Viole ce texte, une Cour d\u2019appel qui, pour valider une vente en cette mati\u00e8re, a retenu que \u00ab \u2026 la procuration notari\u00e9e\u2026 concerne le mandat de vendre l\u2019immeuble \u00bb et que \u00ab \u2026 le repr\u00e9- sentant de l\u2019acqu\u00e9reur n\u2019\u00e9tait point tenu de justifier d\u2019un mandat notari\u00e9 \u00bb.<\/p>\n<p>LA COUR,<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>SUR LA RECEVABILIT\u00c9 DU M\u00c9MOIRE EN R\u00c9PONSE<\/p>\n<p>Attendu, selon l\u2019article 21 de la loi organique n\u00b0 92-25 du 30 mai 1992 sur la Cour de Cassa- tion, que la partie adverse aura, \u00e0 compter de la signification de la requ\u00eate de pourvoi, un d\u00e9lai de deux mois pour produire sa d\u00e9fense ;<\/p>\n<p>Attendu que la SAIM-Ind\u00e9pendance, qui a re\u00e7u signification de la requ\u00eate le 10 septembre 2007, n\u2019a produit un m\u00e9moire en d\u00e9fense que le 14 novembre 2007 ;<\/p>\n<p>Qu\u2019il s\u2019ensuit que le m\u00e9moire en d\u00e9fense est irrecevable ;<\/p>\n<p>Attendu, selon l\u2019arr\u00eat confirmatif attaqu\u00e9, que par jugement du 05 avril 2000, le tribunal r\u00e9gio- nal de Dakar a, entre autres, dit que la vente du titre foncier n\u00b0 1451\/R, intervenue entre SAIM- Ind\u00e9pendance et les h\u00e9ritiers de feu Ousmane Mbengue et de feu Djibril Ndiaye inscrits audit titre, est r\u00e9guli\u00e8re ;<\/p>\n<p>Sur le troisi\u00e8me moyen tir\u00e9 de la violation de l\u2019article 49 du code des obligations civiles et commerciales, en ce que la Cour d\u2019appel a outrepass\u00e9 l\u2019exigence d\u2019un mandat notari\u00e9 du repr\u00e9- sentant de la SAIM-Ind\u00e9pendance pour consid\u00e9rer la vente valable et r\u00e9guli\u00e8re, alors que, selon le texte vis\u00e9 au moyen et l\u2019article 383 du m\u00eame code, la forme authentique est exig\u00e9e pour le mandat de repr\u00e9sentation en mati\u00e8re de transaction immobili\u00e8re ;<\/p>\n<p>Vu ledit texte, ensemble l\u2019article 383 du m\u00eame code ;<\/p>\n<p>Attendu que, pour valider la vente, l\u2019arr\u00eat retient \u00ab qu\u2019il est de jurisprudence constante que la procuration notari\u00e9e, exig\u00e9e en vertu des articles 49 et 383 du code des obligations civiles et commerciales, concerne le mandat de vendre l\u2019immeuble immatricul\u00e9 ; que, contrairement aux pr\u00e9tentions des appelants, le clerc Doudou Diop en sa qualit\u00e9 de repr\u00e9sentant de l\u2019acqu\u00e9reur, n\u2019\u00e9tait point tenu de justifier d\u2019un mandat notari\u00e9 \u2026 \u00bb ;<\/p>\n<p>Bulletin des Arr\u00eats n\u00b0 2-3<\/p>\n<p>116 Chambre civile et commerciale<\/p>\n<p>Qu\u2019en statuant ainsi, alors que le pouvoir de repr\u00e9senter une partie en mati\u00e8re de vente immobi- li\u00e8re doit \u00eatre pass\u00e9 par devant le notaire territorialement comp\u00e9tent, la Cour d\u2019appel a viol\u00e9 les- dits textes ;<\/p>\n<p>PAR CES MOTIFS,<\/p>\n<p>Et sans qu\u2019il y ait lieu de statuer sur les autres moyens :<\/p>\n<p>Casse et annule l\u2019arr\u00eat n\u00b0 461 rendu le 12 mars 2005 par la Cour d\u2019appel de Dakar ;<\/p>\n<p>Remet, en cons\u00e9quence, la cause et les parties au m\u00eame et semblable \u00e9tat o\u00f9 elles \u00e9taient avant ledit arr\u00eat et, pour \u00eatre fait droit, les renvoie devant la Cour d\u2019appel de Kaolack ;<\/p>\n<p>Condamne la SAIM-Ind\u00e9pendance aux d\u00e9pens ;<\/p>\n<p>Dit que le pr\u00e9sent arr\u00eat sera imprim\u00e9, qu\u2019il sera transcrit sur les registres de la Cour d\u2019appel de Dakar, en marge ou \u00e0 la suite de la d\u00e9cision attaqu\u00e9e ;<\/p>\n<p>Ainsi fait, jug\u00e9 et prononc\u00e9 par la Cour supr\u00eame, chambre civile et commerciale en son audien- ce publique tenue les jour, mois et an que dessus et o\u00f9 \u00e9taient pr\u00e9sents Madame et Messieurs :<\/p>\n<p>PR\u00c9SIDENT : Ibrahima GU\u00c9YE ; CONSEILLERS : Cheikh Tidiane COULIBALY, Jean Louis Paul TOUPANE, Ch\u00e9rif SOUMAR\u00c9, MAMA KONAT\u00c9 ; RAPPORTEUR : Ch\u00e9rif SOUMAR\u00c9 ; AVOCAT G\u00c9N\u00c9RAL : Abdourahmane DIOUF ; AVOCAT : Ma\u00eetre Mamadou LO ; GREFFIER : Macodou NDIAYE.<\/p>\n<p>TEXTES ANNEX\u00c9S AU PR\u00c9SENT ARR\u00caT<\/p>\n<p>&#8211; Article 49 du code des obligations civiles et commerciales.<\/p>\n<p>Le repr\u00e9sentant peut \u00eatre habilit\u00e9 \u00e0 agir au nom du repr\u00e9sent\u00e9, soit par un contrat, soit par la loi, soit par une d\u00e9cision judiciaire.
