Les occupants invoquaient la prescription acquisitive, par eux-m\u00eames et par leurs ascendants. L\u2019intim\u00e9e se pr\u00e9valait d\u2019un acte authentique de 1981, compl\u00e9t\u00e9 par un document de filiation parcellaire, et d\u2019un constat d\u2019occupation avec constructions r\u00e9centes. Le tribunal judiciaire de Pointe-\u00e0-Pitre, par ordonnance du 15 d\u00e9cembre 2023, a ordonn\u00e9 l\u2019expulsion, la d\u00e9molition et allou\u00e9 une indemnit\u00e9. Un arr\u00eat avant dire droit du 30 janvier 2025 a rouvert les d\u00e9bats sur la d\u00e9molition et la charge de ses frais. La cour d\u00e9clare recevable l\u2019intervention volontaire d\u2019une proche de l\u2019occupant, \u00e0 la lumi\u00e8re de la r\u00e8gle selon laquelle \u00ab A l&#8217;\u00e9nonc\u00e9 de l&#8217;article 554 du code de proc\u00e9dure civile, peuvent intervenir en cause d&#8217;appel d\u00e9s lors qu&#8217;elles y ont int\u00e9r\u00eat les personnes qui n&#8217;ont \u00e9t\u00e9 ni parties, ni repr\u00e9sent\u00e9es en premi\u00e8re instance ou qui y ont figur\u00e9 en une autre qualit\u00e9 \u00bb. La question centrale porte sur l\u2019office du juge des r\u00e9f\u00e9r\u00e9s face \u00e0 une atteinte au droit de propri\u00e9t\u00e9, et sur la possibilit\u00e9 d\u2019ordonner la d\u00e9molition au regard de l\u2019article 555 du code civil. La cour confirme l\u2019expulsion en tant que mesure de cessation d\u2019un trouble manifestement illicite, mais \u00e9carte la d\u00e9molition en r\u00e9f\u00e9r\u00e9. La d\u00e9cision pr\u00e9cise le contr\u00f4le du trouble manifestement illicite en r\u00e9f\u00e9r\u00e9, puis encadre les pr\u00e9rogatives quant \u00e0 la d\u00e9molition.<\/p>\n<p>I. Le contr\u00f4le du trouble manifestement illicite en r\u00e9f\u00e9r\u00e9<\/p>\n<p>A. Les crit\u00e8res directeurs et leur application \u00e0 l\u2019esp\u00e8ce<br \/>\nLa cour rappelle la port\u00e9e de l\u2019article 809 du code de proc\u00e9dure civile en ces termes : \u00ab En application de l&#8217;article 809 alin\u00e9a 1er du code de proc\u00e9dure civile, le pr\u00e9sident peut toujours, m\u00eame en pr\u00e9sence d&#8217;une contestation s\u00e9rieuse, prescrire en r\u00e9f\u00e9r\u00e9 les mesures conservatoires ou de remise en \u00e9tat qui s&#8217;imposent, soit pour pr\u00e9venir un dommage imminent, soit pour faire cesser un trouble manifestement illicite. \u00bb Elle pr\u00e9cise les d\u00e9finitions op\u00e9ratoires qui guident l\u2019office du juge : \u00ab Le dommage imminent s&#8217;entend du dommage qui n&#8217;est pas encore r\u00e9alis\u00e9 mais qui se produira s\u00fbrement si la situation actuelle doit se perp\u00e9tuer ; le trouble manifestement illicite r\u00e9sulte de toute perturbation r\u00e9sultant d&#8217;un fait qui directement ou indirectement constitue une violation \u00e9vidente de la r\u00e8gle de droit. \u00bb En rapprochant ces normes des pi\u00e8ces, la cour retient un titre authentique ancien et une filiation cadastrale, ainsi qu\u2019un constat descriptif d\u2019\u00e9dification d\u2019une construction r\u00e9cente. Les all\u00e9gations d\u2019usucapion ne sont pas \u00e9tay\u00e9es par une possession utile, continue et non \u00e9quivoque, exerc\u00e9e \u00e0 titre de propri\u00e9taire. Des d\u00e9marches ant\u00e9rieures d\u2019acquisition r\u00e9v\u00e8lent au contraire l\u2019absence d\u2019animus domini. Dans ce cadre probatoire, la violation apparente du droit de propri\u00e9t\u00e9, concr\u00e9tis\u00e9e par l\u2019occupation et des travaux, caract\u00e9rise le trouble manifestement illicite.