{"id":1092982,"date":"2026-06-14T00:22:28","date_gmt":"2026-06-13T22:22:28","guid":{"rendered":"https:\/\/kohenavocats.com\/jurisprudences\/cour-supreme-du-senegal-bulletin-arret-n-34-du-12-avril-2017\/"},"modified":"2026-06-14T00:22:28","modified_gmt":"2026-06-13T22:22:28","slug":"cour-supreme-du-senegal-bulletin-arret-n-34-du-12-avril-2017","status":"publish","type":"kji_decision","link":"https:\/\/kohenavocats.com\/en\/jurisprudences\/cour-supreme-du-senegal-bulletin-arret-n-34-du-12-avril-2017\/","title":{"rendered":"Cour supr\u00eame du S\u00e9n\u00e9gal, Bulletin, arr\u00eat n\u00b0 34 du 12 AVRIL 2017"},"content":{"rendered":"<div class=\"kji-decision\">\n<div class=\"kji-full-text\">\n<p>ARR\u00caT N\u00b034 DU 12 AVRIL 2017<\/p>\n<p>DAOUDA NDIAYE c\/ LA SOCI\u00c9T\u00c9 EGB R BADARACHI<\/p>\n<p>CONTRAT DE TRAVAIL, RUPTURE \u2013 LICENCIEMENT \u2013 MOTIF L\u00c9 GITIME \u2013 FAUTE LOURDE \u2013 CONDITIONS \u2013 D\u00c9FAUT DE RECHERCHE D\u2019INTENTION DE NUIRE \u2013 MANQUE DE BASE L \u00c9GALE<\/p>\n<p>N\u2019a pas justifi\u00e9 sa d\u00e9cision, au regard des articles L 54 et L 56 du code du travail, une cour d\u2019Appel qui a d\u00e9clar\u00e9 l\u00e9gitime pour faute lourde, le licenciement de l\u2019employ\u00e9, responsable de chantiers et tenu au respect des d\u00e9lais et de la qualit\u00e9 de l\u2019ouvrage, qui n\u2019a ex\u00e9cut\u00e9 qu\u2019une partie des travaux, obligeant ainsi l\u2019employeur \u00e0 r\u00e9aliser un ouvrage conforme \u00e0 la commande, par les soins d\u2019un autre employ\u00e9, sans rechercher en quoi les faits, relev\u00e9s \u00e0 l\u2019encontre de l\u2019employ\u00e9, r\u00e9v\u00e8lent une intention de nuire \u00e0 l\u2019employeur et sont constitutifs de faute lourde.<\/p>\n<p>La Cour supr\u00eame,<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Attendu, selon l\u2019arr\u00eat attaqu\u00e9, que la soci\u00e9t\u00e9 B ADARACHI qui a reproch\u00e9 \u00e0 son employ\u00e9 Daouda N DIAYE conducteur des travaux, plusieurs griefs, l\u2019a licenci\u00e9 pour faute grave ; que ce licenciement a \u00e9t\u00e9 qualifi\u00e9 de l\u00e9gitime pour faute lourde par la cour d\u2019Appel, qui l\u2019a d\u00e9bout\u00e9 de toutes ses demandes ;<\/p>\n<p>Sur les premier et troisi\u00e8me moyens r\u00e9unis ;<\/p>\n<p>Vu les articles L 54 et L 56 du code du travail ;<\/p>\n<p>Attendu que, pour d\u00e9clarer le licenciement l\u00e9gitime pour faute lourde, la cour d\u2019Appel a relev\u00e9 que, sur le chantier de la Rochelle qui portait sur la d\u00e9molition du mur exis- tant, la construction d\u2019un autre mur \u00e0 2 m\u00e8tres de celui d\u00e9moli, le raccordement du dal- lage existant au nouveau mur, la mise en place d\u2019une chape sur toute la surface, Daouda N DIAYE n\u2019a ex\u00e9cut\u00e9 que la chape ; que l\u2019employeur a \u00e9t\u00e9 oblig\u00e9 de proc\u00e9der par les soins de G NABALY \u00e0 un d\u00e9capage de la chape r\u00e9alis\u00e9e par N DIAYE et l\u2019ex\u00e9cution d\u2019une dalle conforme \u00e0 la commande, le client ayant du d\u00e9placer toutes ses machines dont la chape ne pouvait emp\u00eacher les vibrations ; qu\u2019en sa qualit\u00e9 de responsable de chantiers, il est tenu au respect des d\u00e9lais et de la qualit\u00e9 de l\u2019ouvrage ;<\/p>\n<p>Qu\u2019en se d\u00e9terminant ainsi, sans rechercher en quoi les faits relev\u00e9s \u00e0 l\u2019encontre de Daouda N DIAYE r\u00e9v\u00e8lent une intention de nuire \u00e0 l\u2019employeur et sont constitutifs de faute lourde, la cour d\u2019Appel n\u2019a pas justifi\u00e9 sa d\u00e9cision ;<\/p>\n<p>Par ces motifs :<\/p>\n<p>Et sans qu\u2019il y ait lieu de statuer sur le deuxi\u00e8me moyen ;<\/p>\n<p>Arr\u00eats de la Cour supr\u00eame \u2013 Ann\u00e9e judiciaire 2017<\/p>\n<p>Chambre sociale 165<\/p>\n<p>Casse et annule l\u2019arr\u00eat n\u00b0144 rendu le 22 f\u00e9vrier 2016 par la cour d\u2019Appel de Dakar ;<\/p>\n<p>Renvoie la cause et les parties devant la cour d\u2019Appel de Saint-Louis ;<\/p>\n<p>Ainsi fait, jug\u00e9 et prononc\u00e9 par la chambre sociale de la Cour supr\u00eame, en son audience publique tenue les jour, mois et an que dessus et o\u00f9 \u00e9taient pr\u00e9sents Madame et Mes- sieurs :<\/p>\n<p>PR\u00c9SIDENT, CONSEILLER DOYEN : AMADOU HAMADY DIALLO ;
