MOYEN DE PREUVE &#8211; \u00c9CRIT &#8211; D\u00c9SAVEU OU NON-CONNAISSANCE \u2013 V\u00c9RIFICATION D\u2019\u00c9CRITURE<\/p>\n<p>Aux termes de l\u2019article 26 du code des obligations civiles et commerciales \u00ab en cas de d\u00e9saveu ou de non-connaissance, la v\u00e9rification d\u2019\u00e9criture est ordonn\u00e9e\u2026 \u00bb Viole ce texte, une Cour d\u2019appel qui, pour rejeter une demande en v\u00e9rification d\u2019\u00e9criture, a re- tenu que les h\u00e9ritiers qui se bornent \u00e0 d\u00e9clarer qu\u2019ils ne connaissent pas l\u2019\u00e9criture ou la signa- ture de leur auteur n\u2019ont apport\u00e9 aucun argument pertinent pour soutenir cette th\u00e8se.<\/p>\n<p>LA COUR,<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Attendu, selon l\u2019arr\u00eat confirmatif attaqu\u00e9, que par jugement du 16 mai 2007, le tribunal r\u00e9gio- nal de Dakar a condamn\u00e9 les h\u00e9ritiers de Y\u00e9ro Mbaye Konat\u00e9 \u00e0 payer \u00e0 la soci\u00e9t\u00e9 standing im- mobilier la somme de 10 000 000 frs outre les int\u00e9r\u00eats de droit \u00e0 compter de l\u2019assignation ;<\/p>\n<p>Sur le premier moyen pris de la violation de l\u2019article 26 du code des obligations civiles et commerciales, en ce que la Cour d\u2019appel a retenu \u00ab que les h\u00e9ritiers qui ne peuvent, aux termes des dispositions de l\u2019article 25 du code des obligations civiles et commerciales, que se borner \u00e0 d\u00e9clarer qu\u2019ils ne connaissent pas l\u2019\u00e9criture ou la signature de leur auteur, n\u2019ont apport\u00e9 aucun argument pertinent pour assortir cette th\u00e8se alors que le sieur Konat\u00e9 n\u2019avait pas initi\u00e9 la pro- c\u00e9dure de d\u00e9saveu qui lui \u00e9tait ouverte \u00bb, alors que les juges du fond avaient, en application de l\u2019article 26 vis\u00e9 ci-dessus, l\u2019obligation de recourir \u00e0 la v\u00e9rification d\u2019\u00e9criture ;<\/p>\n<p>Vu ledit article ;<\/p>\n<p>Attendu qu\u2019aux termes de ce texte \u00ab En cas de d\u00e9saveu ou de non connaissance, la v\u00e9rification d\u2019\u00e9criture est ordonn\u00e9e en justice suivant les dispositions du code de proc\u00e9dure civile \u00bb ;<\/p>\n<p>Attendu que, pour rejeter l\u2019incident de v\u00e9rification soulev\u00e9 par les h\u00e9ritiers de Y\u00e9ro Mbaye Konat\u00e9, les juges du fond ont retenu les motifs d\u00e9nonc\u00e9s au moyen ;<\/p>\n<p>Qu\u2019en statuant ainsi, alors que les h\u00e9ritiers ont d\u00e9clar\u00e9 qu\u2019ils ne reconnaissent pas l\u2019\u00e9criture de leur auteur, la Cour d\u2019appel a viol\u00e9, par refus d\u2019application, le texte susvis\u00e9 ;<\/p>\n<p>PAR CES MOTIFS ;<\/p>\n<p>Et sans qu\u2019il soit besoin de statuer sur le second moyen :<\/p>\n<p>Casse et annule, dans toutes ses dispositions, l\u2019arr\u00eat n\u00b0 82 rendu le 05 f\u00e9vrier 2009 par la Cour d\u2019appel de Dakar ;<\/p>\n<p>Remet, en cons\u00e9quence, la cause et les parties au m\u00eame et semblable \u00e9tat o\u00f9 elles \u00e9taient avant ledit arr\u00eat et, pour \u00eatre fait droit, les renvoie devant la Cour d\u2019appel de Saint-Louis ;<\/p>\n<p>Bulletin des Arr\u00eats n\u00b0 2-3<\/p>\n<p>114 Chambre civile et commerciale<\/p>\n<p>Condamne la soci\u00e9t\u00e9 Standing Immobilier aux d\u00e9pens ;<\/p>\n<p>Dit que le pr\u00e9sent arr\u00eat sera imprim\u00e9, qu\u2019il sera transcrit sur les registres de la Cour d\u2019appel de Dakar, en marge ou \u00e0 la suite de la d\u00e9cision attaqu\u00e9e ;<\/p>\n<p>Ainsi fait, jug\u00e9 et prononc\u00e9 par la Cour supr\u00eame, chambre civile et commerciale en son audien- ce publique tenue les jour, mois et an que dessus et o\u00f9 \u00e9taient pr\u00e9sents Messieurs :<\/p>\n<p>PR\u00c9SIDENT : Ibrahima GU\u00c9YE ;
