Apr\u00e8s un avis n\u00e9gatif du comit\u00e9 r\u00e9gional, la requ\u00e9rante conteste le manque de motivation de cet avis. Le tribunal rejette cette demande mais ordonne la saisine d\u2019un second comit\u00e9 avant de statuer au fond.<\/p>\n<p>La motivation suffisante de l\u2019avis du premier comit\u00e9<\/p>\n<p>Le tribunal examine d\u2019abord la r\u00e9gularit\u00e9 formelle de l\u2019avis initial. Il rel\u00e8ve que le comit\u00e9 a dress\u00e9 une liste pr\u00e9cise des pi\u00e8ces consult\u00e9es. Il a \u00e9galement entendu le m\u00e9decin rapporteur avant de rendre sa d\u00e9cision. Le juge estime ainsi que l\u2019avis est suffisamment circonstanci\u00e9 pour \u00eatre qualifi\u00e9 de motiv\u00e9.<\/p>\n<p>La motivation doit permettre au juge de disposer d\u2019\u00e9l\u00e9ments d\u2019appr\u00e9ciation suffisants. Un avis ni d\u00e9velopp\u00e9 ni argument\u00e9 serait d\u00e9pourvu de port\u00e9e utile. En l\u2019esp\u00e8ce, l\u2019\u00e9num\u00e9ration des sources et la mention de l\u2019audition comblent cette exigence. Le contr\u00f4le op\u00e9r\u00e9 reste cependant limit\u00e9 \u00e0 l\u2019existence d\u2019une motivation formelle.<\/p>\n<p>L\u2019obligation de saisir un second comit\u00e9 r\u00e9gional<\/p>\n<p>Le tribunal aborde ensuite la question de la saisine d\u2019un nouvel expert. Le litige porte sur une maladie hors tableau de maladies professionnelles. La loi pr\u00e9voit une proc\u00e9dure sp\u00e9cifique en cas de diff\u00e9rend sur une telle pathologie. Le juge doit alors recueillir l\u2019avis d\u2019un second comit\u00e9 r\u00e9gional.<\/p>\n<p>L\u2019article R. 142-17-2 du Code de la s\u00e9curit\u00e9 sociale impose cette saisine pr\u00e9alable. Cette obligation s\u2019impose au tribunal sans qu\u2019il ne dispose de la moindre libert\u00e9 d\u2019appr\u00e9ciation. Le juge applique strictement cette r\u00e8gle proc\u00e9durale pour garantir l\u2019\u00e9quit\u00e9. Il d\u00e9signe donc le comit\u00e9 d\u2019Orl\u00e9ans et sursoit \u00e0 statuer en attendant son avis.<\/p>\n<p>Cette d\u00e9cision rappelle le caract\u00e8re imp\u00e9ratif de l\u2019expertise m\u00e9dicale duale. Elle renforce les garanties proc\u00e9durales offertes au travailleur dans un contentieux technique. Le juge social ne peut se prononcer au fond sans avoir obtenu ce second \u00e9clairage.
