Litige n\u00e9 d\u2019un bail d\u2019habitation conclu en 2023, marqu\u00e9 par des impay\u00e9s ayant d\u00e9clench\u00e9 un commandement de payer. Par ordonnance de r\u00e9f\u00e9r\u00e9 du 19 septembre 2024, la clause r\u00e9solutoire a \u00e9t\u00e9 tenue pour acquise au 10 janvier 2024, l\u2019expulsion ordonn\u00e9e et une provision arr\u00eat\u00e9e.<\/p>\n<p>En appel, l\u2019occupant sollicite la suspension des effets de la clause et des d\u00e9lais de paiement \u00e9tal\u00e9s sur trente-six mois, en invoquant reprise des aides et retour \u00e0 l\u2019emploi. Le bailleur demande confirmation, actualisation de la dette et, subsidiairement, r\u00e9siliation judiciaire, tout en contestant la capacit\u00e9 \u00e0 apurer et \u00e0 r\u00e9gler le courant.<\/p>\n<p>Les pi\u00e8ces communiqu\u00e9es attestent d\u2019un rappel d\u2019aide au logement en mars 2025, de versements r\u00e9guliers au printemps, d\u2019un accord du fonds de solidarit\u00e9 pour le logement, et d\u2019un emploi retrouv\u00e9 en avril. La dette a l\u00e9g\u00e8rement diminu\u00e9 depuis la premi\u00e8re d\u00e9cision, ce qui manifeste une dynamique de r\u00e9gularisation cr\u00e9dible.<\/p>\n<p>La question pos\u00e9e tient aux conditions permettant au juge d\u2019accorder des d\u00e9lais et de suspendre la clause r\u00e9solutoire acquise, au regard des articles 1343\u20115 du code civil et 24 V de la loi du 6 juillet 1989. La d\u00e9cision comment\u00e9e infirme partiellement l\u2019ordonnance, accorde un plan d\u2019apurement et suspend les effets de la clause sous conditions strictes, tout en \u00e9cartant une demande p\u00e9cuniaire irrecevable en r\u00e9f\u00e9r\u00e9.<\/p>\n<p>I. Le fondement et le contr\u00f4le des d\u00e9lais de paiement<\/p>\n<p>A. Les crit\u00e8res l\u00e9gaux mobilis\u00e9s par la juridiction d\u2019appel<\/p>\n<p>La motivation reprend les textes applicables et les articule. La cour rappelle d\u2019abord que, selon la formule retenue, \u00ab le juge peut, compte tenu de la situation du d\u00e9biteur et en consid\u00e9ration des besoins du cr\u00e9ancier, reporter ou \u00e9chelonner, dans la limite de deux ann\u00e9es, le paiement des sommes dues \u00bb. On mentionne un second levier sp\u00e9cifique aux baux d\u2019habitation, la juridiction citant que \u00ab le juge peut, \u00e0 la condition que le locataire soit en situation de r\u00e9gler sa dette locative et qu\u2019il ait repris le versement int\u00e9gral du loyer courant avant la date de l\u2019audience, accorder des d\u00e9lais de paiement dans la limite de trois ann\u00e9es \u00bb.<\/p>\n<p>Ces rappels visent \u00e0 encadrer l\u2019office du juge des r\u00e9f\u00e9r\u00e9s lorsqu\u2019une clause r\u00e9solutoire a produit effet. La pr\u00e9cision sur la reprise int\u00e9grale du loyer courant avant l\u2019audience impose un crit\u00e8re temporel rigoureux, distinct de la simple promesse de paiement. L\u2019exigence d\u2019une situation permettant l\u2019apurement circonscrit l\u2019octroi aux d\u00e9biteurs cr\u00e9dibles, au regard des ressources, des aides et des engagements ext\u00e9rieurs.