L&#8217;actualit\u00e9 sociale du 6 mai 2026 donne un angle utile : la Cour de cassation a jug\u00e9, dans une affaire publi\u00e9e au Bulletin, qu&#8217;une indemnit\u00e9 de r\u00e9cup\u00e9ration li\u00e9e \u00e0 des interventions pendant l&#8217;astreinte constituait un \u00e9l\u00e9ment de salaire.<\/p>\n<p>La demande Google existe, m\u00eame si elle est de niche : le Keyword Planner remonte 210 recherches mensuelles sur &#8220;prime d astreinte&#8221;, 170 sur &#8220;prime astreinte&#8221;, 40 sur &#8220;astreinte salaire&#8221;, 40 sur &#8220;heures astreinte&#8221; et 20 sur &#8220;astreinte non pay\u00e9e&#8221;. L&#8217;intention est financi\u00e8re et actionnable : le salari\u00e9 veut savoir si l&#8217;employeur doit payer, majorer, r\u00e9cup\u00e9rer, int\u00e9grer l&#8217;indemnit\u00e9 dans le salaire de r\u00e9f\u00e9rence ou r\u00e9gulariser les bulletins de paie.<\/p>\n<p>La r\u00e9ponse courte est la suivante : une astreinte doit donner lieu \u00e0 une compensation, financi\u00e8re ou sous forme de repos, selon les r\u00e8gles applicables dans l&#8217;entreprise. Si le salari\u00e9 intervient pendant l&#8217;astreinte, le temps d&#8217;intervention est du temps de travail effectif. Et lorsque l&#8217;accord collectif pr\u00e9voit une indemnit\u00e9 de r\u00e9cup\u00e9ration li\u00e9e \u00e0 ces interventions, cette indemnit\u00e9 peut constituer un \u00e9l\u00e9ment de salaire. L&#8217;accord pr\u00e9voyait que lorsqu&#8217;un salari\u00e9 d&#8217;astreinte effectuait une ou plusieurs interventions, il b\u00e9n\u00e9ficiait d&#8217;une compensation globale et forfaitaire sous forme d&#8217;heures de r\u00e9cup\u00e9ration.<\/p>\n<p>La Cour retient que cette indemnit\u00e9 de r\u00e9cup\u00e9ration constitue un \u00e9l\u00e9ment de salaire. Cette pr\u00e9cision compte pour plusieurs raisons : elle peut influencer le bulletin de paie, le salaire de r\u00e9f\u00e9rence, le calcul de certaines indemnit\u00e9s et les demandes de rappel lorsque l&#8217;employeur a trait\u00e9 l&#8217;astreinte comme une simple organisation interne sans valeur salariale.<\/p>\n<p>L&#8217;arr\u00eat ne signifie pas que toutes les astreintes donnent automatiquement droit \u00e0 la m\u00eame somme. Il rappelle surtout qu&#8217;il faut lire l&#8217;accord applicable et qualifier juridiquement la compensation. Une prime, une indemnit\u00e9 ou un repos li\u00e9 \u00e0 l&#8217;astreinte ne doit pas \u00eatre \u00e9cart\u00e9 du salaire de r\u00e9f\u00e9rence sans analyse.<\/p>\n<h2>Astreinte ou temps de travail effectif<\/h2>\n<p>L&#8217;astreinte n&#8217;est pas exactement du travail effectif pendant toute sa dur\u00e9e. Le salari\u00e9 n&#8217;est pas forc\u00e9ment au poste de travail, mais il doit rester disponible pour intervenir si l&#8217;entreprise le demande. En revanche, le temps d&#8217;intervention pendant l&#8217;astreinte est du temps de travail effectif.<\/p>\n<p>Cette distinction change tout. Un salari\u00e9 peut \u00eatre d&#8217;astreinte de 20 heures \u00e0 8 heures, sans travailler r\u00e9ellement pendant toute la nuit. Mais s&#8217;il r\u00e9pond \u00e0 des appels, se connecte \u00e0 un serveur, se d\u00e9place, d\u00e9panne un client, r\u00e9dige un compte rendu ou traite une urgence, les p\u00e9riodes d&#8217;intervention doivent \u00eatre identifi\u00e9es.<\/p>\n<p>Le litige na\u00eet souvent lorsque l&#8217;employeur m\u00e9lange tout : astreinte non compens\u00e9e, interventions non compt\u00e9es, temps de trajet ignor\u00e9, r\u00e9cup\u00e9ration promise mais jamais prise, prime forfaitaire trop basse ou bulletin de paie incompr\u00e9hensible.