{"id":1045332,"date":"2026-06-03T22:33:57","date_gmt":"2026-06-03T20:33:57","guid":{"rendered":"https:\/\/kohenavocats.com\/jurisprudences\/cour-supreme-du-senegal-chambre-sociale-arret-n-13-du-24-mars-2021\/"},"modified":"2026-06-03T22:33:57","modified_gmt":"2026-06-03T20:33:57","slug":"cour-supreme-du-senegal-chambre-sociale-arret-n-13-du-24-mars-2021","status":"publish","type":"kji_decision","link":"https:\/\/kohenavocats.com\/en\/jurisprudences\/cour-supreme-du-senegal-chambre-sociale-arret-n-13-du-24-mars-2021\/","title":{"rendered":"Cour supr\u00eame du S\u00e9n\u00e9gal, Chambre sociale, arr\u00eat n\u00b0 13 du 24 MARS 2021"},"content":{"rendered":"<div class=\"kji-decision\">\n<div class=\"kji-full-text\">\n<p>ARR\u00caT N\u00b0 13 DU 24 MARS 2021<\/p>\n<p>&#8211; LA SOCI\u00c9T\u00c9 INDUSTRIES ALIMENTAIRES S\u00c9N\u00c9GALAISES SA DITE INASEN SA c\/ &#8211; CHEIKH TIDIANE BADJI<\/p>\n<p>CONTRAT DE TRAVAIL \u2013 RUPTURE \u2013 LICENCIEMENT \u2013 MOTIF L\u00c9GI- TIME \u2013 APPLICATIONS DIVERSES<\/p>\n<p>Constitue un licenciement abusif, la rupture, par l\u2019employeur, des relations de travail pour \u00e9ch\u00e9ance du terme d\u2019un troisi\u00e8me contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e (CDD) conclu sur la base d\u2019un agr\u00e9ment, lorsque le travailleur avait d\u00e9j\u00e0 ex\u00e9cut\u00e9 deux CDD avant ledit agr\u00e9ment.<\/p>\n<p>La Cour supr\u00eame<\/p>\n<p>Vu les moyens annex\u00e9s ;<\/p>\n<p>Vu la loi organique n\u00b0 2017-09 du 17 janvier 2017 sur la Cour supr\u00eame ;<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Sur le moyen unique, en ses premi\u00e8re et seconde branches r\u00e9unies ;<\/p>\n<p>Attendu, selon l\u2019arr\u00eat attaqu\u00e9 (Dakar, 11 f\u00e9vrier 2020, n\u00b0 98), que Cheikh Tidiane BADJI a \u00e9t\u00e9 engag\u00e9 par la soci\u00e9t\u00e9 Industries alimentaires s\u00e9n\u00e9galaises, dite INASEN, en qualit\u00e9 d\u2019ouvrier, suivant plusieurs contrats de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e ; que la soci\u00e9t\u00e9 INASEN, invoquant l\u2019arriv\u00e9 du terme fix\u00e9 au 31 mars 2017 du dernier contrat, lui a pay\u00e9 une indemnit\u00e9 de fin de contrat et remis un certificat de travail ; que Cheikh Tidiane BADJI l\u2019a attraite devant le tribunal du travail pour licenciement abusif et paiement de diverses indemnit\u00e9s ;<\/p>\n<p>Attendu qu\u2019ayant relev\u00e9 que le dernier agr\u00e9ment n\u00b0 00112777 du 29 octobre 2015, sur le fondement duquel la soci\u00e9t\u00e9 INASEN a rompu le contrat le liant \u00e0 Cheikh Tidiane BADJI, a \u00e9t\u00e9 accord\u00e9 alors que les parties avaient ant\u00e9rieurement conclu plus de deux contrats, puis retenu que cet agr\u00e9ment ne saurait faire perdre \u00e0 Cheikh Tidiane BADJI, le b\u00e9n\u00e9fice d\u2019un contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e acquis, en application de l\u2019article L.42 du code du travail, d\u00e8s le troisi\u00e8me contrat conclu le 1 er octobre 2015, la cour d\u2019Appel qui en a d\u00e9duit, que la rupture du contrat de travail, intervenue \u00e0 l\u2019initiative de la soci\u00e9t\u00e9 INASEN pour \u00e9ch\u00e9ance du terme, constitue un licenciement abusif, a fait l\u2019exacte application de la loi ;<\/p>\n<p>Par ces motifs :<\/p>\n<p>Rejette le pourvoi form\u00e9 par la soci\u00e9t\u00e9 Industries Alimentaires S\u00e9n\u00e9galaises SA, dite INASEN SA, contre l\u2019arr\u00eat n\u00b0 98 du 11 f\u00e9vrier 2020 de la cour d\u2019Appel de Dakar.<\/p>\n<p>Ainsi fait, jug\u00e9 et prononc\u00e9 par la chambre sociale de la Cour supr\u00eame, en son audience publique tenue les jour, mois et an que dessus et o\u00f9 \u00e9taient pr\u00e9sents Messieurs :<\/p>\n<p>PR\u00c9SIDENT : Jean Louis Paul TOUPANE ; CONSEILLERS : Waly FAYE, Amadou Lamine BATHILY, Idrissa SOW et Kor S\u00c8NE ; AVOCAT G\u00c9N\u00c9RAL : Amadou Mbaye GUISS\u00c9 ; AVOCATS : SCP LO, KAMARA et DIOUF ; GREFFIER : Ma\u00eetre Cheikh DIOP.<\/p>\n<\/div>\n<hr class=\"kji-sep\" \/>\n<p class=\"kji-source-links\"><strong>Sources officielles :<\/strong> <a class=\"kji-source-link\" href=\"https:\/\/www.coursupreme.gouv.sn\/sites\/default\/files\/2023-02\/BulletinDesArretsChambreSocial2021.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">consulter la page source<\/a> &middot; <a class=\"kji-pdf-link\" href=\"https:\/\/www.coursupreme.gouv.sn\/sites\/default\/files\/2023-02\/BulletinDesArretsChambreSocial2021.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">PDF officiel<\/a><\/p>\n<p class=\"kji-license-note\"><em>Cour supreme du Senegal, bulletins officiels.
