{"id":1093105,"date":"2026-06-14T00:27:02","date_gmt":"2026-06-13T22:27:02","guid":{"rendered":"https:\/\/kohenavocats.com\/jurisprudences\/cour-supreme-du-senegal-bulletin-arret-n-9-du-25-janvier-2017\/"},"modified":"2026-06-14T00:27:02","modified_gmt":"2026-06-13T22:27:02","slug":"cour-supreme-du-senegal-bulletin-arret-n-9-du-25-janvier-2017","status":"publish","type":"kji_decision","link":"https:\/\/kohenavocats.com\/en\/jurisprudences\/cour-supreme-du-senegal-bulletin-arret-n-9-du-25-janvier-2017\/","title":{"rendered":"Cour supr\u00eame du S\u00e9n\u00e9gal, Bulletin, arr\u00eat n\u00b0 9 du 25 JANVIER 2017"},"content":{"rendered":"<div class=\"kji-decision\">\n<div class=\"kji-full-text\">\n<p>ARR\u00caT N\u00b009 DU 25 JANVIER 2017<\/p>\n<p>PROMETRA c\/ SOURY SANGAR \u00c9<\/p>\n<p>CONTRAT DE TRAVAIL, EX\u00c9CUTION \u2013 MODIFICATION SUBSTANTIELLE DU CONTRAT \u2013 CONTINUATION DES RELATIONS DE TRAVAIL PLUS DE CINQ MOIS APR\u00c8 S LA MODIFICATION \u2013 IMPOSSIBILIT\u00c9 DE QUALIFIER D\u2019ABUSIVE LA RUPTURE<\/p>\n<p>Ne peut \u00eatre qualifi\u00e9e d\u2019abusive, la rupture des relations de travail cons\u00e9cutive \u00e0 une modification substantielle du contrat refus\u00e9e par le travailleur d\u00e8s lors que ce dernier a continu\u00e9 de travailler pendant plus de cinq mois sans contester la nouvelle situation et a d\u00e9missionn\u00e9 pour convenance personnelle, sans aucune r\u00e9f\u00e9rence \u00e0 la modification du contrat.<\/p>\n<p>La Cour supr\u00eame,<\/p>\n<p>Vu la loi organique n\u00b02008-35 du 8 ao\u00fbt 2008 sur la Cour supr\u00eame ;<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Attendu que le d\u00e9fendeur conteste la recevabilit\u00e9 du pourvoi au motif que le requ\u00e9- rant attaque un arr\u00eat du 18 d\u00e9cembre 2015, alors qu\u2019aucun arr\u00eat n\u2019a \u00e9t\u00e9 rendu entre les parties \u00e0 cette date ;<\/p>\n<p>Attendu que le pourvoi porte sur l\u2019arr\u00eat rendu le 8 d\u00e9cembre 2015 ; que la date du 18 d\u00e9cembre mentionn\u00e9e dans le pourvoi constitue une simple erreur mat\u00e9rielle ;<\/p>\n<p>D\u2019o\u00f9 il suit que l\u2019irrecevabilit\u00e9 n\u2019est pas encourue ;<\/p>\n<p>Attendu, selon l\u2019arr\u00eat attaqu\u00e9, que l\u2019ONG PROMETRA et Soury S ANGAR\u00c9 ont conclu un \u00ab contrat de prestation de service \u00e0 dur\u00e9e d\u00e9termin\u00e9e \u00bb ; que ces relations, quali- fi\u00e9es de contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e, se sont poursuivies au-del\u00e0 du terme, jusqu\u2019\u00e0 la d\u00e9mission de S ANGAR\u00c9 ;<\/p>\n<p>Sur le moyen, relev\u00e9 d\u2019office en application de l\u2019article 72-4 de la loi orga- nique sur la Cour supr\u00eame, tir\u00e9 de la violation de l\u2019article L 67 du code du travail ;<\/p>\n<p>Vu l\u2019article L67 du code du travail ;<\/p>\n<p>Attendu, selon ce texte, que le contrat de travail peut \u00eatre modifi\u00e9 \u00e0 l\u2019initiative du tra- vailleur ou de l\u2019employeur et, si la proposition de modification substantielle du contrat \u00e9mane de l\u2019employeur et que le travailleur la refuse, la rupture du contrat de travail sera consid\u00e9r\u00e9e comme r\u00e9sultant de l\u2019initiative de l\u2019employeur, ce dernier \u00e9tant d\u00e8s lors tenu de respecter les r\u00e8gles de proc\u00e9dure du licenciement ;<\/p>\n<p>Bulletin des Arr\u00eats n os 13-14<\/p>\n<p>140 Chambre sociale<\/p>\n<p>Attendu que pour d\u00e9clarer le licenciement abusif, la cour d\u2019Appel a relev\u00e9, d\u2019une part, qu\u2019\u00e0 compter de janvier 2012, la soci\u00e9t\u00e9 PROMETRA a pay\u00e9 \u00e0 S ANGAR\u00c9 la somme de 130 000 FCFA comme salaire, alors qu\u2019il percevait depuis le d\u00e9but de leurs relations de travail 250 000 F CFA et, d\u2019autre part, qu\u2019\u00e0 la date du 12 juin 2012, S ANGAR\u00c9 a formel- lement d\u00e9missionn\u00e9 puis \u00e9nonc\u00e9 \u00ab que l\u2019employeur qui ne conteste pas avoir diminu\u00e9 le salaire de M.
