Il a examin\u00e9 une demande d&#8217;un bailleur social visant \u00e0 constater la r\u00e9siliation d&#8217;un bail pour impay\u00e9s. La proc\u00e9dure respectait les formalit\u00e9s pr\u00e9alables requises par la loi. Le juge a constat\u00e9 la r\u00e9siliation du bail tout en accordant des d\u00e9lais de paiement au locataire. Il a ainsi concili\u00e9 la sanction du d\u00e9faut de paiement avec une mesure de traitement du surendettement.<\/p>\n<p>Le formalisme proc\u00e9dural protecteur<\/p>\n<p>Le juge v\u00e9rifie scrupuleusement le respect des conditions de recevabilit\u00e9. La notification de l&#8217;assignation au repr\u00e9sentant de l&#8217;\u00c9tat est intervenue dans le d\u00e9lai l\u00e9gal. &#8220;une copie de l&#8217;assignation aux fins de constat de la r\u00e9siliation du bail a \u00e9t\u00e9 notifi\u00e9e au repr\u00e9sentant de l&#8217;Etat dans le d\u00e9partement le 30 ao\u00fbt 2024, soit au moins six semaines avant l&#8217;audience&#8221; (Motifs). Le signalement pr\u00e9alable \u00e0 la Caisse d&#8217;allocations familiales est \u00e9galement justifi\u00e9. Ces v\u00e9rifications garantissent la s\u00e9curit\u00e9 juridique de la proc\u00e9dure d&#8217;expulsion. Elles assurent une protection proc\u00e9durale au locataire avant toute d\u00e9cision sur le fond. Le formalisme strict constitue un garde-fou essentiel contre les r\u00e9siliations abusives. Il impose au bailleur une diligence particuli\u00e8re dans le recouvrement amiable.<\/p>\n<p>La demande en paiement est trait\u00e9e selon les principes g\u00e9n\u00e9raux de la preuve. Le bailleur doit rapporter la preuve de l&#8217;existence et du montant de la cr\u00e9ance. &#8220;il appartient \u00e0 celui qui demande l&#8217;ex\u00e9cution d&#8217;une obligation d&#8217;en rapporter la preuve&#8221; (Motifs). Le juge rel\u00e8ve que cette preuve est apport\u00e9e par les pi\u00e8ces du dossier. Il \u00e9carte en revanche toute demande de frais de recouvrement suppl\u00e9mentaires. &#8220;le bailleur ne peut mettre \u00e0 la charge du locataire les frais relatifs au recouvrement amiable ou contentieux de sa cr\u00e9ance&#8221; (Motifs). Cette solution est conforme \u00e0 une jurisprudence constante sur l&#8217;article 4 p) de la loi de 1989. &#8220;Conform\u00e9ment aux dispositions de l\u2019article 4 p) de la loi n\u00b089-462 du 6 juillet 1989, est r\u00e9put\u00e9e non \u00e9crite toute clause qui fait supporter au locataire des frais de relance ou d&#8217;exp\u00e9dition de la quittance ainsi que les frais de proc\u00e9dure&#8221; (Tribunal judiciaire, le 11 d\u00e9cembre 2025, n\u00b025\/00951). Le principe de faveur interdit ainsi toute majoration de la dette locative.<\/p>\n<p>La sanction temp\u00e9r\u00e9e par le traitement du surendettement<\/p>\n<p>Le juge constate l&#8217;acquisition de la clause r\u00e9solutoire apr\u00e8s un commandement de payer infructueux. Les conditions l\u00e9gales sont remplies d\u00e8s l&#8217;expiration du d\u00e9lai de deux mois. &#8220;Les conditions d&#8217;acquisition de la clause r\u00e9solutoire sont en principe r\u00e9unies \u00e0 l&#8217;expiration du d\u00e9lai de deux mois&#8221; (Motifs). La r\u00e9siliation est donc constat\u00e9e r\u00e9troactivement \u00e0 une date ant\u00e9rieure au jugement. Ce constat entra\u00eene des cons\u00e9quences imm\u00e9diates et s\u00e9v\u00e8res pour le locataire. Il devient occupant sans titre et doit lib\u00e9rer les lieux. Une indemnit\u00e9 d&#8217;occupation est due pour la p\u00e9riode post\u00e9rieure \u00e0 la r\u00e9siliation. Le juge rappelle \u00e9galement les modalit\u00e9s de l&#8217;expulsion forc\u00e9e. Cette partie du dispositif sanctionne clairement le manquement \u00e0 l&#8217;obligation essentielle de payer.<\/p>\n<p>Le juge suspend cependant les effets de cette r\u00e9siliation en accordant des d\u00e9lais de paiement. Cette d\u00e9cision est prise en application d&#8217;une disposition d\u00e9rogatoire protectrice. &#8220;par d\u00e9rogation \u00e0 l&#8217;article 24 V, en cas de constat de l&#8217;acquisition de la clause r\u00e9solutoire, lorsque la commission de surendettement des particuliers a impos\u00e9 les mesures pr\u00e9vues aux articles L. 733-1, L. 733-4 et L. 733-7 du code de la consommation, dont le bailleur a \u00e9t\u00e9 avis\u00e9, et qu&#8217;au jour de l&#8217;audience, le locataire a repris le paiement du loyer et des charges, le juge accorde les d\u00e9lais et modalit\u00e9s de paiement de la dette locative contenus dans le plan ou impos\u00e9s par la commission de surendettement des particuliers&#8221; (Motifs). Le juge se fonde sur un plan de la commission adopt\u00e9 en f\u00e9vrier 2025. Il int\u00e8gre ainsi la proc\u00e9dure de surendettement dans le contentieux locatif. Cette articulation permet une gestion judiciaire apais\u00e9e de l&#8217;impay\u00e9.<\/p>\n<p>La suspension est conditionn\u00e9e au respect strict du plan de paiement et du loyer courant. &#8220;en cas de d\u00e9faut de paiement d&#8217;un seul loyer ou d&#8217;une seule mensualit\u00e9, la totalit\u00e9 du solde restant d\u00fb deviendrait imm\u00e9diatement exigible&#8221; (Motifs). La clause r\u00e9solutoire reprendrait alors son effet avec toutes ses cons\u00e9quences. Le juge op\u00e8re donc un \u00e9quilibre subtil entre sanction et soutien. Il offre une derni\u00e8re chance au locataire de r\u00e9gulariser sa situation. Cette solution pragmatique \u00e9vite une expulsion in\u00e9luctable lorsque le redressement est possible.
