Le locataire, qui reconnaissait la dette, sollicitait des d\u00e9lais de paiement et la suspension des effets de la clause r\u00e9solutoire. La question centrale portait sur les conditions d\u2019octroi de ces mesures de faveur au regard de la situation financi\u00e8re du d\u00e9biteur. Le juge a constat\u00e9 la r\u00e9siliation du bail, rejet\u00e9 la demande de d\u00e9lais et ordonn\u00e9 l\u2019expulsion.<\/p>\n<p>Sur la recevabilit\u00e9 et l\u2019acquisition de la clause r\u00e9solutoire.<\/p>\n<p>Le tribunal a d\u2019abord v\u00e9rifi\u00e9 le respect des obligations proc\u00e9durales impos\u00e9es par la loi du 6 juillet 1989. Il a relev\u00e9 que la bailleresse avait notifi\u00e9 l\u2019assignation au repr\u00e9sentant de l\u2019\u00c9tat et saisi la commission de coordination des actions de pr\u00e9vention des expulsions locatives dans les d\u00e9lais requis. Le juge a ensuite constat\u00e9 que le commandement de payer, d\u00e9livr\u00e9 le 18 novembre 2024, \u00e9tait rest\u00e9 infructueux pendant plus de six semaines.<\/p>\n<p>Il a donc logiquement conclu que les conditions de la clause r\u00e9solutoire \u00e9taient r\u00e9unies depuis le 31 d\u00e9cembre 2024. Ce faisant, le tribunal rappelle la rigueur de l\u2019application de la clause r\u00e9solutoire lorsque le preneur ne justifie d\u2019aucun r\u00e8glement dans le d\u00e9lai l\u00e9gal. La solution est classique et conforme \u00e0 la lettre de l\u2019article 24 de la loi du 6 juillet 1989.<\/p>\n<p>Sur le rejet des d\u00e9lais de paiement et de la suspension des effets de la clause.<\/p>\n<p>Le juge a ensuite examin\u00e9 la demande de d\u00e9lais form\u00e9e par le locataire. Il a estim\u00e9 que ses revenus ne lui permettaient pas d\u2019assumer le paiement du loyer courant ni d\u2019envisager un plan d\u2019apurement. Le tribunal a soulign\u00e9 que \u201cle paiement du dernier loyer courant n\u2019a pas \u00e9t\u00e9 repris\u201d (Motifs, point 1.2) pour justifier son refus.<\/p>\n<p>Cette position illustre la condition cumulative pos\u00e9e par la loi : le locataire doit non seulement \u00eatre en mesure de r\u00e9gler sa dette, mais aussi avoir repris le versement int\u00e9gral du loyer courant avant l\u2019audience. En l\u2019absence de cette reprise, le juge ne peut suspendre les effets de la clause r\u00e9solutoire. La d\u00e9cision est d\u2019une grande rigueur et \u00e9carte toute cl\u00e9mence face \u00e0 une situation financi\u00e8re ob\u00e9r\u00e9e.<\/p>\n<p>Sur la condamnation au paiement et les mesures d\u2019expulsion.<\/p>\n<p>Le tribunal a condamn\u00e9 le locataire \u00e0 payer la somme de 17 629,23 euros, correspondant \u00e0 l\u2019arri\u00e9r\u00e9 locatif arr\u00eat\u00e9 au 3 novembre 2025. Il a \u00e9galement ordonn\u00e9 son expulsion et fix\u00e9 une indemnit\u00e9 d\u2019occupation \u00e9gale au loyer et aux charges. Enfin, il a d\u00e9bout\u00e9 la bailleresse de sa demande au titre de l\u2019article 700 du code de proc\u00e9dure civile, eu \u00e9gard \u00e0 la situation \u00e9conomique du d\u00e9fendeur.<\/p>\n<p>Cette solution t\u00e9moigne d\u2019un \u00e9quilibre entre la protection du cr\u00e9ancier et la prise en compte des difficult\u00e9s du d\u00e9biteur. Le refus d\u2019accorder des frais de proc\u00e9dure constitue une mesure de temp\u00e9rament appr\u00e9ciable.
