ASSOCI\u00c9S) c\/ DIABEL TOUR\u00c9 SAKHO<\/p>\n<p>CONTRAT DE TRAVAIL \u2013 RUPTURE \u2013 LICENCIEMENT \u2013 MOTIF L\u00c9GI- TIME \u2013 FAUTE \u2013 FAUTE L\u00c9G\u00c8RE \u2013 OFFICE DU JUGE \u2013 CONTR\u00d4LE DE PROPORTIONNALIT\u00c9 \u2013 NON<\/p>\n<p>Selon l\u2019article 119 du COCC, la faute est un manquement \u00e0 une obligation pr\u00e9existante de quelque nature qu\u2019elle soit.<\/p>\n<p>Au sens des articles L 51 et L 56 du code du travail un licenciement, fond\u00e9 sur un motif l\u00e9gitime, n\u2019est pas abusif.<\/p>\n<p>A viol\u00e9 ces textes, une cour d\u2019Appel qui a d\u00e9clar\u00e9 un licenciement abusif au motif que le travailleur, qui a commis une faute l\u00e9g\u00e8re, ne m\u00e9ritait pas un licenciement au regard de son anciennet\u00e9, des \u00e9chelons gravis et des fonctions occup\u00e9es sans avoir encouru une quelconque sanction, alors que toute faute constitue un motif l\u00e9gitime de licencie- ment.<\/p>\n<p>Vu la loi organique n\u00b0 2017-09 du 17 janvier 2017 sur la Cour supr\u00eame ;<\/p>\n<p>La Cour supr\u00eame,<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Attendu que Diabel T OUR\u00c9 SAKHO conteste la recevabilit\u00e9 du pourvoi aux motifs que d\u2019une part, l\u2019h\u00f4tel King Fahd a re\u00e7u le 7 juin 2019 une correspondance \u00e0 laquelle \u00e9tait jointe la d\u00e9cision attaqu\u00e9e et, d\u2019autre part, l\u2019action est \u00e9teinte, l\u2019h\u00f4tel King Fahd Palace ayant acquiesc\u00e9 \u00e0 l\u2019arr\u00eat attaqu\u00e9 en entamant son ex\u00e9cution ;<\/p>\n<p>Attendu que la lettre du 7 juin 2019, accompagn\u00e9e d\u2019un d\u00e9compte des int\u00e9r\u00eats de droit, a \u00e9t\u00e9 envoy\u00e9e aux conseils, en appel, de l\u2019h\u00f4tel King Fahd ; qu\u2019il ne r\u00e9sulte pas des pi\u00e8ces de la proc\u00e9dure que l\u2019arr\u00eat ait \u00e9t\u00e9 notifi\u00e9 \u00e0 l\u2019h\u00f4tel King Fahd Palace ;<\/p>\n<p>Et attendu que le paiement d\u2019une somme au titre de l\u2019ex\u00e9cution partielle d\u2019une d\u00e9ci- sion ex\u00e9cutoire dont la preuve de la notification n\u2019est pas rapport\u00e9e, ne fait pas obstacle \u00e0 l\u2019exercice d\u2019un pourvoi ;<\/p>\n<p>Qu\u2019il s\u2019ensuit que le pourvoi est recevable ;<\/p>\n<p>Attendu, selon l\u2019arr\u00eat attaqu\u00e9, que Diabel T OUR\u00c9 SAKHO, responsable des espaces pu- blics de l\u2019h\u00f4tel King Fahd, licenci\u00e9e pour violation des \u00ab proc\u00e9dures et standards \u00bb, a attrait son employeur devant le tribunal du travail pour l\u2019entendre d\u00e9clarer son licen- ciement abusif et condamner l\u2019h\u00f4tel au paiement de diverses indemnit\u00e9s ;<\/p>\n<p>Bulletin des Arr\u00eats n os 21-22<\/p>\n<p>186 Chambre sociale<\/p>\n<p>Sur le moyen soulev\u00e9 d\u2019office, en application de l\u2019article 73-4 de la loi orga- nique susvis\u00e9e, et tir\u00e9 de la violation des articles 119 du code des obliga- tions civiles et commerciales (COCC), L 51 et L 56 du code du travail ;<\/p>\n<p>Vu les articles 119 du COCC, L 51 et L 56 du code du travail ;<\/p>\n<p>Attendu, selon ces textes, que la faute est un manquement \u00e0 une obligation pr\u00e9exis- tante de quelque nature qu\u2019elle soit et, qu\u2019un licenciement, fond\u00e9 sur un motif l\u00e9gitime, n\u2019est pas abusif ;<\/p>\n<p>Attendu que pour d\u00e9clarer le licenciement abusif, l\u2019arr\u00eat rel\u00e8ve qu\u2019en se permettant de rappeler au pr\u00e9sident de la R\u00e9publique les services qu\u2019elle avait accomplis en sa fa- veur alors qu\u2019il \u00e9tait directeur de P \u00c9TROSEN, Diabel TOUR\u00c9 SAKHO a viol\u00e9 l\u2019obligation de r\u00e9serve qui pesait sur elle en vertu du r\u00e8glement int\u00e9rieur, puis \u00e9nonce que \u00ab dans l\u2019expos\u00e9 des motifs de la loi n\u00b0 97-17 du 1 er d\u00e9cembre 1997 portant code du travail, le l\u00e9gislateur s\u2019est express\u00e9ment r\u00e9f\u00e9r\u00e9 \u00e0 la notion de cause r\u00e9elle et s\u00e9rieuse ce qui per- met au juge de contr\u00f4ler la proportionnalit\u00e9 de la sanction \u00e0 la faute du salari\u00e9 (\u2026) no- nobstant les dispositions de l\u2019article 16 de la convention collective qui ne peuvent ex- clure le contr\u00f4le de proportionnalit\u00e9 au risque de transformer le pouvoir discr\u00e9tion- naire de l\u2019employeur dans le choix de la sanction en pouvoir arbitraire \u00bb, et retient que la dame S AKHO a commis une faute l\u00e9g\u00e8re qui toutefois, ne m\u00e9ritait pas un licenciement au regard de l\u2019anciennet\u00e9 de 18 ans 7 mois acquise, des \u00e9chelons gravis et des fonctions qu\u2019elle a occup\u00e9es sans avoir encouru une quelconque sanction ;<\/p>\n<p>Qu\u2019en statuant ainsi, alors que toute faute constitue un motif l\u00e9gitime de licencie- ment, cour d\u2019Appel a viol\u00e9 les textes susvis\u00e9s ;<\/p>\n<p>Par ces motifs :<\/p>\n<p>Et sans qu\u2019il soit besoin d\u2019examiner les moyens du pourvoi :<\/p>\n<p>-casse et annule l\u2019arr\u00eat n\u00b0 297 du 7 mai 2017 de cour d\u2019Appel de Dakar ;<\/p>\n<p>-renvoie la cause et les parties devant cour d\u2019Appel de Saint Louis.<\/p>\n<p>Ainsi fait, jug\u00e9 et prononc\u00e9 par la chambre sociale de la Cour supr\u00eame, en son au- dience publique ordinaire tenue les jour, mois et an ci-dessus et \u00e0 laquelle ont si\u00e9g\u00e9 Messieurs :<\/p>\n<p>PR\u00c9SIDENT DE CHAMBRE : JEAN LOUIS PAUL TOUPANE ;
