{"id":1067046,"date":"2026-06-10T00:14:48","date_gmt":"2026-06-09T22:14:48","guid":{"rendered":"https:\/\/kohenavocats.com\/jurisprudences\/cour-supreme-du-senegal-bulletin-arret-n-37-du-26-juin-2019\/"},"modified":"2026-06-10T00:14:51","modified_gmt":"2026-06-09T22:14:51","slug":"cour-supreme-du-senegal-bulletin-arret-n-37-du-26-juin-2019","status":"publish","type":"kji_decision","link":"https:\/\/kohenavocats.com\/en\/jurisprudences\/cour-supreme-du-senegal-bulletin-arret-n-37-du-26-juin-2019\/","title":{"rendered":"Cour supr\u00eame du S\u00e9n\u00e9gal, Bulletin, arr\u00eat n\u00b0 37 du 26 JUIN 2019"},"content":{"rendered":"<div class=\"kji-decision\">\n<div class=\"kji-full-text\">\n<p>ARR\u00caT N\u00b0 37 DU 26 JUIN 2019<\/p>\n<p>MARIE LOUISE DIAGNE CORR\u00c9 A c\/ L\u2019ONG CHILD FUND S\u00c9N\u00c9GAL<\/p>\n<p>CONTRAT DE TRAVAIL, RUPTURE \u2013 LICENCIEMENT ABUSIF \u2013 ALLOCA- TION DE DOMMAGES ET INT \u00c9R\u00caTS \u2013 OBLIGATION DE TENIR CO MPTE DES CRIT\u00c8 RES L\u00c9GAUX ET DE LES CARACT \u00c9RISER EN FONCTION DE LA SITUATION DE CHAQUE TRAVAILLEUR<\/p>\n<p>N\u2019a pas l\u00e9galement justifi\u00e9 sa d\u00e9cision au regard de l\u2019article L 56 du code du travail, une cour d\u2019Appel qui a confirm\u00e9 le jugement sur les dommages et int\u00e9r\u00eats pour licencie- ment abusif, au motif que l\u2019employeur a fait perdre au travailleur des moyens financiers et l\u2019a install\u00e9 dans une situation de pr\u00e9carit\u00e9, sans pr\u00e9ciser les moyens financiers perdus ni prendre en compte, les \u00e9l\u00e9ments d\u00e9finis par la loi, en les caract\u00e9risant pour les rap- porter \u00e0 la situation individuelle de l\u2019employ\u00e9e.<\/p>\n<p>La Cour supr\u00eame ;<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Attendu, selon l\u2019arr\u00eat attaqu\u00e9, que le contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e de Marie Louise C ORR\u00c9A, employ\u00e9e de l\u2019ONG Child Fund, a \u00e9t\u00e9 rompu au motif d\u2019une r\u00e9organisa- tion interne ; que le tribunal a qualifi\u00e9 la rupture de licenciement abusif, condamn\u00e9 l\u2019ex-employeur au paiement de dommages et int\u00e9r\u00eats et d\u00e9bout\u00e9 Marie Louise C ORR\u00c9A de sa demande de dommages et int\u00e9r\u00eats pour harc\u00e8lement moral ;<\/p>\n<p>Sur les premier et deuxi\u00e8me moyens r\u00e9unis ;<\/p>\n<p>Vu l\u2019article L 56 du code du travail ;<\/p>\n<p>Attendu que la cour d\u2019Appel a confirm\u00e9 le jugement qui a retenu que l\u2019ONG Child Fund a fait perdre \u00e0 Marie Louise C ORR\u00c9A \u00ab les moyens financiers qu\u2019elle tirait de son activit\u00e9 professionnelle pour subvenir \u00e0 ses besoins ; qu\u2019en proc\u00e9dant de la sorte \u00e0 son endroit, elle l\u2019a install\u00e9e du jour au lendemain dans une situation de pr\u00e9carit\u00e9 av\u00e9r\u00e9e alors que cette derni\u00e8re, non seulement n\u2019avait commis aucune faute justifiant un tel traitement, mais avait surtout accompli au sein de l\u2019\u00e9tablissement une pr\u00e9sence effec- tive de pr\u00e8s de 28 ans \u00bb ;<\/p>\n<p>Qu\u2019en se d\u00e9terminant ainsi, sans pr\u00e9ciser les moyens financiers perdus ni prendre en compte, notamment, les \u00e9l\u00e9ments d\u00e9finis par la loi, en les caract\u00e9risant pour les rappor- ter \u00e0 la situation individuelle de l\u2019employ\u00e9e et, ainsi, \u00e9valuer l\u2019\u00e9tendue de son pr\u00e9judice, la cour d\u2019Appel n\u2019a pas l\u00e9galement justifi\u00e9 sa d\u00e9cision ;<\/p>\n<p>Sur le troisi\u00e8me moyen ;<\/p>\n<p>Vu l\u2019article 10 de la loi n\u00b0 2014-26 du 3 novembre 2014 portant organisation judiciaire, ensemble l\u2019article L 265 alin\u00e9a 5 du code du travail ;<\/p>\n<p>Arr\u00eats de la Cour supr\u00eame \u2013 Ann\u00e9e judiciaire 2019<\/p>\n<p>Chambre sociale 113<\/p>\n<p>Attendu que la cour d\u2019Appel, saisie par conclusions du 19 avril 2019 d\u2019une demande de paiement de dommages et int\u00e9r\u00eats pour harc\u00e8lement moral, ne s\u2019est pas prononc\u00e9e sur lesdites conclusions ;<\/p>\n<p>Qu\u2019en statuant ainsi, alors que d\u2019une part, tout jugement doit \u00eatre motiv\u00e9 \u00e0 peine de nullit\u00e9, le d\u00e9faut de r\u00e9ponse \u00e0 conclusions \u00e9quivalant \u00e0 un d\u00e9faut de motifs et, d\u2019autre part, l\u2019appel est jug\u00e9 sur pi\u00e8ces, la cour d\u2019Appel a m\u00e9connu le sens et la port\u00e9e des textes susvis\u00e9s ;<\/p>\n<p>Par ces motifs :<\/p>\n<p>Casse et annule, mais seulement sur les dommages et int\u00e9r\u00eats pour licenciement abusif et harc\u00e8lement moral, l\u2019arr\u00eat n\u00b0 513 du 17 ao\u00fbt 2017 de la cour d\u2019Appel de Dakar ;<\/p>\n<p>Renvoie la cause et les parties devant la cour d\u2019Appel de Saint Louis ;<\/p>\n<p>Ainsi fait, jug\u00e9 et prononc\u00e9 par la chambre sociale de la Cour supr\u00eame, en son audience publique tenue les jour, mois et an que dessus et o\u00f9 \u00e9taient pr\u00e9sents Messieurs :<\/p>\n<p>PR\u00c9SIDENT DE CHAMBRE : JEAN LOUIS PAUL TOUPANE, RAPPORTEUR : IBRAHIMA SY, CONSEILLERS : IBRAHIMA SY, AMADOU HAMADY DIALLO, AMADOU LAMINE BATHILY, KOR S\u00c8NE ;
