Une locataire, en situation de pr\u00e9carit\u00e9 sociale et m\u00e9dicale, avait vu son bail r\u00e9sili\u00e9 de plein droit apr\u00e8s un commandement de payer rest\u00e9 infructueux. La question centrale portait sur l\u2019acquisition de la clause r\u00e9solutoire et l\u2019octroi de d\u00e9lais pour quitter les lieux. La juridiction a fait droit \u00e0 la demande du bailleur tout en accordant un d\u00e9lai de six mois \u00e0 l\u2019occupante.<\/p>\n<p>La recevabilit\u00e9 de l\u2019action du bailleur et l\u2019acquisition de la clause r\u00e9solutoire.<\/p>\n<p>Le tribunal a d\u2019abord v\u00e9rifi\u00e9 la recevabilit\u00e9 de la demande en s\u2019assurant du respect des obligations pr\u00e9alables. Le bailleur justifiait avoir inform\u00e9 la commission de coordination des actions de pr\u00e9vention des expulsions locatives deux mois avant l\u2019assignation. Il d\u00e9montrait \u00e9galement avoir notifi\u00e9 l\u2019assignation au repr\u00e9sentant de l\u2019\u00c9tat dans le d\u00e9partement plus de six semaines avant l\u2019audience. Ces formalit\u00e9s rendaient l\u2019action recevable sur le fondement de l\u2019article 24 de la loi du 6 juillet 1989.<\/p>\n<p>Sur le fond, le juge a constat\u00e9 que le contrat de location contenait une clause r\u00e9solutoire valide. Un commandement de payer visant cette clause avait \u00e9t\u00e9 d\u00e9livr\u00e9 le 3 avril 2025 pour une somme principale de 3502,38 euros. La locataire n\u2019ayant effectu\u00e9 aucun r\u00e8glement dans le d\u00e9lai de deux mois suivant cet acte, les conditions de la clause \u00e9taient r\u00e9unies. Le tribunal a donc constat\u00e9 la r\u00e9siliation de plein droit du bail \u00e0 compter du 4 juin 2025.<\/p>\n<p>La port\u00e9e de cette solution est classique mais ferme. Elle rappelle que la clause r\u00e9solutoire produit ses effets automatiquement d\u00e8s lors que le locataire ne purge pas le commandement dans le d\u00e9lai imparti. La valeur de cette d\u00e9cision r\u00e9side dans son application m\u00e9canique du droit, sans \u00e9gard aux difficult\u00e9s personnelles de la d\u00e9bitrice \u00e0 ce stade du raisonnement.<\/p>\n<p>Les d\u00e9lais pour quitter les lieux et les cons\u00e9quences financi\u00e8res de la r\u00e9siliation.<\/p>\n<p>Apr\u00e8s avoir ordonn\u00e9 l\u2019expulsion, le juge a examin\u00e9 la demande de d\u00e9lais formul\u00e9e par l\u2019occupante. Celle-ci sollicitait un an pour lib\u00e9rer le logement en raison de sa situation fragile. Elle percevait une pension d\u2019invalidit\u00e9, une aide au retour \u00e0 l\u2019emploi r\u00e9duite et justifiait d\u2019un recours DALO en cours. Elle \u00e9tait \u00e9galement suivie m\u00e9dicalement et orient\u00e9e vers un appartement th\u00e9rapeutique.<\/p>\n<p>Le tribunal a accord\u00e9 un d\u00e9lai de six mois, en consid\u00e9ration de ces \u00e9l\u00e9ments mais aussi des int\u00e9r\u00eats l\u00e9gitimes du propri\u00e9taire. Il a estim\u00e9 que ce d\u00e9lai \u00e9tait suffisant pour permettre un relogement adapt\u00e9, tout en \u00e9vitant une prolongation excessive de l\u2019occupation indue. Cette solution concilie l\u2019imp\u00e9ratif d\u2019ex\u00e9cution de la d\u00e9cision judiciaire avec la protection due aux personnes vuln\u00e9rables.<\/p>\n<p>Enfin, le tribunal a condamn\u00e9 la locataire au paiement de l\u2019arri\u00e9r\u00e9 locatif actualis\u00e9 \u00e0 8872,77 euros. Il a \u00e9galement fix\u00e9 une indemnit\u00e9 d\u2019occupation mensuelle \u00e9quivalente au loyer et aux charges jusqu\u2019\u00e0 la lib\u00e9ration effective des lieux. La valeur de cette d\u00e9cision est de rappeler que l\u2019indemnit\u00e9 d\u2019occupation a une nature compensatoire et indemnitaire, distincte du loyer contractuel.
