Un local commercial avait \u00e9t\u00e9 lou\u00e9 le 17 mars 2023, moyennant un loyer mensuel de 350 euros hors taxes et charges. Le preneur a cess\u00e9 de r\u00e9gler d\u00e8s mai 2023, malgr\u00e9 une sommation du 17 octobre 2023 demeur\u00e9e sans effet.<\/p>\n<p>Les bailleurs ont assign\u00e9 le 30 octobre 2024, sollicitant la r\u00e9siliation, l\u2019expulsion sous astreinte, une indemnit\u00e9 d\u2019occupation d\u00e8s octobre 2023, ainsi qu\u2019une somme au titre de l\u2019article 700. D\u00e9faillant \u00e0 l\u2019instance, le preneur n\u2019a pas constitu\u00e9 avocat; la juridiction a statu\u00e9 au fond par jugement r\u00e9put\u00e9 contradictoire. Les bailleurs justifiaient de l\u2019absence de cr\u00e9ancier inscrit sur le fonds de commerce, condition utile \u00e0 l\u2019opposabilit\u00e9 des mesures d\u2019ex\u00e9cution envisag\u00e9es. La question portait sur la r\u00e9solution judiciaire d\u2019un bail commercial hors clause r\u00e9solutoire, ses conditions, sa date d\u2019effet et l\u2019assiette d\u2019une indemnit\u00e9 d\u2019occupation. La juridiction a retenu la gravit\u00e9 des impay\u00e9s, prononc\u00e9 la r\u00e9siliation \u00e0 la date du jugement, ordonn\u00e9 l\u2019expulsion, refus\u00e9 l\u2019astreinte, et fix\u00e9 l\u2019indemnit\u00e9 \u00e0 compter de la d\u00e9cision.<\/p>\n<p>I. La r\u00e9solution judiciaire du bail commercial: fondements et qualification du manquement<\/p>\n<p>A. L\u2019office du juge en cas de d\u00e9faillance et les bases textuelles<\/p>\n<p>La formation rappelle l\u2019article 472 du code de proc\u00e9dure civile, qui encadre l\u2019office du juge en cas de d\u00e9faillance du d\u00e9fendeur. \u00ab Si le d\u00e9fendeur ne compara\u00eet pas, il est n\u00e9anmoins statu\u00e9 sur le fond. Le juge ne fait droit \u00e0 la demande que dans la mesure o\u00f9 il l&#8217;estime r\u00e9guli\u00e8re, recevable et bien fond\u00e9e \u00bb. Elle pr\u00e9cise statuer par jugement r\u00e9put\u00e9 contradictoire, conform\u00e9ment \u00e0 l\u2019article 473, avant d\u2019examiner le bien\u2011fond\u00e9 des pr\u00e9tentions au regard du droit applicable.<\/p>\n<p>La base mat\u00e9rielle de la r\u00e9solution est ensuite \u00e9nonc\u00e9e. Le jugement cite l\u2019article 1227 du code civil: \u00ab la r\u00e9solution du contrat peut, en toute hypoth\u00e8se \u00eatre ordonn\u00e9e en justice \u00bb. Il ajoute l\u2019article 1228, aux termes duquel \u00ab le juge peut, selon les circonstances, constater ou prononcer la r\u00e9solution ou ordonner l&#8217;ex\u00e9cution du contrat en accordant \u00e9ventuellement un d\u00e9lai au d\u00e9biteur, ou allouer seulement des dommages et int\u00e9r\u00eats \u00bb.<\/p>\n<p>B. La gravit\u00e9 des impay\u00e9s et la fixation des effets<\/p>\n<p>Le dossier \u00e9tablissait des impay\u00e9s continus depuis mai 2023 et l\u2019inefficacit\u00e9 d\u2019une sommation d\u2019octobre 2023, caract\u00e9risant une inex\u00e9cution essentielle des obligations du preneur. Le jugement retient express\u00e9ment que \u00ab Le d\u00e9faut de paiement des loyers par le preneur constitue un manquement grave de ce dernier \u00e0 ses obligations contractuelles \u00bb. Usant de la latitude de l\u2019article 1228, la juridiction fixe l\u2019effet de la r\u00e9siliation au jour o\u00f9 elle statue, sans r\u00e9troactivit\u00e9, l\u2019affaire ne comportant aucune clause r\u00e9solutoire. Ainsi, il est \u00e9crit: \u00ab Il y a lieu par cons\u00e9quent de prononcer la r\u00e9siliation du bail \u00e0 la date de la pr\u00e9sente d\u00e9cision \u00bb. Cette d\u00e9termination commande directement l\u2019\u00e9conomie des mesures accessoires, dont l\u2019indemnit\u00e9 d\u2019occupation et l\u2019organisation de l\u2019expulsion.<\/p>\n<p>II. Les effets accessoires de la rupture: indemnit\u00e9, coercition et garanties<\/p>\n<p>A. L\u2019indemnit\u00e9 d\u2019occupation: principe, quantum et point de d\u00e9part<\/p>\n<p>Le juge alloue une indemnit\u00e9 d\u2019occupation au taux du loyer, soit 350 euros mensuels, traduisant l\u2019\u00e9quivalence d\u2019une contrepartie pour l\u2019occupation sans titre apr\u00e8s la r\u00e9siliation. La d\u00e9cision pr\u00e9cise une assiette temporelle conforme \u00e0 la date d\u2019effet choisie: \u00ab une indemnit\u00e9 d&#8217;occupation mensuelle de 350 euros \u00e0 compter de la pr\u00e9sente d\u00e9cision \u00bb. Les bailleurs sollicitaient une r\u00e9troactivit\u00e9 \u00e0 octobre 2023; le refus r\u00e9v\u00e8le une application mesur\u00e9e de l\u2019article 1228, privil\u00e9giant l\u2019\u00e9quilibre entre sanction de l\u2019inex\u00e9cution et s\u00e9curit\u00e9 juridique. Cette solution limite les recomptes contentieux ant\u00e9rieurs et r\u00e9serve, le cas \u00e9ch\u00e9ant, une action indemnitaire distincte si un pr\u00e9judice suppl\u00e9mentaire \u00e9tait \u00e9tabli.<\/p>\n<p>B. Expulsion, astreinte et garanties: proportion et r\u00e9gularit\u00e9<\/p>\n<p>L\u2019expulsion est ordonn\u00e9e pour assurer l\u2019effectivit\u00e9 de la r\u00e9siliation, la r\u00e9gularit\u00e9 ayant \u00e9t\u00e9 v\u00e9rifi\u00e9e au regard des cr\u00e9anciers \u00e9ventuellement int\u00e9ress\u00e9s par le fonds. Le jugement souligne \u00e0 cet \u00e9gard: \u00ab Les bailleurs justifient par ailleurs de l&#8217;absence de cr\u00e9ancier inscrit sur le fonds de commerce conform\u00e9ment aux dispositions de l&#8217;article L143-2 du code de commerce \u00bb. Le recours \u00e0 une astreinte est \u00e9cart\u00e9 par une motivation br\u00e8ve mais claire: \u00ab Le prononc\u00e9 d&#8217;une astreinte n&#8217;apparaissant pas n\u00e9cessaire \u00bb. Ce choix manifeste une recherche de proportion, l\u2019expulsion constituant d\u00e9j\u00e0 une mesure suffisamment incisive, et l\u2019astreinte demeurant disponible si l\u2019ex\u00e9cution rencontrait des obstacles s\u00e9rieux.
