Ainsi, viole ce texte une Cour d\u2019appel qui retient que de simples copies de bulletins de salaires vers\u00e9s au dossier non certifi\u00e9s conformes aux originaux ne peuvent \u00e9tablir la preuve de l\u2019existence d\u2019un lien contractuel entre les parties alors que ces documents constituent un com- mencement de preuve par \u00e9crit du contrat de travail.<\/p>\n<p>LA COUR,<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Sur la recevabilit\u00e9<\/p>\n<p>Attendu que les d\u00e9fendeurs concluent \u00e0 l\u2019irrecevabilit\u00e9 du pourvoi en estimant que celui-ci a \u00e9t\u00e9 fait hors d\u00e9lai ;<\/p>\n<p>Attendu qu\u2019il ne r\u00e9sulte pas des pi\u00e8ces du dossier que la notification a \u00e9t\u00e9 r\u00e9guli\u00e8rement faite \u00e0 la demanderesse ; qu\u2019ainsi le d\u00e9lai n\u2019a pu courir ;<\/p>\n<p>Qu\u2019il s\u2019ensuit que le pourvoi est recevable en la forme ;<\/p>\n<p>Attendu qu\u2019il r\u00e9sulte de l\u2019arr\u00eat infirmatif attaqu\u00e9, que la Cour d\u2019appel de Saint-Louis a d\u00e9clar\u00e9 recevable l\u2019action de Dione et autres et condamn\u00e9 la CSS \u00e0 payer \u00e0 chacun des travailleurs la somme de 8 000 000 frs ;<\/p>\n<p>Sur le premier moyen tir\u00e9 de la violation de l\u2019article L 62 du code du travail en ce que l\u2019article L 62 n\u2019indique pas que l\u2019employeur doit prouver qu\u2019il a discut\u00e9 avec les d\u00e9l\u00e9gu\u00e9s du personnel, cette formalit\u00e9 \u00e9tant envisag\u00e9e dans le cas ou l\u2019employeur veut \u00e9viter le licenciement ; que, lors- que le licenciement est prononc\u00e9, l\u2019article L 62 qui s\u2019applique met \u00e0 la charge de l\u2019employeur uniquement la preuve du motif \u00e9conomique et du respect de l\u2019ordre des licenciements ; qu\u2019en d\u00e9clarant le licenciement abusif au motif que l\u2019employeur n\u2019a pas prouv\u00e9 avoir discut\u00e9 avec les d\u00e9l\u00e9gu\u00e9s du personnel, la Cour d\u2019appel a viol\u00e9 l\u2019article vis\u00e9 au moyen ;<\/p>\n<p>Mais attendu que pour d\u00e9clarer le licenciement abusif l\u2019arr\u00eat d\u00e9f\u00e9r\u00e9 a retenu que la CSS n\u2019a produit ni le proc\u00e8s-verbal de r\u00e9union avec les d\u00e9l\u00e9gu\u00e9s du personnel, ni la preuve de la com- munication de la liste des travailleurs licenci\u00e9s et du compte-rendu de r\u00e9union \u00e0 l\u2019Inspecteur du travail ; qu\u2019en l\u2019\u00e9tat de ces constatations d\u2019o\u00f9 il r\u00e9sulte que la CSS n\u2019a pas respect\u00e9 la proc\u00e9dure d\u2019ordre public applicable au licenciement pour motif \u00e9conomique, la Cour d\u2019appel a fait une exacte application de la loi ;<\/p>\n<p>Bulletin des Arr\u00eats n\u00b0 2-3<\/p>\n<p>!166 Chambre sociale<\/p>\n<p>Sur le second moyen tir\u00e9 de la violation de l\u2019article L 56 du code du travail en ce que la Cour d\u2019appel a allou\u00e9 \u00e0 chacun des 22 travailleurs \u00e0 titre de dommages int\u00e9r\u00eats, la somme de 8 000 000. de francs, au motif que le licenciement de Dione et autres apr\u00e8s 20 ans de relation de travail leur a caus\u00e9 un pr\u00e9judice r\u00e9el, sans pr\u00e9ciser selon le moyen les \u00e9l\u00e9ments sur lesquels elle s\u2019est fond\u00e9e pour fixer ce montant ;<\/p>\n<p>Vu l\u2019article L 56 alin\u00e9as 5 et 7 du code du travail ;<\/p>\n<p>Attendu qu\u2019il r\u00e9sulte de ce texte que d\u2019une part lorsque la responsabilit\u00e9 incombe \u00e0 l\u2019employeur, le montant des dommages-int\u00e9r\u00eats est fix\u00e9 compte tenu des usages, de la nature des services engag\u00e9s, de l\u2019anciennet\u00e9 des services, de l\u2019\u00e2ge du travailleur et des droits acquis \u00e0 quelque titre que ce soit ; et, d\u2019autre part, le jugement doit \u00eatre motiv\u00e9 en ce qui concerne la fixation du montant des dommages-int\u00e9r\u00eats ;<\/p>\n<p>Attendu que pour allouer la somme de 8 000 000 de frs \u00e0 chaque travailleur, la Cour d\u2019appel a relev\u00e9 que le licenciement abusif de Dione et autres apr\u00e8s 20 ans de relations de travail, leur a caus\u00e9 un pr\u00e9judice r\u00e9el ;<\/p>\n<p>Attendu qu\u2019en statuant ainsi sommairement, d\u2019une part, en se fondant exclusivement sur l\u2019anciennet\u00e9 et d\u2019autre part, sans appr\u00e9cier le pr\u00e9judice individuel de chaque travailleur, la Cour d\u2019appel a m\u00e9connu le sens et la port\u00e9e des dispositions susvis\u00e9es ;<\/p>\n<p>PAR CES MOTIFS :<\/p>\n<p>Casse et annule l\u2019arr\u00eat rendu le 05 juin 2009 par la chambre sociale de la Cour d\u2019appel de Saint-Louis en ce qui concerne les dommages-int\u00e9r\u00eats ;<\/p>\n<p>Renvoie la cause et les parties devant la Cour d\u2019appel de Dakar pour y \u00eatre statu\u00e9 \u00e0 nouveau.<\/p>\n<p>Ainsi fait, jug\u00e9 et prononc\u00e9 par la chambre sociale de la Cour supr\u00eame, en son audience publi- que ordinaire tenue les jour, mois et an que dessus et o\u00f9 \u00e9taient pr\u00e9sents Madame et Messieurs :<\/p>\n<p>PR\u00c9SIDENT : Awa Sow CABA ;
