Un bailleur a saisi le juge pour obtenir la d\u00e9molition d&#8217;une pergola install\u00e9e sans autorisation par sa locataire sur une terrasse. Le bailleur invoquait un trouble manifestement illicite. Le juge a accueilli la demande et ordonn\u00e9 la remise en \u00e9tat des lieux sous astreinte.<\/p>\n<p>La caract\u00e9risation d&#8217;un trouble manifestement illicite<\/p>\n<p>Le fondement juridique du trouble manifestement illicite. Le juge fonde sa d\u00e9cision sur l&#8217;article 835 du code de proc\u00e9dure civile. Ce texte permet d&#8217;ordonner des mesures de remise en \u00e9tat pour faire cesser un trouble manifestement illicite. La jurisprudence rappelle que &#8220;la r\u00e9alisation sans autorisation de travaux portant atteinte aux parties communes de l&#8217;immeuble&#8221; constitue un tel trouble (Cour d&#8217;appel de Paris, le 4 avril 2024, n\u00b023\/14461). Le juge applique strictement ce principe \u00e0 l&#8217;esp\u00e8ce.<\/p>\n<p>L&#8217;application rigoureuse aux faits de l&#8217;esp\u00e8ce. L&#8217;installation concerne une terrasse, \u00e9l\u00e9ment affectant l&#8217;aspect ext\u00e9rieur. Le r\u00e8glement de <a href=\"https:\/\/kohenavocats.fr\/droit-de-la-copropriete\/\" target=\"_blank\" title=\"copropri\u00e9t\u00e9\">copropri\u00e9t\u00e9<\/a> interdit tout am\u00e9nagement rompant l&#8217;harmonie de l&#8217;immeuble. Le bail subordonne \u00e9galement toute transformation \u00e0 l&#8217;accord expr\u00e8s du bailleur. &#8220;Ces travaux, qui affectent l\u2019aspect ext\u00e9rieur de l\u2019immeuble, devaient \u00eatre autoris\u00e9s par l\u2019<a href=\"https:\/\/kohenavocats.fr\/elementor-60\/avocats-droit-affaires-paris\/avocat-assemblees-generales-societe-paris-2\/\" target=\"_blank\" title=\"assembl\u00e9e g\u00e9n\u00e9rale\">assembl\u00e9e g\u00e9n\u00e9rale<\/a> des copropri\u00e9taires ainsi que par le bailleur&#8221; (Motifs). Le d\u00e9faut d&#8217;autorisation rend l&#8217;installation illicite.<\/p>\n<p>Les cons\u00e9quences proc\u00e9durales de la caract\u00e9risation<\/p>\n<p>L&#8217;octroi de la mesure de remise en \u00e9tat. La qualification de trouble illicite ouvre droit \u00e0 la mesure demand\u00e9e. Le juge ordonne le d\u00e9montage de la pergola et la remise en l&#8217;\u00e9tat initial. Il exige &#8220;la production d\u2019une attestation de conformit\u00e9 par un professionnel du b\u00e2timent&#8221; (Dispositif). Cette exigence garantit l&#8217;efficacit\u00e9 pratique de la d\u00e9cision et la conformit\u00e9 des lieux.<\/p>\n<p>Le renforcement de l&#8217;efficacit\u00e9 par des mesures accessoires. Pour assurer l&#8217;ex\u00e9cution, le juge prononce une astreinte de trente euros par jour de retard. Il accorde \u00e9galement une provision sur les frais d&#8217;avocat au profit du bailleur. Il rappelle enfin le b\u00e9n\u00e9fice de l&#8217;ex\u00e9cution provisoire de droit. L&#8217;ensemble constitue un dispositif dissuasif et efficace pour le cr\u00e9ancier.<\/p>\n<p>Cette d\u00e9cision illustre la protection efficace des r\u00e8gles de copropri\u00e9t\u00e9 et des clauses contractuelles. Elle confirme que toute modification de l&#8217;aspect ext\u00e9rieur n\u00e9cessite une autorisation expresse. La jurisprudence utilis\u00e9e renforce la coh\u00e9rence de la mati\u00e8re.
