Une propri\u00e9taire a subi l\u2019effondrement partiel de son immeuble apr\u00e8s des infiltrations et un d\u00e9faut de drainage sur le fonds voisin. Le tribunal avait retenu la responsabilit\u00e9 du curateur de la succession vacante et de son assureur, ainsi qu\u2019une perte de chance imputable \u00e0 l\u2019assureur de la victime. La question de droit portait sur l\u2019engagement de la responsabilit\u00e9 du fait des choses et l\u2019indemnisation des pr\u00e9judices. La cour a confirm\u00e9 la responsabilit\u00e9 du curateur et de son assureur, tout en r\u00e9\u00e9valuant certains postes de pr\u00e9judice.<\/p>\n<p>La confirmation de la responsabilit\u00e9 du gardien de l\u2019immeuble \u00e0 l\u2019origine du sinistre.<\/p>\n<p>Le curateur de la succession vacante et son assureur contestaient leur responsabilit\u00e9, invoquant un ruissellement d\u2019eau pluviale et non le remblai. La cour \u00e9carte cette argumentation en se fondant sur les rapports d\u2019expertise. Elle retient que le sinistre trouve son origine dans le remblai de la cave, lequel \u201cen l\u2019absence de drainage, a permis la pouss\u00e9e hydrostatique des terres sur le mur\u201d (Motifs). Cette analyse confirme le lien causal entre la chose gard\u00e9e et le dommage.<\/p>\n<p>La cour rejette l\u2019application de la servitude d\u2019\u00e9coulement des eaux, car le remblai a contrari\u00e9 la circulation naturelle des eaux. Elle \u00e9carte \u00e9galement la prescription trentenaire pour l\u2019acquisition d\u2019une servitude, le remblai n\u2019\u00e9tant ni continu ni apparent. Ainsi, le curateur engage sa responsabilit\u00e9 sur le fondement de l\u2019article 1242 du code civil, en tant que gardien de l\u2019immeuble. Cette solution est conforme \u00e0 la mission d\u2019entretien et de r\u00e9paration qui lui incombait.<\/p>\n<p>La cour pr\u00e9cise la port\u00e9e de cette responsabilit\u00e9 en \u00e9cartant l\u2019existence d\u2019un cas de force majeure. L\u2019\u00e9pisode c\u00e9venol invoqu\u00e9 ne constitue pas \u201cun \u00e9v\u00e9nement totalement impr\u00e9visible et irr\u00e9sistible\u201d dans la r\u00e9gion (Motifs). De plus, aucune faute de la victime n\u2019est retenue, le mur mitoyen n\u2019\u00e9tant pas \u00e0 l\u2019origine du sinistre. La responsabilit\u00e9 du curateur et de son assureur est donc d\u00e9finitivement \u00e9tablie.<\/p>\n<p>L\u2019\u00e9valuation des pr\u00e9judices et la limitation de la perte de chance imputable \u00e0 l\u2019assureur de la victime.<\/p>\n<p>La cour \u00e9carte d\u2019abord le moyen d\u2019irrecevabilit\u00e9 des demandes de la propri\u00e9taire, fond\u00e9 sur une proc\u00e9dure d\u2019expropriation en cours. Elle rappelle qu\u2019\u201caucun transfert de propri\u00e9t\u00e9 n\u2019est intervenu\u201d et que la victime conserve qualit\u00e9 et int\u00e9r\u00eat \u00e0 agir (Motifs). Elle rejette \u00e9galement la limitation de l\u2019indemnisation \u00e0 l\u2019actif net de la succession, faute de preuve, et \u00e0 la valeur de remplacement de l\u2019immeuble. La r\u00e9paration int\u00e9grale du pr\u00e9judice est affirm\u00e9e.<\/p>\n<p>Sur le pr\u00e9judice mat\u00e9riel, la cour confirme les sommes allou\u00e9es pour les travaux de reprise et d\u2019\u00e9quipement int\u00e9rieur, tout en pr\u00e9cisant leur indexation. Elle condamne in solidum le curateur et son assureur \u00e0 payer des sommes suppl\u00e9mentaires pour la mise en s\u00e9curit\u00e9 de la porte et l\u2019assurance dommage-ouvrage. Pour le pr\u00e9judice immat\u00e9riel, elle r\u00e9\u00e9value la perte de mobilier \u00e0 une somme forfaitaire de 100 000 euros, faute de justificatifs suffisants. Le pr\u00e9judice de jouissance est fix\u00e9 \u00e0 53 900 euros sur la base de la valeur locative.<\/p>\n<p>Enfin, la cour confirme la responsabilit\u00e9 de l\u2019assureur de la victime pour n\u00e9gligence fautive dans la gestion du sinistre. Elle retient une perte de chance de b\u00e9n\u00e9ficier d\u2019une expertise judiciaire qui aurait pu \u00e9viter l\u2019effondrement. Cette perte de chance est \u00e9valu\u00e9e \u00e0 15 000 euros, sans lien de causalit\u00e9 direct avec le dommage.
