La cour d’appel, statuant en formation sociale, a rendu une ordonnance le 18 septembre 2025. Une requ\u00e9rante contestait le refus d’attribution d’une carte mobilit\u00e9 inclusion mention invalidit\u00e9. L’\u00e9tendue souveraine de la mission d’expertise<\/p>\n

Le pouvoir discr\u00e9tionnaire du juge sur la mesure d’instruction. Le juge de la mise en \u00e9tat conserve la ma\u00eetrise de la proc\u00e9dure d’expertise apr\u00e8s l’avoir ordonn\u00e9e. Il peut en adapter les modalit\u00e9s pour tenir compte de circonstances nouvelles affectant son bon d\u00e9roulement. L’impossibilit\u00e9 pour une partie de se soumettre \u00e0 un examen constitue un fait justifiant une r\u00e9vision des termes de la mission. Cette adaptation garantit le principe du contradictoire et l’\u00e9galit\u00e9 des armes. Elle permet \u00e0 la preuve de se constituer malgr\u00e9 un emp\u00eachement l\u00e9gitime.<\/p>\n

La modification des conditions d’intervention de l’expert. La d\u00e9cision substitue \u00e0 l’examen physique de la requ\u00e9rante un “examiner sur pi\u00e8ce le dossier” (Motifs). Cette modification alt\u00e8re la nature m\u00eame de la mission initialement confi\u00e9e au m\u00e9decin. La conciliation des imp\u00e9ratifs proc\u00e9duraux et des droits des parties<\/p>\n

La pr\u00e9servation des droits de la d\u00e9fense et de l’\u00e9quit\u00e9. La modification permet \u00e0 la proc\u00e9dure de suivre son cours sans p\u00e9naliser la requ\u00e9rante pour son \u00e9tat.
