Le p\u00f4le social du tribunal judiciaire d’Auxerre, par jugement du 12 mars 2025, statue sur un litige relatif \u00e0 la fixation de la date de consolidation suite \u00e0 un accident de trajet. L’assur\u00e9 contestait la date retenue par la caisse, invoquant la poursuite de soins et une inaptitude au travail. La juridiction rejette ses demandes et confirme la date de consolidation fix\u00e9e au 15 novembre 2023, tout en d\u00e9boutant la caisse de sa demande au titre des frais irr\u00e9p\u00e9tibles.<\/p>\n

La notion autonome de consolidation<\/p>\n

La d\u00e9finition juridique de la consolidation. Le jugement rappelle la distinction fondamentale entre gu\u00e9rison et consolidation, notion centrale en droit de la s\u00e9curit\u00e9 sociale. La consolidation correspond au moment o\u00f9 l’\u00e9tat de la victime est d\u00e9finitivement stabilis\u00e9, m\u00eame s’il subsiste encore des troubles. Cette d\u00e9finition autonome \u00e9carte toute confusion avec un retour \u00e0 un \u00e9tat de sant\u00e9 ant\u00e9rieur. Elle consacre une approche m\u00e9dicol\u00e9gale pure, d\u00e9tach\u00e9e de consid\u00e9rations subjectives ou professionnelles.<\/p>\n

L’ind\u00e9pendance de la consolidation face aux soins et \u00e0 l’aptitude au travail. Le tribunal isole la notion de consolidation de tout \u00e9l\u00e9ment extrins\u00e8que, affirmant son caract\u00e8re objectif. La consolidation est ind\u00e9pendante des soins toujours en cours ou de l’appr\u00e9ciation de l’aptitude au travail. Cette position est corrobor\u00e9e par la jurisprudence, qui \u00e9tablit que ni la persistance de douleurs, ni la poursuite de soins n’est incompatible avec la fixation d’une date de consolidation (Cour d’appel de Nancy, le 24 septembre 2025, n\u00b024\/02149). La consolidation marque ainsi le point de stabilisation d\u00e9finitive des l\u00e9sions.<\/p>\n

La charge de la preuve et le contr\u00f4le judiciaire<\/p>\n

L’exigence de preuve de la non-stabilisation. La d\u00e9cision op\u00e8re un renversement de la charge de la preuve au d\u00e9triment de l’assur\u00e9 contestataire. Il lui incombe de d\u00e9montrer que les l\u00e9sions ne sont pas stabilis\u00e9es et que la date de consolidation n’a pas \u00e9t\u00e9 correctement fix\u00e9e. Le juge exige ainsi une d\u00e9monstration positive de l’\u00e9volution pathologique, renfor\u00e7ant la pr\u00e9somption de validit\u00e9 attach\u00e9e \u00e0 la d\u00e9cision de la caisse. Cette exigence cadre avec les principes g\u00e9n\u00e9raux de la proc\u00e9dure civile en mati\u00e8re d’allocation du fardeau de la preuve.<\/p>\n

Le refus de la mesure d’instruction comme sanction de la carence probatoire. Le tribunal justifie son refus d’ordonner une expertise m\u00e9dicale par la carence de l’assur\u00e9 dans l’administration de la preuve. Elle reste une facult\u00e9 qui ne peut, de plus, \u00eatre ordonn\u00e9e en vue de suppl\u00e9er la carence d’une partie. Cette solution rappelle que la mesure d’instruction est subsidiaire et ne vise pas \u00e0 pallier l’inaction d’une partie. Elle confirme le pouvoir souverain des juges du fond dans l’appr\u00e9ciation de l’opportunit\u00e9 de telles mesures pour \u00e9clairer leur conviction.<\/p>\n

Ce jugement affirme avec force l’autonomie de la notion juridique de consolidation. Il en pr\u00e9cise les contours en la dissociant r\u00e9solument de la gu\u00e9rison, de la poursuite des soins et de l’inaptitude professionnelle. La solution renforce la s\u00e9curit\u00e9 juridique des d\u00e9cisions des caisses en exigeant une preuve solide de leur inexactitude.
