Il se pronon\u00e7ait sur une demande en r\u00e9siliation de bail pour impay\u00e9s de loyers et sur une demande de provision. Le juge a constat\u00e9 la r\u00e9gularit\u00e9 de la proc\u00e9dure et l&#8217;acquisition de la <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a>. Il a cependant accord\u00e9 des d\u00e9lais de paiement et suspendu les effets de cette clause, rejetant ainsi l&#8217;expulsion imm\u00e9diate tout en condamnant la locataire au paiement provisionnel des sommes dues.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale pr\u00e9alable \u00e0 l&#8217;action en r\u00e9siliation<\/p>\n<p>Le juge v\u00e9rifie d&#8217;abord le strict respect des formalit\u00e9s l\u00e9gales impos\u00e9es au bailleur. L&#8217;action en r\u00e9siliation n&#8217;est recevable qu&#8217;apr\u00e8s notification de l&#8217;assignation \u00e0 la pr\u00e9fecture et signalement pr\u00e9alable des impay\u00e9s. Une copie de l\u2019assignation a \u00e9t\u00e9 notifi\u00e9e \u00e0 la pr\u00e9fecture de Haute-Garonne par la voie \u00e9lectronique le 24 f\u00e9vrier 2025, soit plus de six semaines avant l\u2019audience conform\u00e9ment aux dispositions de l\u2019article 24 III de la loi n\u00b089-462 du 06 juillet 1989. Le bailleur justifie \u00e9galement avoir avis\u00e9 l&#8217;organisme payeur des aides au logement deux mois avant l&#8217;assignation. La confirmation par cet organisme de la r\u00e9ception de l&#8217;information suffit \u00e0 valider cette formalit\u00e9 malgr\u00e9 l&#8217;absence d&#8217;accus\u00e9 de r\u00e9ception. Ce contr\u00f4le rigoureux souligne le caract\u00e8re d&#8217;ordre public de ces r\u00e8gles protectrices. Leur m\u00e9connaissance entra\u00eene l&#8217;irrecevabilit\u00e9 de la demande, sanction proc\u00e9durale protectrice des droits du locataire.<\/p>\n<p>L&#8217;acquisition effective de la clause r\u00e9solutoire du bail<\/p>\n<p>Le juge examine ensuite les conditions de mise en \u0153uvre de la clause contractuelle. La loi encadre strictement les effets des clauses r\u00e9solutoires de plein droit pour impay\u00e9s. &#8220;Toute clause pr\u00e9voyant la r\u00e9siliation de plein droit du contrat de location pour d\u00e9faut de paiement du loyer ou des charges aux termes convenus ne produit effet que deux mois apr\u00e8s un <a href=\"https:\/\/kohenavocats.fr\/avocat-recouvrement-loyers-paris\/\" target=\"_blank\" title=\"commandement de payer\">commandement de payer<\/a> demeur\u00e9 infructueux&#8221; (article 24 I de la loi n\u00b089-462 du 06 juillet 1989). Le commandement d\u00e9livr\u00e9 reproduit les mentions obligatoires et laisse un d\u00e9lai de deux mois. Son caract\u00e8re infructueux au-del\u00e0 de ce d\u00e9lai permet de constater l&#8217;acquisition de la clause. Cette analyse confirme la jurisprudence exigeant un commandement r\u00e9gulier pr\u00e9alable. &#8220;Aux termes de l&#8217;article L145-1 du code de commerce toute clause ins\u00e9r\u00e9e dans le bail pr\u00e9voyant la r\u00e9siliation de plein droit ne produit effets qu&#8217;un mois apr\u00e8s un commandement demeur\u00e9 infructueux&#8221; (Cour d&#8217;appel de Montpellier, le 27 f\u00e9vrier 2025, n\u00b024\/02618). Le formalisme protecteur s&#8217;applique ainsi pleinement en mati\u00e8re d&#8217;habitation.<\/p>\n<p>Le pouvoir d&#8217;am\u00e9nagement des cons\u00e9quences de l&#8217;impay\u00e9<\/p>\n<p>Le juge use ensuite de son pouvoir d&#8217;\u00e9quit\u00e9 pour am\u00e9nager les d\u00e9lais de paiement. La loi r\u00e9cente lui permet d&#8217;accorder des d\u00e9lais et de suspendre la r\u00e9siliation sous conditions. Le locataire doit avoir repris le paiement du loyer courant et \u00eatre en capacit\u00e9 de r\u00e9gler sa dette. En l&#8217;esp\u00e8ce, les versements partiels r\u00e9cents et les revenus d\u00e9clar\u00e9s remplissent ces conditions. Le juge autorise d\u00e8s lors un \u00e9talement sur trente-six mois. Cette d\u00e9cision illustre la conciliation entre la protection du locataire et les int\u00e9r\u00eats du bailleur. Elle \u00e9vite une expulsion pour dette tout en garantissant un recouvrement progressif. Le juge op\u00e8re ainsi un contr\u00f4le concret de la situation du d\u00e9biteur. Il adapte la sanction contractuelle aux circonstances pour privil\u00e9gier le maintien dans les lieux.<\/p>\n<p>La suspension conditionnelle des effets de la clause r\u00e9solutoire<\/p>\n<p>Enfin, le juge suspend les effets de la clause r\u00e9solutoire acquise. Cette suspension est subordonn\u00e9e au respect strict du plan de paiement. &#8220;Lorsque le juge est saisi en ce sens par le bailleur ou par le locataire, et \u00e0 la condition que celui-ci ait repris le versement int\u00e9gral du loyer courant avant la date de l&#8217;audience, les effets de la clause de r\u00e9siliation de plein droit peuvent \u00eatre suspendus&#8221; (article 24 VII de la loi n\u00b089-462 du 06 juillet 1989). La d\u00e9cision pr\u00e9voit un m\u00e9canisme de r\u00e9vocation automatique en cas de nouvel impay\u00e9. Tout d\u00e9faut entra\u00eene la reprise des effets de la clause et ouvre droit \u00e0 expulsion. Le juge organise ainsi une p\u00e9riode probatoire pour le locataire. Cette solution \u00e9quilibre les droits des parties en donnant une chance au redressement.
