souverain d\u2019appr\u00e9ciation des \u00e9l\u00e9ments de preuve \u00e0 elle soumis. \u00bb<\/p>\n<p>R\u00c9PUBLIQUE DE MADAGASCAR<\/p>\n<p>COUR DE CASSATION<\/p>\n<p>CHAMBRE CIVILE COMMERCIALE ET SOCIALE<\/p>\n<p>La Cour de Cassation, Chambre civile Commerciale et Sociale en son audience publique ordinaire du mardi vingt-huit ao\u00fbt deux mille dix-huit, tenue au palais de Justice \u00e0 Anosy, a rendu l&#039;arr\u00eat dont la teneur suit:<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi;<\/p>\n<p>Statuant sur le pourvoi des \u00e9poux R.D\/R.E., demeurant au [adresse] ayant pour conseil Ma\u00eetre RAHARIMALALA R.V\u00e9ronique, Avocat, lot 20 C 70 Avaratsena Antsirabe, contre l&#039;arr\u00eat civil contradictoire de la Cour d&#039;Appel d&#039;Antananarivo n\u00b01310 du 06 d\u00e9cembre 2004 dans le litige les opposant \u00e0 A.S. et R.L., tous domicili\u00e9s au [adresse];<\/p>\n<p>Vu le m\u00e9moire en demande ;<\/p>\n<p>Sur le premier moyen de cassation pris de la violation de l&#039;article 26 de la loi organique 2004-036 du 1er octobre 2004 relative \u00e0 la Cour Supr\u00eame et de l&#039;article 82 de l&#039;ordonnance n\u00b060.146 du 03 octobre 1960 pour contradiction de motifs, d\u00e9naturation des faits, fausse interpr\u00e9tation de la loi et fausse application, manque de base l\u00e9gale en ce que l&#039;arr\u00eat attaqu\u00e9 s&#039;est appuy\u00e9 sur le jugement n\u00b0578 du 08 ao\u00fbt 2001 qui a expuls\u00e9 les demandeurs au pourvoi du terrain litigieux pour affirmer que les conditions requises pour b\u00e9n\u00e9ficier de la prescription acquisitive, notamment le caract\u00e8re paisible de l&#039;occupation ne sont pas remplies alors que le rapport de la commission administrative a soulign\u00e9 l&#039;effectivit\u00e9 de la mise en valeur, la publicit\u00e9 de l&#039;occupation, la continuit\u00e9, l&#039;univocit\u00e9 et la paisibilit\u00e9 de l&#039;occupation ;<\/p>\n<p>Sur le deuxi\u00e8me moyen de cassation tir\u00e9 de la violation de l&#039;article 285 du Code de Proc\u00e9dure Civile sur l&#039;administration de la preuve en ce que la Cour s&#039;est content\u00e9e de se r\u00e9f\u00e9rer au jugement n\u00b0578 du 08 ao\u00fbt 2001 pour ordonner l&#039;expulsion des \u00e9poux R.D\/R.E. sans v\u00e9rifier la r\u00e9alit\u00e9 des faits alors que les motifs du 1er Juge dans le jugement n\u00b0001 du 23 janvier 2002 sont bien assis sur des bases l\u00e9gales, le rapport de la commission administrative faisant foi ;<\/p>\n<p>Sur le troisi\u00e8me moyen de cassation pris de la violation des articles 67 de la loi sur la Th\u00e9orie G\u00e9n\u00e9rale des Obligations et 1583 du Code Civil pour non observation des formes prescrites \u00e0 peine de nullit\u00e9 en mati\u00e8re de contrat de vente, manque de base l\u00e9gale en ce que la Cour a pris comme motifs de confirmation du jugement r\u00e9tractant le jugement n\u00b0001 suscit\u00e9 l&#039;existence de ce jugement qui ordonne l&#039;expulsion des demandeurs au pourvoi alors que les motifs de ce dernier ne reposent pas sur des bases l\u00e9gales ; qu&#039;en effet l&#039;acte de vente sans date est nul et de nul effet ;<\/p>\n<p>Vu les textes de loi vis\u00e9s aux moyens ;<\/p>\n<p>Attendu que les demandeurs, par ces trois moyens propos\u00e9s, reprochent \u00e0 l&#039;arr\u00eat attaqu\u00e9 d&#039;avoir confirm\u00e9 le jugement n\u00b0965 du 08 octobre 2003 qui a r\u00e9tract\u00e9 le jugement n\u00b0001 du 23 janvier 23002 lequel cependant lui a attribu\u00e9 le terrain litigieux par prescription acquisitive apr\u00e8s avoir affirm\u00e9 qu&#039;il a rempli toutes les conditions requises \u00e0 cet effet par l\u2019article 82 de l&#039;ordonnance n\u00b060146 du 03 octobre 1960 ;<\/p>\n<p>Attendu toutefois que la Cour d&#039;Appel d&#039;Antananarivo, en constatant que la condition de paisibilit\u00e9 de l&#039;occupation n&#039;est pas remplie, n&#039;a fait qu&#039;appliquer d&#039;une mani\u00e8re r\u00e9guli\u00e8re l&#039;article 82 susvis\u00e9 et n&#039;a fait qu&#039;user de son pouvoir souverain d&#039;appr\u00e9ciation des \u00e9l\u00e9ments de preuves \u00e0 elle soumis, n&#039;\u00e9tant pas li\u00e9e par le rapport de la Commission administrative ;<\/p>\n<p>Attendu en effet que cette appr\u00e9ciation \u00e9chappe au contr\u00f4le de la Cour de Cassation ; il s&#039;ensuit que les moyens ne sauraient prosp\u00e9rer ;<\/p>\n<p>REJETTE le pourvoi ;<\/p>\n<p>Condamne les demandeurs \u00e0 l&#039;amende et aux d\u00e9pens.<\/p>\n<p>Ainsi jug\u00e9 et prononc\u00e9 par la Cour de Cassation, Chambre civile Commerciale et Sociale, en son audience publique, les jour, mois et an que
