ASSOCI\u00c9S) c\/ VIVO ENERGY (MA\u00ceTRE FRAN\u00c7OIS SARR &amp; ASSOCI\u00c9S)<\/p>\n<p>CONTRAT DE TRAVAIL \u2013 RUPTURE \u2013 D\u00c9MISSION \u2013 CONDITIONS \u2013 TERMES NON \u00c9QUIVOQUES \u2013 OUI<\/p>\n<p>Ayant relev\u00e9 que la d\u00e9cision de supprimer le \u00ab cluster \u00bb qui regroupait plusieurs pays, sans r\u00e9duire les avantages acquis du travailleur, ne saurait \u00eatre qualifi\u00e9e de modifica- tion substantielle, le travailleur conservant tous les avantages li\u00e9s \u00e0 son classement cat\u00e9goriel d\u2019autant plus que ladite suppression n\u2019est pas une mesure individuelle le visant personnellement, puis que la suppression du \u00ab cluster \u00bb a \u00e9t\u00e9 notifi\u00e9e au tra- vailleur le 7 janvier 2009, qui par lettre en date du 16 octobre 2009, soit pr\u00e8s de neuf mois apr\u00e8s, a notifi\u00e9 \u00e0 son employeur sa d\u00e9mission en des termes non \u00e9quivoques, la cour d\u2019Appel, qui en a d\u00e9duit que la cessation des relations de travail est cons\u00e9cutive \u00e0 une d\u00e9mission, a l\u00e9galement justifi\u00e9 sa d\u00e9cision.<\/p>\n<p>La Cour supr\u00eame,<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Attendu, selon l\u2019arr\u00eat attaqu\u00e9 ( Thi\u00e8s, 1 er ao\u00fbt 2018, n\u00b0 12), que El Hadji Abdoul Ha- mid Faye, employ\u00e9 de Shell S\u00e9n\u00e9gal depuis le 04 mai 1998 en qualit\u00e9 de cadre techni- cien, y a occup\u00e9 plusieurs fonctions dont en dernier, celle de Distribution Engineering Manager S\u00e9n\u00e9gal du \u00ab cluster \u00bb S\u00e9n\u00e9gal, Gambie, Mali, Guin\u00e9e, class\u00e9e \u00e0 la cat\u00e9gorie JG4 ; qu\u2019\u00e0 la suite d\u2019une r\u00e9organisation interne qui a \u00e9clat\u00e9 le \u00ab cluster \u00bb S\u00e9n\u00e9gal en deux entit\u00e9s, S\u00e9n\u00e9gal, d\u2019une part et, Mali et Guin\u00e9e, d\u2019autre part, il a \u00e9t\u00e9 nomm\u00e9 au poste d\u2019Engineering Manager Shell S\u00e9n\u00e9gal, rattach\u00e9 au Distribution Manager S\u00e9n\u00e9gal ; que n\u2019ayant pas accept\u00e9 ce changement de poste qu\u2019il a assimil\u00e9 \u00e0 une r\u00e9trogradation et qualifi\u00e9 d\u2019une modification substantielle de son contrat de travail sans son accord, il a saisi le tribunal du travail pour rupture abusive des relations de travail ;<\/p>\n<p>Sur le premier moyen ;<\/p>\n<p>Attendu que l\u2019arr\u00eat de la Cour supr\u00eame qui a cass\u00e9, en toutes ses dispositions, la d\u00e9ci- sion de cour d\u2019Appel de Dakar, a replac\u00e9, en vertu de l\u2019article 56-5 de la loi organique susvis\u00e9e, les parties dans l\u2019\u00e9tat o\u00f9 elles se trouvaient avant la d\u00e9cision cass\u00e9e ; que c\u2019est \u00e0 bon droit, que cour d\u2019Appel de renvoi, tirant les cons\u00e9quences de l\u2019arr\u00eat de la Cour supr\u00eame, s\u2019est prononc\u00e9e sur la rupture de la relation de travail ;<\/p>\n<p>Sur les deuxi\u00e8me, troisi\u00e8me et quatri\u00e8me moyens, r\u00e9unis ;<\/p>\n<p>Attendu que pour d\u00e9clarer que la cessation des relations de travail est cons\u00e9cutive \u00e0 une d\u00e9mission, l\u2019arr\u00eat rel\u00e8ve et retient que \u00ab le travailleur dans ses conclusions du 24 janvier 2017, reconnait que son salaire n\u2019a pas \u00e9t\u00e9 r\u00e9duit ; il est d\u00e8s lors \u00e9vident<\/p>\n<p>Bulletin des Arr\u00eats n os 21-22<\/p>\n<p>184 Chambre sociale<\/p>\n<p>qu\u2019aucun de ses avantages n\u2019a \u00e9t\u00e9 r\u00e9duit (\u2026) ; que le travailleur n\u2019ayant (produit) au- cune preuve de ladite r\u00e9duction se borne tout simplement \u00e0 de simples d\u00e9n\u00e9gations non \u00e9tay\u00e9es par des \u00e9l\u00e9ments de preuve (\u2026) ;que la d\u00e9cision de supprimer le \u00ab cluster \u00bb qui regroupait plusieurs pays, sans r\u00e9duire les avantages acquis du sieur Faye, ne saurait nullement \u00eatre qualifi\u00e9e de modification substantielle, le travailleur conservant tous les avantages li\u00e9s \u00e0 son classement cat\u00e9goriel d\u2019autant plus que ladite suppression n\u2019est pas une mesure individuelle visant le sieur Faye ; (\u2026) que la suppression du \u00ab cluster \u00bb re- groupant plusieurs pays a \u00e9t\u00e9 notifi\u00e9e au sieur Faye le 07 janvier 2009, qui par lettre en date du 16 octobre 2009, soit pr\u00e8s de neuf mois apr\u00e8s, a notifi\u00e9 \u00e0 son employeur sa d\u00e9- mission en des termes non \u00e9quivoques \u00bb ;<\/p>\n<p>Qu\u2019en l\u2019\u00e9tat de ses constatations, elle a, sans d\u00e9naturation, l\u00e9galement justifi\u00e9 sa d\u00e9ci- sion et fait l\u2019exacte application de la loi ;<\/p>\n<p>Par ces motifs :<\/p>\n<p>Rejette le pourvoi.<\/p>\n<p>Ainsi fait, jug\u00e9 et prononc\u00e9 par la chambre sociale de la Cour supr\u00eame, en son audience publique ordinaire tenue les jour, mois et an ci-dessus et \u00e0 laquelle ont si\u00e9g\u00e9 Mes- sieurs :<\/p>\n<p>PR\u00c9SIDENT DE CHAMBRE : JEAN LOUIS PAUL TOUPANE ;
