Que toutefois, la Cour n\u2019est pas li\u00e9e par l\u2019avis de la Commission. \u00bb<\/p>\n<p>REPUBLIQUE DE MADAGASCAR<\/p>\n<p>COUR DE CASSATION<\/p>\n<p>La Cour de Cassation, Chambre civile, en son audience publique ordinaire du vendredi dix-huit mai deux mille dix-huit, tenue au palais de Justice \u00e0 Anosy, a rendu l&#039;arr\u00eat dont la teneur suit:<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi:<\/p>\n<p>Statuant sur le pourvoi de R.J.R. demeurant au [adresse] ayant pour conseil Ma\u00eetre Allain Rajoelina avocat, contre l\u2019arr\u00eat n\u00b0819 du 16 juillet 2003 rendu par la Chambre Civile de la Cour d\u2019Appel d\u2019Antananarivo dans la proc\u00e9dure qui l\u2019oppose \u00e0 R. ;<\/p>\n<p>Vu le m\u00e9moire en demande ;<\/p>\n<p>Sur le premier moyen de cassation tir\u00e9 des articles 5 et 44 de la loi n\u00b061-013 du 19 juillet 1961 portant cr\u00e9ation de la Cour Supr\u00eame et pris de la violation de l\u2019article 82 de l\u2019ordonnance n\u00b060-146 du 03 Octobre 1960 relative au r\u00e9gime foncier de 1&#039; immatriculation pour violation de la loi, fausse application ou fausse interpr\u00e9tation de la loi, d\u00e9naturation des faits, insuffisance et contradiction de motifs ;<\/p>\n<p>En ce que l&#039;arr\u00eat attaqu\u00e9 en d\u00e9boutant R.J.R., a fond\u00e9 sa d\u00e9cision sur le fait que les conditions exig\u00e9es par la loi ne sont pas remplies alors que la loi n&#039;exige que la cr\u00e9ation ou l&#039;entretien permanant d\u2019une mise en valeur effective et durable constat\u00e9e sur ordonnance de justice ;<\/p>\n<p>Attendu que contrairement aux all\u00e9gations du moyen, en plus de la cr\u00e9ation ou l&#039;entretien permanent d&#039;une mise en valeur effective et durable, I&#039; article 82 susvis\u00e9 parle d&#039;une occupation pendant au moins 20 ann\u00e9es pour des nationaux ;<\/p>\n<p>Qu&#039;en effet, en estimant que les cultures saisonni\u00e8res se trouvant sur les terrains litigieux n&#039;ont pas 20 ans d\u2019\u00e2ge et que la condition relative \u00e0 la dur\u00e9e d\u2019occupation n&#039;est pas remplie, la Cour d\u2019Appel a us\u00e9 de son pouvoir d\u2019appr\u00e9ciation des faits qui \u00e9chappe au contr\u00f4le de la Cour de cassation ;<\/p>\n<p>Que le moyen ne saurait \u00eatre accueilli ;<\/p>\n<p>Sur le deuxi\u00e8me moyen de cassation tir\u00e9 des articles 5 et 44 de la loi n\u00b061-013 du 19 juillet 1960 portant cr\u00e9ation de la Cour Supr\u00eame pour violation de la loi, fausse application ou fausse interpr\u00e9tation de la loi, d\u00e9naturation des faits, insuffisance et contradiction de motifs ;<\/p>\n<p>En ce que l&#039;arr\u00eat attaqu\u00e9, en rejetant la demande de R.J.R. , n&#039;a pas pris en consid\u00e9ration le proc\u00e8s-verbal de constatation n\u00b064-G\/A\/RC en date du 03 Septembre 1998 alors que la commission a conclu un avis favorable pour l\u2019acquisition par prescription au profit de R.J.R. de la parcelle cadastrale n\u00b01109 dite Anosivato Sambaina,<\/p>\n<p>Attendu que pour d\u00e9bouter R.J.R. de sa demande de prescription acquisitive, la Cour d&#039; Appel a \u00e9nonc\u00e9 qu&#039; il ressort du proc\u00e8s-verbal de constatation de mise en valeur \u00e9tabli par la Commission domaniale le 03 Septembre 1998 que le terrain consiste en tanety et non en rizi\u00e8re comme mentionn\u00e9e sur le certificat de situation juridique, et les cultures s&#039; y trouvant sont des cultures saisonni\u00e8res (voly avotra) telles que manioc et pomme de terre \u00bb:<\/p>\n<p>Qu\u2019ainsi, contrairement aux all\u00e9gations du demandeur au pourvoi, la Cour d&#039;Appel a pris en consid\u00e9ration le proc\u00e8s-verbal \u00e9tabli par la commission<\/p>\n<p>Que toutefois, la Cour n&#039;est pas li\u00e9e par l&#039;avis de la commission ;<\/p>\n<p>Qu&#039;il s&#039;ensuit que le moyen n&#039;est pas fond\u00e9 ;<\/p>\n<p>Attendu que les deux moyens propos\u00e9s ne sont pas fond\u00e9s, il \u00e9chet de rejeter le pourvoi ;<\/p>\n<p>REJETTE le pourvoi ;<\/p>\n<p>Condamne le demandeur \u00e0 l&#039;amende et aux d\u00e9pens<\/p>\n<p>Ainsi jug\u00e9 et prononc\u00e9 par la Cour de Cassation, Chambre civile les jour, mois et an que dessus.
