{"id":1093057,"date":"2026-06-14T00:25:42","date_gmt":"2026-06-13T22:25:42","guid":{"rendered":"https:\/\/kohenavocats.com\/jurisprudences\/cour-supreme-du-senegal-bulletin-arret-n-31-du-22-mars-2017\/"},"modified":"2026-06-14T00:25:42","modified_gmt":"2026-06-13T22:25:42","slug":"cour-supreme-du-senegal-bulletin-arret-n-31-du-22-mars-2017","status":"publish","type":"kji_decision","link":"https:\/\/kohenavocats.com\/en\/jurisprudences\/cour-supreme-du-senegal-bulletin-arret-n-31-du-22-mars-2017\/","title":{"rendered":"Cour supr\u00eame du S\u00e9n\u00e9gal, Bulletin, arr\u00eat n\u00b0 31 du 22 MARS 2017"},"content":{"rendered":"<div class=\"kji-decision\">\n<div class=\"kji-full-text\">\n<p>ARR\u00caT N\u00b031 DU 22 MARS 2017<\/p>\n<p>A\u00cfSSATOU DIAGNE SECK c\/ L\u2019ASSOCIATION INTER NATIONALE D\u00c9NOMM\u00c9E \u00ab MEDICOS DEL MUNDO \u00bb<\/p>\n<p>CONTRAT DE TRAVAIL \u2013 FORMATION \u2013 ENGAGEMENT \u00c0 L\u2019ESSAI \u2013 CONDITIONS DE RENOUVELLEMENT \u2013 INFORMATION PAR \u00c9CRIT ET ACCORD DU TRAVAILLEUR<\/p>\n<p>Selon les articles 10 du d\u00e9cret n\u00b0 63-00118 \/MFPT\/DTSSDU 19 f\u00e9vrier 1963 fixant les formes et modalit\u00e9s d\u2019\u00e9tablissement du contrat et de l\u2019engagement \u00e0 l\u2019essai et 11 alin\u00e9a 3 de la convention collective nationale interprofessionnelle, l\u2019employeur qui souhaite renouveler la p\u00e9riode d\u2019essai d\u2019un contrat de travail doit en informer le tra- vailleur par \u00e9crit, 15 jours au moins, avant la fin de la p\u00e9riode d\u2019essai et recueillir par \u00e9crit l\u2019accord du travailleur.<\/p>\n<p>A viol\u00e9 lesdits textes, la cour d\u2019Appel qui retenu que la rupture des relations de tra- vail, par l\u2019employeur, \u00e0 l\u2019issu de la p\u00e9riode d\u2019essai, ne constitue pas un licenciement, alors que celui-ci n\u2019a pas inform\u00e9 le travailleur par \u00e9crit ni obtenu son accord sur le renouvellement de l\u2019essai non susceptible de tacite reconduction.<\/p>\n<p>La Cour supr\u00eame,<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9men t \u00e0 la loi ;<\/p>\n<p>Attendu, selon l\u2019arr\u00eat attaqu\u00e9, que l\u2019association internationale Medicos del Mundo, dite Medicos del Mundo, et A\u00efssatou D IAGNE SECK ont conclu un contrat de travail d\u2019une dur\u00e9e de dix mois et quinze jours, avec une p\u00e9riode d\u2019essai de trois mois, renou- velable une fois ; qu\u2019\u00e0 la suite de la notification de la rupture du contrat, A\u00efssatou D IA- GNE SECK a saisi le tribunal du travail qui a d\u00e9clar\u00e9 que les parties \u00e9taient li\u00e9es par un contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e et qualifi\u00e9 la rupture d\u2019abusive ; que la cour d\u2019Appel a in- firm\u00e9 le jugement et dit que \u00ab le contrat rompu pendant la p\u00e9riode d\u2019essai ne constitue pas un licenciement \u00bb ;<\/p>\n<p>Sur le moyen, en sa premi\u00e8re branche ;<\/p>\n<p>Vu les articles 10 du d\u00e9cret n\u00b063-00118 du 19 f\u00e9vrier 1963 et 11 alin\u00e9a 3 de la convention collective nationale interprofessionnelle (CCNI) ;<\/p>\n<p>Attendu, selon ces textes, que d\u2019une part, le renouvellement de la p\u00e9riode d\u2019essai ne peut \u00eatre d\u00e9cid\u00e9 que par accord \u00e9crit des parties et, d\u2019autre part, l\u2019employeur qui sou- haite renouveler l\u2019essai doit en informer le travailleur par \u00e9crit, 15 jours au moins, avant la fin de la p\u00e9riode d\u2019essai lorsqu\u2019elle est de trois mois ;<\/p>\n<p>Attendu que pour retenir que la rupture ne constitue pas un licenciement, l\u2019arr\u00eat rel\u00e8ve \u00ab qu\u2019en l\u2019esp\u00e8ce, Medicos del Mundo et A\u00efssatou D IAGNE SECK ont conclu un contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e le 14 f\u00e9vrier 2011, pour une dur\u00e9e de 10 mois et 15 jours<\/p>\n<p>Arr\u00eats de la Cour supr\u00eame \u2013 Ann\u00e9e judiciaire 2017<\/p>\n<p>Chambre sociale 161<\/p>\n<p>dont une p\u00e9riode d\u2019essai de 03 mois renouvelable une fois ; (\u2026) que la relation de tra- vail a \u00e9t\u00e9 rompue \u00e0 compter du 31 juillet 2011 par lettre de notification du 15 juillet 2011, soit \u00e0 l\u2019issue de la p\u00e9riode de renouvellement de l\u2019essai\u2026\u00bb, puis \u00e9nonce \u00ab or aux termes de l\u2019article L 40 du code du travail, ce type d\u2019engagement peut cesser \u00e0 tout moment et sans pr\u00e9avis, par la volont\u00e9 des parties \u00bb ;<\/p>\n<p>Qu\u2019en statuant ainsi, alors que Medicos del Mundo n\u2019a ni inform\u00e9 A\u00efssatou D IAGNE SECK par \u00e9crit ni obtenu son accord sur le renouvellement de l\u2019essai non susceptible de tacite reconduction, la cour d\u2019Appel a viol\u00e9, par refus d\u2019application, les textes susvis\u00e9s ;<\/p>\n<p>Par ces motifs :<\/p>\n<p>Et sans qu\u2019il soit besoin de statuer sur la seconde branche du moyen :<\/p>\n<p>Casse et annule l\u2019arr\u00eat n\u00b0459 du 4 septembre 2014 de la cour d\u2019Appel de Dakar ;<\/p>\n<p>Renvoie la cause et les parties devant la cour d\u2019Appel de Thi\u00e8s ;<\/p>\n<p>Ainsi fait, jug\u00e9 et prononc\u00e9 par la chambre sociale de la Cour supr\u00eame, en son audience publique tenue les jour, mois et an que dessus et o\u00f9 \u00e9taient pr\u00e9sents Madame et Mes- sieurs :<\/p>\n<p>PR\u00c9SIDENT : JEAN LOUIS PAUL TOUPANE ;