<\/p>\n<h2>Quels documents v\u00e9rifier<\/h2>\n<p>Avant de r\u00e9clamer, il faut rassembler les textes et les preuves. Les documents utiles sont :<\/p>\n<ul>\n<li>le contrat de travail ;<\/li>\n<li>les avenants sur les astreintes ;<\/li>\n<li>l&#8217;accord d&#8217;entreprise ou la convention collective ;<\/li>\n<li>les plannings d&#8217;astreinte ;<\/li>\n<li>les relev\u00e9s d&#8217;appels, tickets, alertes, interventions ou connexions ;<\/li>\n<li>les mails ou messages demandant une disponibilit\u00e9 ;<\/li>\n<li>les bulletins de paie ;<\/li>\n<li>les compteurs de r\u00e9cup\u00e9ration ;<\/li>\n<li>les demandes de repos refus\u00e9es ;<\/li>\n<li>les \u00e9changes RH sur la prime ou la r\u00e9cup\u00e9ration.<\/li>\n<\/ul>\n<p>Le salari\u00e9 doit aussi reconstruire une chronologie simple : dates d&#8217;astreinte, horaires, interventions, dur\u00e9e, compensation pr\u00e9vue, compensation r\u00e9ellement accord\u00e9e. Un tableau mensuel est souvent plus efficace qu&#8217;un long r\u00e9cit.<\/p>\n<h2>Prime d&#8217;astreinte, repos ou r\u00e9cup\u00e9ration : que r\u00e9clamer<\/h2>\n<p>La r\u00e9clamation d\u00e9pend du syst\u00e8me applicable. Certaines entreprises paient une prime d&#8217;astreinte. D&#8217;autres accordent un repos. D&#8217;autres distinguent la disponibilit\u00e9, l&#8217;intervention, le d\u00e9placement et la r\u00e9cup\u00e9ration.<\/p>\n<p>Si la prime d&#8217;astreinte n&#8217;est pas vers\u00e9e, le salari\u00e9 peut demander un rappel. Si les interventions ne sont pas compt\u00e9es comme temps de travail effectif, il peut demander leur paiement, avec \u00e9ventuellement les majorations d&#8217;heures suppl\u00e9mentaires si les seuils sont d\u00e9pass\u00e9s. Si un repos de r\u00e9cup\u00e9ration \u00e9tait pr\u00e9vu mais jamais accord\u00e9, il faut v\u00e9rifier si une compensation financi\u00e8re peut \u00eatre demand\u00e9e.<\/p>\n<p>L&#8217;arr\u00eat du 6 mai 2026 invite \u00e0 ne pas n\u00e9gliger les indemnit\u00e9s de r\u00e9cup\u00e9ration. Le salari\u00e9 peut produire ses plannings, tickets d&#8217;intervention, captures d&#8217;alertes, historiques d&#8217;appels, journaux de connexion, mails, messages Teams ou Slack, comptes rendus et bulletins de paie.<\/p>\n<p>Il faut distinguer deux niveaux. Le premier niveau est la disponibilit\u00e9 : le salari\u00e9 \u00e9tait officiellement d&#8217;astreinte. Le second niveau est l&#8217;intervention : il a effectivement travaill\u00e9 pendant l&#8217;astreinte. Les deux doivent \u00eatre trac\u00e9s s\u00e9par\u00e9ment.<\/p>\n<p>Un simple message &#8220;j&#8217;\u00e9tais d&#8217;astreinte tout le week-end&#8221; ne suffit pas toujours pour chiffrer. Il faut montrer quand l&#8217;intervention a commenc\u00e9, quand elle s&#8217;est termin\u00e9e, quelle t\u00e2che a \u00e9t\u00e9 r\u00e9alis\u00e9e, et si l&#8217;employeur en avait connaissance.<\/p>\n<p>Si l&#8217;entreprise utilise un outil informatique, les logs peuvent \u00eatre d\u00e9cisifs. Mais il faut rester proportionn\u00e9 : le salari\u00e9 doit conserver les \u00e9l\u00e9ments n\u00e9cessaires \u00e0 sa d\u00e9fense, sans extraire de donn\u00e9es clients ou confidentielles inutiles au litige.<\/p>\n<h2>Que faire si l&#8217;employeur refuse de payer<\/h2>\n<p>La premi\u00e8re \u00e9tape consiste \u00e0 demander une r\u00e9gularisation \u00e9crite. La demande doit viser les p\u00e9riodes, les bulletins concern\u00e9s, les astreintes, les interventions et le texte applicable. Les litiges apparaissent fr\u00e9quemment lorsque l&#8217;entreprise banalise la disponibilit\u00e9 permanente.<\/p>\n<p>Un salari\u00e9 \u00e0 Paris, Nanterre, Bobigny, Cr\u00e9teil, Versailles, Saint-Denis, Courbevoie, Boulogne-Billancourt ou Issy-les-Moulineaux doit pr\u00e9parer le dossier en tenant compte du lieu de travail, de l&#8217;\u00e9tablissement et du conseil de prud&#8217;hommes comp\u00e9tent.