<\/p>\n<p>B. L\u2019expulsion comme mesure de remise en \u00e9tat malgr\u00e9 la contestation all\u00e9gu\u00e9e<br \/>\nLa cour articule clairement le pouvoir d\u2019injonction en r\u00e9f\u00e9r\u00e9 et la pr\u00e9sence d\u2019une contestation : \u00ab L&#8217;existence d&#8217;une contestation s\u00e9rieuse n&#8217;interdit pas au juge des r\u00e9f\u00e9r\u00e9s de prendre les mesures pr\u00e9vues par l&#8217;article pr\u00e9cit\u00e9 en appr\u00e9ciant le caract\u00e8re manifestement illicite du trouble caus\u00e9, l&#8217;atteinte au droit de propri\u00e9t\u00e9 \u00e9tant consid\u00e9r\u00e9e comme constituant par elle m\u00eame une voie de fait causant un tel trouble. \u00bb Le principe d\u00e9gag\u00e9 est classique : la gravit\u00e9 et l\u2019\u00e9vidence de l\u2019atteinte au droit de propri\u00e9t\u00e9 l\u00e9gitiment une mesure de cessation, telle l\u2019expulsion, sans pr\u00e9juger du fond. La cour souligne que la proc\u00e9dure au principal est engag\u00e9e, ce qui encadre la mesure provisoire et confirme sa finalit\u00e9 de remise en \u00e9tat. L\u2019\u00e9quilibre est net : protection imm\u00e9diate du droit l\u00e9s\u00e9, contr\u00f4le de proportionnalit\u00e9 par la temporalit\u00e9 du r\u00e9f\u00e9r\u00e9, et renvoi implicite des questions de propri\u00e9t\u00e9 au juge du fond. La confirmation de l\u2019expulsion s\u2019inscrit donc dans le sch\u00e9ma orthodoxe du trouble manifeste, la preuve par titre et les constatations mat\u00e9rielles neutralisant la port\u00e9e d\u2019une contestation non d\u00e9montr\u00e9e.<\/p>\n<p>II. L\u2019encadrement des pouvoirs du juge des r\u00e9f\u00e9r\u00e9s en mati\u00e8re de d\u00e9molition<\/p>\n<p>A. La d\u00e9molition, mesure exc\u00e9dant l\u2019office du juge des r\u00e9f\u00e9r\u00e9s au regard de l\u2019article 555<br \/>\nLa cour op\u00e8re une distinction d\u00e9cisive entre la cessation de l\u2019occupation et la d\u00e9molition des constructions. Elle \u00e9nonce que \u00ab Toutefois, au regard des r\u00e8gles applicables en mati\u00e8re de constructions par un tiers sur le terrain d&#8217;autrui et de l&#8217;appr\u00e9ciation de la bonne ou mauvaise foi de ce dernier, il y a lieu de consid\u00e9rer que la d\u00e9molition des constructions y \u00e9difi\u00e9es ne rel\u00e8ve pas des pouvoirs du juge des r\u00e9f\u00e9r\u00e9s. \u00bb La r\u00e9f\u00e9rence explicite \u00e0 l\u2019\u00e9conomie de l\u2019article 555 du code civil \u00e9claire la solution : l\u2019appr\u00e9ciation de la bonne ou mauvaise foi, la qualification des ouvrages et le choix entre conservation avec indemnisation ou suppression appellent un examen au fond. La d\u00e9molition pr\u00e9sente un caract\u00e8re irr\u00e9versible qui exc\u00e8de la logique de mesures provisoires, sauf hypoth\u00e8se exceptionnelle non caract\u00e9ris\u00e9e ici. La cour infirme donc ce chef, en coh\u00e9rence avec la nature des pouvoirs du juge des r\u00e9f\u00e9r\u00e9s et la n\u00e9cessit\u00e9 d\u2019un d\u00e9bat contradictoire approfondi sur les cons\u00e9quences patrimoniales et la qualification de la possession.<\/p>\n<p>B. Port\u00e9e pratique de la solution et articulation des proc\u00e9dures<br \/>\nLe dispositif consacre la limite fonctionnelle ainsi r\u00e9sum\u00e9e : \u00ab dit n&#8217;y avoir lieu \u00e0 r\u00e9f\u00e9r\u00e9 sur ces demandes relatives \u00e0 la d\u00e9molition des constructions et \u00e0 la remise en \u00e9tat des lieux \u00bb. La port\u00e9e est double. D\u2019une part, la cessation de l\u2019occupation illicite est obtenue par l\u2019expulsion, ce qui met fin au trouble manifeste sans trancher d\u00e9finitivement la propri\u00e9t\u00e9 ni l\u2019existence d\u2019une prescription. D\u2019autre part, la d\u00e9molition est renvoy\u00e9e \u00e0 l\u2019instance au fond, seule \u00e0 m\u00eame d\u2019arbitrer les cons\u00e9quences de l\u2019article 555, notamment quant \u00e0 la bonne foi, aux am\u00e9liorations \u00e9ventuelles et aux indemnit\u00e9s crois\u00e9es. La solution pr\u00e9serve l\u2019effectivit\u00e9 du droit de propri\u00e9t\u00e9 par une mesure proportionn\u00e9e et r\u00e9versible, et maintient la s\u00e9curit\u00e9 juridique en refusant un rem\u00e8de radical en urgence. Elle offre un cadre op\u00e9ratoire lisible pour les conflits d\u2019occupation rurale ou p\u00e9riurbaine impliquant des constructions : le r\u00e9f\u00e9r\u00e9 traite l\u2019illicite manifeste, tandis que le juge du fond tranche l\u2019accession immobili\u00e8re et ses suites.
