Qu\u2019en d\u00e9clarant le contraire, l\u2019arr\u00eat attaqu\u00e9 a viol\u00e9 les dispositions l\u00e9gales susvis\u00e9es.<\/p>\n<p>Cassation : Ordinaire<\/p>\n<p>Nature : Civile<\/p>\n<p>Solution : Rejet<\/p>\n<p>ARR\u00caT N\u00b0 214 du 4 mai 2018<\/p>\n<p>Dossier : 884\/11-CO<\/p>\n<p>CONTRAT DE BAIL COMMERCIAL \u2013 RECONDUCTION \u2013 DEVIENT \u00c0 DUR\u00c9E IND\u00c9TERMIN\u00c9E<\/p>\n<p>&quot;Le contrat de bail commercial reconduit est devenu \u00e0 dur\u00e9e ind\u00e9termin\u00e9e et ne peut prendre fin que par l\u2019effet d\u2019un cong\u00e9, et que le cong\u00e9 de \u00ab une ann\u00e9e \u00bb donn\u00e9 par exploit d\u2019huissier, reproduisant les termes de l\u2019article 31 de l\u2019ordonnance sur le bail commercial, est r\u00e9gulier et valable.<\/p>\n<p>Qu\u2019en d\u00e9clarant le contraire, l\u2019arr\u00eat attaqu\u00e9 a viol\u00e9 les dispositions l\u00e9gales susvis\u00e9es.&quot;<\/p>\n<p>H\u00e9ritiers T.H. rep\u00e9sent\u00e9 pa H.N.<\/p>\n<p>R\u00c9PUBLIQUE DE MADAGASCAR<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;<\/p>\n<p>Cour de Cassation<\/p>\n<p>Chambre Civile Commerciale Sociale<\/p>\n<p>La Cour de Cassation, Chambre Civile Commerciale Sociale en son audience publique ordinaire du vendredi quatre mai deux mille dix huit, tenue au Palais de Justice \u00e0 Anosy, a rendu l&#039;arr\u00eat dont la teneur suit :<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Statuant sur le pourvoi en date du 20 octobre 2011 de H.N., demeurant au [adresse 1] , repr\u00e9sentant des h\u00e9ritiers de T.H. , contre l\u2019arr\u00eat n\u00b0141-C rendu le 13 Juillet 2011 par la Chambre Civile de la Cour d\u2019Appel d\u2019Antsiranana, dans le litige l\u2019opposant \u00e0 L.S.V. domicili\u00e9 \u00e0 [adresse 2];<\/p>\n<p>Vu les m\u00e9moires en demande et en d\u00e9fense ;<\/p>\n<p>SUR LE SEUL ET UNIQUE MOYEN DE CASSATION : pour fausse application des articles 8 et 31 de l\u2019Ordonnance n\u00b060-050 du 22 Juin 1960 ;<\/p>\n<p>En ce que : le cong\u00e9 donn\u00e9 pour reprise personnelle est conforme aux dispositions l\u00e9gales et au contrat de bail conclu entre les parties ;<\/p>\n<p>Alors qu\u2019un cong\u00e9 d\u2019une dur\u00e9e d\u2019un an a \u00e9t\u00e9 d\u00e9j\u00e0 donn\u00e9 \u00e0 L.S.V., le 10 Octobre 2008 ;<\/p>\n<p>Vu les textes de Loi vis\u00e9s ;<\/p>\n<p>Attendu que le contrat de bail commercial liant les parties a \u00e9t\u00e9 conclu le 10 Septembre 1994 pour une dur\u00e9e de neuf ans renouvelables par tacite reconduction ; Que, comme il y est stipul\u00e9, il prend effet \u00e0 partir du 1er Juin 1994 et que le d\u00e9lai devait expirer en 2003 ;<\/p>\n<p>Attendu, cependant, que le bail a \u00e9t\u00e9 reconduit car un cong\u00e9 de une ann\u00e9e pour reprise personnelle, aux fins d\u2019y loger l\u2019h\u00e9ritier H.N. a \u00e9t\u00e9 servi par exploit d\u2019Huissier le 10 Octobre 2008 ;<\/p>\n<p>Que le probl\u00e8me juridique qui se pose est de savoir si un tel cong\u00e9 est r\u00e9gulier et valable ;<\/p>\n<p>Attendu que, compte tenu du motif susvis\u00e9 pour lequel il a \u00e9t\u00e9 donn\u00e9, ledit cong\u00e9 est soumis aux articles 8 et 16 de l\u2019Ordonnance n\u00b060-050 du 22 Juin 1960 sur le bail commercial ; Que cet article 16 dispose : \u00ab le bail reconduit se poursuit conform\u00e9ment \u00e0 l\u2019article 1738 du Code Civil, en ces termes : \u00ab si \u00e0 l\u2019expiration des baux \u00e9crits, le preneur reste et est laiss\u00e9 en possession, il op\u00e8re un nouveau bail dont l\u2019effet est r\u00e9gl\u00e9 par l\u2019article relatif aux locations sans \u00e9crit ; Alors que le cong\u00e9 donn\u00e9 sans \u00e9crit doit observer les d\u00e9lais fix\u00e9s par l\u2019usage des lieux selon l\u2019article 1736 du Code Civil \u00bb;<\/p>\n<p>Attendu que de toutes ces consid\u00e9rations, le contrat reconduit est devenu \u00e0 \u00ab \u00e0 dur\u00e9e ind\u00e9termin\u00e9e \u00bb et ne peut prendre fin que par l\u2019effet d\u2019un cong\u00e9, et que le cong\u00e9 de \u00ab une ann\u00e9e \u00bb donn\u00e9 par exploit d\u2019huissier, reproduisant les termes de l\u2019article 31 de l\u2019Ordonnance sur le bail commercial, est r\u00e9gulier et valable ; Qu\u2019en d\u00e9clarant le contraire, l\u2019arr\u00eat attaqu\u00e9 a viol\u00e9 les dispositions l\u00e9gales susvis\u00e9es ;<\/p>\n<p>Qu\u2019il encourt la cassation et l\u2019annulation ;<\/p>\n<p>CASSE et ANNULE l\u2019arr\u00eat n\u00b0141-C du 13 Juin 2011 de la Cour d\u2019Appel d\u2019Antsiranana ;<\/p>\n<p>RENVOIE la cause et les parties devant la m\u00eame juridiction mais autrement compos\u00e9e ;<\/p>\n<p>Ordonne la restitution de l\u2019amende de cassation ;<\/p>\n<p>Condamne le d\u00e9fendeur aux d\u00e9pens ;<\/p>\n<p>Appel\u00e9e \u00e0 l\u2019audience du six avril deux mille dix-huit, o\u00f9 l\u2019affaire a \u00e9t\u00e9 mise en d\u00e9lib\u00e9r\u00e9;
