. La cour condamne l\u2019employeur \u00e0 verser l\u2019indemnit\u00e9 conventionnelle de licenciement ainsi que l\u2019indemnit\u00e9 compensatrice de pr\u00e9avis et les cong\u00e9s pay\u00e9s aff\u00e9rents. Cette solution est classique : la faute grave n\u2019est pas une faute lourde et n\u2019emporte pas d\u00e9ch\u00e9ance des droits \u00e0 indemnit\u00e9s d\u2019origine l\u00e9gale ou conventionnelle, sauf disposition contraire. La d\u00e9cision rappelle ainsi la distinction fondamentale entre les deux qualifications. Elle accorde \u00e9galement au salari\u00e9 une somme au titre de l\u2019article 700 du code de proc\u00e9dure civile pour les frais irr\u00e9p\u00e9tibles expos\u00e9s dans les deux instances. Cette condamnation, bien que modeste, marque une forme de sanction des insuffisances probatoires initiales de l\u2019employeur. La jurisprudence exige en effet que les griefs soient pr\u00e9cis\u00e9ment d\u00e9montr\u00e9s. &#8220;Sur les anomalies de caisse, l&#8217;employeur n&#8217;apporte aucun \u00e9l\u00e9ment de preuve sur ce point et ne d\u00e9veloppe aucun moyen.&#8221; (Cour d\u2019appel de Saint-Denis de la R\u00e9union, le 23 octobre 2025, n\u00b023\/01696). Ici, le rejet de plusieurs griefs par la cour justifie cette allocation.<\/p>\n<p>L\u2019arr\u00eat illustre la m\u00e9thode prudente des juges du fond. Ils diss\u00e8quent la lettre de licenciement pour n\u2019en retenir que les \u00e9l\u00e9ments prouv\u00e9s et suffisamment graves. La faute grave est ainsi construite par agr\u00e9gation de manquements s\u00e9rieux, \u00e9tablissant une rupture de confiance justifiant une rupture sans pr\u00e9avis. Tout en validant le principe du licenciement, la cour prot\u00e8ge les droits p\u00e9cuniaires du salari\u00e9 et sanctionne les faiblesses de la d\u00e9monstration patronale par une condamnation aux frais.
