{"id":1219090,"date":"2026-06-30T02:22:34","date_gmt":"2026-06-30T00:22:34","guid":{"rendered":"https:\/\/kohenavocats.com\/jurisprudences\/cour-supreme-du-senegal-bulletin-arret-n-28-du-17-juin-2009\/"},"modified":"2026-06-30T02:22:34","modified_gmt":"2026-06-30T00:22:34","slug":"cour-supreme-du-senegal-bulletin-arret-n-28-du-17-juin-2009","status":"publish","type":"kji_decision","link":"https:\/\/kohenavocats.com\/en\/jurisprudences\/cour-supreme-du-senegal-bulletin-arret-n-28-du-17-juin-2009\/","title":{"rendered":"Cour supr\u00eame du S\u00e9n\u00e9gal, Bulletin, arr\u00eat n\u00b0 28 du 17 juin 2009"},"content":{"rendered":"<div class=\"kji-decision\">\n<div class=\"kji-full-text\">\n<p>Arr\u00eat n\u00b0 28 du 17 juin 2009<\/p>\n<p>LA COUR,<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Attendu, selon l\u2019arr\u00eat confirmatif attaqu\u00e9, que la vente du terrain, objet du titre foncier n\u00b0 6962\/DG devenu 1453\/GRD intervenue entre Abdoulaye Diop, vendeur, et Seyni Loum, acqu\u00e9reur, a \u00e9t\u00e9 annul\u00e9e et la radiation de son inscription sur les livres fonciers ordonn\u00e9e ;<\/p>\n<p>Sur le premier moyen, en sa troisi\u00e8me branche, pris de la violation de la loi, en ce que, \u00ab en pronon\u00e7ant l\u2019annulation de la vente du 25 ao\u00fbt 1978, alors que la mutation \u00e9tait d\u00e9j\u00e0 intervenue, les juges du fond ont viol\u00e9 les dispositions de l\u2019article 381 du Code des Obligations Civiles et Commerciales \u00bb ;<\/p>\n<p>Vu ledit texte, ensemble l\u2019article 159 du d\u00e9cret du 26 juillet 1932 et les articles 258 et 10 du COCC ;<\/p>\n<p>Attendu qu\u2019aux termes des deux premiers de ces textes, d\u2019une part, \u00ab L\u2019acquisition du droit r\u00e9el r\u00e9sulte de la mention au titre foncier du nom du nouveau titulaire du droit. Celui-ci acquiert de ce fait sur l\u2019immeuble un droit d\u00e9finitif et inattaquable dont l\u2019\u00e9tendue est d\u00e9termin\u00e9e juridiquement par les \u00e9nonciations du titre foncier \u00bb et, d\u2019autre part, \u00ab les modifications ou annulations (de l\u2019inscription au titre foncier), sauf dans les cas o\u00f9 elles sont la<\/p>\n<p>Arr\u00eats de la Cour supr\u00eame<\/p>\n<p>Chambre civile et commerciale 53<\/p>\n<p>cons\u00e9quence d\u2019une r\u00e9serve mentionn\u00e9e au titre foncier, ne peuvent pr\u00e9judicier au tiers de bonne foi \u00bb ;<\/p>\n<p>Attendu que, pour annuler la vente et ordonner la radiation de son inscription au livre foncier, l\u2019arr\u00eat retient que \u00ab c\u2019est \u00e0 bon droit que le premier juge a d\u00e9cid\u00e9 que l\u2019acte de vente pass\u00e9, sur la base d\u2019un faux jugement d\u2019h\u00e9r\u00e9dit\u00e9, par un pr\u00e9tendu h\u00e9ritier, devait \u00eatre annul\u00e9 \u00bb ;<\/p>\n<p>Qu\u2019en statuant ainsi, tout en relevant que la vente pass\u00e9e par devant notaire a \u00e9t\u00e9 inscrite au livre foncier, la Cour d\u2019appel, qui n\u2019a pas tir\u00e9 les cons\u00e9quences l\u00e9gales de ses propres constatations, a viol\u00e9 les textes susvis\u00e9s ;<\/p>\n<p>Et, attendu qu\u2019en application de l\u2019article 52 alin\u00e9a 5, la Cour est en mesure, en cassant sans renvoi, de mettre fin au litige par application de la r\u00e8gle de droit ;<\/p>\n<p>PAR CES MOTIFS<\/p>\n<p>Et sans qu\u2019il y ait lieu de statuer ni sur la premi\u00e8re et la deuxi\u00e8me branches du premier moyen, ni sur le second moyen ;<\/p>\n<p>Casse et annule l\u2019arr\u00eat n\u00b0 265 rendu le 27 mars 2007 par la Cour d\u2019appel de Dakar ;<\/p>\n<p>Dit n\u2019y avoir lieu \u00e0 renvoi ;<\/p>\n<p>Dit que le droit acquis par Seyni Loum sur le titre foncier n\u00b0 6962\/DG devenu 1453\/GRD est d\u00e9finitif et inattaquable ;<\/p>\n<p>Condamne Souleymane Diop et Ibrahima Diop aux d\u00e9pens.<\/p>\n<p>Ordonne la restitution de l\u2019amende consign\u00e9e<\/p>\n<p>Dit que le pr\u00e9sent arr\u00eat sera imprim\u00e9, qu\u2019il sera transcrit sur les registres de la Cour d\u2019appel de Dakar, en marge ou \u00e0 la suite de la d\u00e9cision attaqu\u00e9e ;<\/p>\n<p>Ainsi fait, jug\u00e9 et prononc\u00e9 par la Cour Supr\u00eame, Chambre civile et commerciale en son audience publique tenue les jour, mois et an que dessus et o\u00f9 \u00e9taient pr\u00e9sents Messieurs :<\/p>\n<p>PR\u00c9SIDENT : Ibrahima GU\u00c9YE, Mouhamadou DIAWARA, Cheikh Tidiane COULIBALY, Jean Louis TOUPANE, Ch\u00e9rif SOUMAR\u00c9, RAPPORTEUR : Mama KONAT\u00c9, AVOCAT G\u00c9N\u00c9RAL : Khary DIOP, AVOCAT : Moustapha NDOYE, GREFFIER : Macodou NDIAYE ;<\/p>\n<p>Arr\u00eats de la Cour supr\u00eame<\/p>\n<p>54 Chambre civile et commerciale<\/p>\n<p>\u2013 12 \u2013<\/p>\n<p>Ousmane DIAGNE c\/ Awa NDIAYE<\/p>\n<p>CASSATION \u2013 MOYEN \u2013 MOYEN TIR\u00c9 DE L\u2019ULTRA PETITA \u2013 IRRECEVABILIT\u00c9 \u2013 CAS \u2013 D\u00c9FAUT D\u2019INVOCATION D\u2019UNE VIOLATION DE LA LOI<\/p>\n<p>Est irrecevable le moyen tir\u00e9 de l\u2019ultra petita non accompagn\u00e9 d\u2019une violation de la loi.<\/p>\n<\/div>\n<hr class=\"kji-sep\" \/>\n<p class=\"kji-source-links\"><strong>Sources officielles :<\/strong> <a class=\"kji-source-link\" href=\"https:\/\/www.coursupreme.gouv.sn\/sites\/default\/files\/2021-03\/BA1-2008-2009.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">consulter la page source<\/a> &middot; <a class=\"kji-pdf-link\" href=\"https:\/\/www.coursupreme.gouv.sn\/sites\/default\/files\/2021-03\/BA1-2008-2009.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">PDF officiel<\/a><\/p>\n<p class=\"kji-license-note\"><em>Cour supreme du Senegal, bulletins officiels.