<\/p>\n<p>B. L\u2019appr\u00e9ciation des gages de solvabilit\u00e9 et de reprise<\/p>\n<p>Le contr\u00f4le op\u00e9r\u00e9 est concret. La cour retient la diminution de l\u2019arri\u00e9r\u00e9 depuis l\u2019ordonnance, la reprise de l\u2019aide au logement, l\u2019accord du fonds de solidarit\u00e9 et le retour \u00e0 l\u2019emploi. Ces \u00e9l\u00e9ments convergents qualifient un apurement possible et une reprise effective du courant, r\u00e9pondant aux conditions textuelles rappel\u00e9es.<\/p>\n<p>Surtout, la d\u00e9cision formule l\u2019effet utile des constats op\u00e9r\u00e9s en indiquant qu\u2019\u00ab il convient de faire droit \u00e0 la demande de suspension des effets de la clause r\u00e9solutoire \u00bb. Cette option entra\u00eene l\u2019infirmation partielle, la juridiction pr\u00e9cisant que \u00ab l\u2019ordonnance sera infirm\u00e9e en ce qu\u2019elle rejette la demande de suspension des effets de la clause r\u00e9solutoire et celle relative aux d\u00e9lais de paiement \u00bb.<\/p>\n<p>II. La port\u00e9e de la solution et son \u00e9conomie contentieuse<\/p>\n<p>A. Les limites proc\u00e9durales du r\u00e9f\u00e9r\u00e9 en mati\u00e8re de condamnation<\/p>\n<p>La d\u00e9cision rappelle la finalit\u00e9 du r\u00e9f\u00e9r\u00e9 provision en citant l\u2019article 835 du code de proc\u00e9dure civile: \u00ab dans les cas o\u00f9 l\u2019existence de l\u2019obligation n\u2019est pas s\u00e9rieusement contestable, [\u2026] peuvent accorder une provision au cr\u00e9ancier \u00bb. L\u2019exigence d\u2019une demande form\u00e9e \u00e0 titre provisionnel structure la recevabilit\u00e9 des pr\u00e9tentions p\u00e9cuniaires en appel de r\u00e9f\u00e9r\u00e9.<\/p>\n<p>La cour tire la cons\u00e9quence proc\u00e9durale en retenant que \u00ab les autres demandes sont sans objet d\u00e8s lors que la cour n\u2019est pas saisie d\u2019une demande d\u2019infirmation de la disposition de l\u2019ordonnance qui constate l\u2019acquisition de la clause r\u00e9solutoire, \u00e0 compter du 10 janvier 2024 \u00bb. La demande p\u00e9cuniaire non formul\u00e9e \u00e0 titre provisionnel est d\u00e9clar\u00e9e irrecevable, ce qui illustre la rigueur attach\u00e9e aux cadres du r\u00e9f\u00e9r\u00e9.<\/p>\n<p>B. Les effets pratiques du plan d\u2019apurement et la pr\u00e9vention des expulsions<\/p>\n<p>Le dispositif consacre une suspension conditionnelle, conforme aux textes et aux objectifs de pr\u00e9vention des expulsions. La juridiction d\u00e9cide en termes clairs: \u00ab Suspend les effets de la clause r\u00e9solutoire \u00bb et \u00ab dit qu\u2019elle sera r\u00e9put\u00e9e n\u2019avoir jamais jou\u00e9 \u00bb si les conditions d\u2019apurement et de paiement courant sont respect\u00e9es.<\/p>\n<p>Le m\u00e9canisme de sanction des incidents est explicite et proportionn\u00e9. \u00c0 d\u00e9faut de paiement conforme, \u00ab la totalit\u00e9 de la somme restant due deviendra imm\u00e9diatement exigible \u00bb et \u00ab la clause r\u00e9solutoire reprendra son plein effet \u00bb. L\u2019\u00e9conomie g\u00e9n\u00e9rale concilie protection du logement et s\u00e9curit\u00e9 du cr\u00e9ancier, en exigeant une discipline stricte dans l\u2019ex\u00e9cution du plan.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Cour d\u2019appel de Paris, 11 septembre 2025.
