L\u2019occupante, assign\u00e9e en r\u00e9siliation de sa convention, sollicitait la cessation d\u2019un trouble manifestement illicite et la pr\u00e9vention d\u2019un dommage imminent. La question centrale portait sur la caract\u00e9risation de ces conditions face \u00e0 un d\u00e9saccord sur la qualification du contrat. Le juge a rejet\u00e9 l\u2019ensemble des demandes de l\u2019occupante.<\/p>\n<p>Sur l\u2019absence de trouble manifestement illicite et de dommage imminent.<\/p>\n<p>Le juge des r\u00e9f\u00e9r\u00e9s rappelle que l\u2019article 835 du code de proc\u00e9dure civile exige un trouble illicite caract\u00e9ris\u00e9 ou un p\u00e9ril certain. En l\u2019esp\u00e8ce, les \u00e9l\u00e9ments produits sont jug\u00e9s insuffisants pour \u00e9tablir de telles situations. Le tribunal rel\u00e8ve que <em>&#8220;ces \u00e9l\u00e9ments sont par cons\u00e9quents insuffisants \u00e0 caract\u00e9riser un trouble manifestement illicite et un dommage imminent&#8221;<\/em> (Motifs). Cette d\u00e9cision a une valeur p\u00e9dagogique : elle rappelle que la simple tension entre parties ne suffit pas \u00e0 justifier une mesure conservatoire.<\/p>\n<p>La port\u00e9e de ce raisonnement est de circonscrire strictement le champ du r\u00e9f\u00e9r\u00e9. Le juge refuse de se substituer au juge du fond sur la nature du contrat, car <em>&#8220;le d\u00e9saccord des parties sur la nature du contrat liant les parties emp\u00eache de faire application de l\u2019article 834&#8221;<\/em> (Motifs). Ainsi, le r\u00e9f\u00e9r\u00e9 ne peut trancher une contestation s\u00e9rieuse portant sur le droit au bail.<\/p>\n<p>Sur le rejet des demandes accessoires et la charge des d\u00e9pens.<\/p>\n<p>L\u2019occupante ayant succomb\u00e9, le juge la condamne aux d\u00e9pens conform\u00e9ment \u00e0 l\u2019article 696 du code de proc\u00e9dure civile. Il \u00e9carte toute application de l\u2019article 700 en laissant \u00e0 chaque partie la charge de ses frais. Cette solution a une valeur d\u2019\u00e9quilibre proc\u00e9dural : elle sanctionne la partie qui a tent\u00e9 d\u2019utiliser le r\u00e9f\u00e9r\u00e9 de mani\u00e8re abusive.<\/p>\n<p>La port\u00e9e de cette d\u00e9cision est de rappeler que le r\u00e9f\u00e9r\u00e9 n\u2019est pas une voie permettant de contourner le d\u00e9bat au fond.
