Ne satisfait pas aux formalit\u00e9s dudit texte, l\u2019arr\u00eat minist\u00e9riel qui prononce une r\u00e9siliation alors que le d\u00e9faut de mise en valeur constat\u00e9 est consti tutif au fait de tiers.<\/p>\n<p>La Cour supr\u00eame,<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Consid\u00e9rant que, par acte administratif du 28 avril 2010, approuv\u00e9 le 18 mai 2010, l\u2019\u00c9tat du S\u00e9n\u00e9gal repr\u00e9sent\u00e9 par le gouverneur de la r\u00e9gion de Dakar, a consenti \u00e0 la soci\u00e9t\u00e9 Saudi Binladen Group un bail sur une parcelle de terrain \u00e0 usage industriel, sise \u00e0 Sebikotane, d\u2019une superficie de 99 hectares 82a 86ca, objet du TF n\u00b0 5065\/R ;<\/p>\n<p>Que par arr\u00eat\u00e9 n\u00b0 04190\/MEFP\/DGID\/DD du 23 f\u00e9vrier 2018, notifi\u00e9 le 28 f\u00e9vrier 2018, le ministre de l\u2019\u00c9conomie et des Finances a r\u00e9sili\u00e9 le bail susvis\u00e9 pour d\u00e9faut de mise en valeur de l\u2019assiette fonci\u00e8re ;<\/p>\n<p>Qu\u2019apr\u00e8s avoir introduit un recours gracieux le 1 er mars 2018, la soci\u00e9t\u00e9 requ\u00e9rante, estimant n\u2019avoir pu mettre en valeur ledit terrain du fait de l\u2019 occupation par des tiers, a form\u00e9 le pr\u00e9sent recours, articul\u00e9 autour d\u2019un moyen unique, pris d\u2019une violation de la loi, subdivis\u00e9 en deux branches ;<\/p>\n<p>Consid\u00e9rant que l\u2019\u00c9tat du S\u00e9n\u00e9gal a soulev\u00e9 l\u2019irrecevabilit\u00e9 du recours au motif qu\u2019il est dirig\u00e9 contre une d\u00e9cision de r\u00e9siliation d\u2019un bail qui constitue un acte administratif non d\u00e9tachable du contrat, donc insusceptible de recours pour exc\u00e8s de pouvoir ;<\/p>\n<p>Consid\u00e9rant que l\u2019article 139 du code des obligations de l\u2019administration ne proc\u00e8de pas \u00e0 une \u00e9num\u00e9ration exhaustive des actes d\u00e9tachables du contrat ;<\/p>\n<p>Que le bail emphyt\u00e9otique est un contrat administratif dont la r\u00e9siliation, relevant de la comp\u00e9tence du ministre, ob\u00e9it \u00e0 des conditions l\u00e9gales qui n\u2019 \u00e9chappent pas au con- tr\u00f4le du juge de l\u2019exc\u00e8s de pouvoir ;<\/p>\n<p>Qu\u2019ainsi l\u2019irrecevabilit\u00e9 n\u2019est pas encourue ;<\/p>\n<p>Sur le moyen unique en sa premi\u00e8re branche ti r\u00e9e de la violation de l\u2019article 39 de la loi n\u00b0 76-66 du 2 juillet 1976 portant code du domaine de<\/p>\n<p>Arr\u00eats de la Cour supr\u00eame \u2013 Ann\u00e9e judiciaire 2019<\/p>\n<p>Chambre administrative 165<\/p>\n<p>l\u2019\u00c9tat en ce que le ministre a pris un arr\u00eat\u00e9 de r\u00e9siliation alors qu\u2019il n\u2019a pas respect\u00e9 le pr\u00e9alable de la mise en demeure ;<\/p>\n<p>Et sans qu\u2019il soit besoin de statuer sur la seconde branche<\/p>\n<p>Consid\u00e9rant que l\u2019\u00c9tat du S\u00e9n\u00e9gal a conclu au rejet du moyen au motif que la r\u00e9silia- tion est fond\u00e9e sur le d\u00e9faut de mise en valeur du terrain et qu\u2019une lettre de mise en demeure du 26 avril 2016 a \u00e9t\u00e9 adress\u00e9e \u00e0 la soci\u00e9t\u00e9 Saudi Ben Laden Group ;<\/p>\n<p>Consid\u00e9rant que, selon les dispositions de l\u2019article 39 du texte susvis\u00e9, l\u2019administration ne peut r\u00e9silier un bail emphyt\u00e9otique sans indemnit\u00e9 que pour inex\u00e9cution par le pre- neur de ses obligations et trois mois apr\u00e8s mise en demeure par lettre recommand\u00e9e, rest\u00e9e sans effet ;<\/p>\n<p>Consid\u00e9rant qu\u2019en l\u2019esp\u00e8ce, il n\u2019est pas \u00e9tabli que l\u2019\u00c9tat du S\u00e9n\u00e9gal qui a r\u00e9sili\u00e9 sans indemnit\u00e9 pour inex\u00e9cution par le preneur de son obligation de mise en valeur, a pro- c\u00e9d\u00e9 \u00e0 la mise en demeure par lettre recommand\u00e9e rest\u00e9e sans effet, dans les d\u00e9lais l\u00e9gaux, alors surtout que le d\u00e9faut de mise en valeur est cons\u00e9cutif au fait de tiers ;<\/p>\n<p>Qu\u2019ainsi la d\u00e9cision, pour n\u2019avoir pas satisfait aux formalit\u00e9s dudit texte, encourt l\u2019annulation ;<\/p>\n<p>Par ces motifs :<\/p>\n<p>Annule l \u2019arr\u00eat\u00e9 de la d\u00e9cision n\u00b0 4190\/MEF\/DGID\/DD du 23 f\u00e9vrier 2018 du ministre de l\u2019\u00c9conomie et des Finances portant r\u00e9siliation du bail consenti \u00e0 la Soci\u00e9t\u00e9 Saudi Binladen Group, approuv\u00e9 le 18 mai 2010 ;<\/p>\n<p>Ainsi fait, jug\u00e9 et prononc\u00e9 par la chambre administrative de la Cour supr\u00eame, en son audience publique de vacations tenue les jour, mois et an que dessus et o\u00f9 \u00e9taient pr\u00e9- sents Mesdames et Messieurs :<\/p>\n<p>PR\u00c9SIDENT : ABDOULAYE NDIAYE ;
