Un bailleur social avait assign\u00e9 sa locataire pour obtenir le constat de la clause r\u00e9solutoire et le paiement de l\u2019arri\u00e9r\u00e9 locatif. La locataire, ayant quitt\u00e9 les lieux apr\u00e8s un cong\u00e9, ne comparaissait pas. La question de droit portait sur le montant de la dette locative apr\u00e8s d\u00e9duction des frais de recouvrement. Le juge a condamn\u00e9 la locataire \u00e0 payer 9 950,62 euros tout en d\u00e9boutant le bailleur de ses demandes d\u2019expulsion devenues sans objet.<\/p>\n<p>La qualification des frais de recouvrement comme clause abusive.<\/p>\n<p>Le juge \u00e9carte les frais de commissaire de justice de la dette locative en application de l\u2019article 4 p) de la loi du 6 juillet 1989. Il retient qu\u2019\u00ab est r\u00e9put\u00e9e non \u00e9crite toute clause qui fait supporter au locataire des frais de relance ou d&#8217;exp\u00e9dition de la quittance ainsi que les frais de proc\u00e9dure \u00bb (Motifs, I, Sur la demande en paiement). Cette solution prohibe toute facturation au preneur des frais de recouvrement amiable ou contentieux. La port\u00e9e de cette d\u00e9cision est de rappeler l\u2019ordre public locatif qui prot\u00e8ge le locataire contre des charges indues. Le sens est de purger la cr\u00e9ance de tout \u00e9l\u00e9ment illicite avant condamnation.<\/p>\n<p>L\u2019actualisation de la dette en l\u2019absence du d\u00e9fendeur.<\/p>\n<p>Le tribunal admet la recevabilit\u00e9 du d\u00e9compte actualis\u00e9 malgr\u00e9 la non-comparution de la locataire. Il estime que la cr\u00e9ance, \u00ab d\u2019un montant d\u00e9terminable, est \u00e9tablie par un d\u00e9compte pr\u00e9cis et actualis\u00e9 \u00bb (Motifs, I, Sur la demande en paiement). Cette solution permet au juge de statuer sur le fond en vertu de l\u2019article 472 du code de proc\u00e9dure civile. La valeur de cette position est de garantir l\u2019efficacit\u00e9 de la proc\u00e9dure par d\u00e9faut. La port\u00e9e est d\u2019encourager le bailleur \u00e0 fournir un d\u00e9compte rigoureux pour obtenir une condamnation fiable.<\/p>\n<p>L\u2019absence d\u2019objet des demandes d\u2019expulsion apr\u00e8s le d\u00e9part.<\/p>\n<p>Le juge constate que les demandes d\u2019expulsion et de sort des meubles sont devenues sans objet. Il suit la propre indication du bailleur, qui reconna\u00eet le cong\u00e9 et l\u2019\u00e9tat des lieux de sortie. Cette solution \u00e9vite une d\u00e9cision inutile sur des mesures devenues impossibles. La valeur de ce constat est de respecter le principe de l\u2019\u00e9conomie de la proc\u00e9dure.
