souverain pour appr\u00e9cier les \u00e9l\u00e9ments de fait et des preuves soumis \u00e0 leur examen lequel pouvoir \u00e9chappe au contr\u00f4le de la Cour de Cassation \u00bb<\/p>\n<p>Service des Domaines Arivonimamo<\/p>\n<p>REPUBLIQUE DE MADAGASCAR<\/p>\n<p>AU NOM DU PEUPLE MALAGASY<\/p>\n<p>La Cour de Cassation, Chambre civile, en son audience publique ordinaire du vendredi vingt avril deux mille dix huit, tenue au palais de Justice \u00e0 Anosy, a rendu l&#039;arr\u00eat dont la teneur suit;<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Statuant sur le pourvoi de R.M.N. demeurant \u00e0 [adresse] ayant pour conseil Ma\u00eetre Doroth\u00e9e Ralimanana avocat, contre l\u2019arr\u00eat n\u00b0039 du 26 Avril 2010 rendu par la Chambre Civile de la Cour d\u2019Appel d&#039;Antananarivo dans la proc\u00e9dure qui l\u2019oppose \u00e0 R. ;<\/p>\n<p>Vu les m\u00e9moires en demande et en d\u00e9fense ;<\/p>\n<p>Sur le premier moyen de cassation pris de la violation de l&#039;article 18 de la loi n\u00b060-004 du 15 f\u00e9vrier 1960 pour inobservations des formes prescrites \u00e0 peine de nullit\u00e9 ;<\/p>\n<p>En ce que la Cour d\u2019Appel n\u2019a pas pris en consid\u00e9ration des t\u00e9moignages recueillis lors de la descente sur les lieux effectu\u00e9e par le premier juge, lesquels affirment que R. n&#039;a jamais mis en valeur le terrain litigieux alors que l\u2019article 18 suscit\u00e9 stipule clairement que l\u2019occupation effective et durable ainsi que la mise en valeur du terrain objet de la demande sont des conditions requises pour pouvoir acqu\u00e9rir un terrain domanial ;<\/p>\n<p>Vu le texte de loi vis\u00e9 au moyen ;<\/p>\n<p>Attendu que les juges du fond disposent d\u2019un pouvoir souverain pour appr\u00e9cier les \u00e9l\u00e9ments de fait et de preuve soumis \u00e0 leur examen et qui \u00e9chappe au contr\u00f4le de la Cour de Cassation ;<\/p>\n<p>Que le moyen ne saurait \u00eatre accueilli ;<\/p>\n<p> Sur le deuxi\u00e8me moyen de cassation pour exc\u00e8s de pouvoir ; En ce que la Cour d\u2019Appel a pris acte de la d\u00e9cision de partage judiciaire effectu\u00e9 entre R. et consort alors que la m\u00eame Cour a soulev\u00e9 que, concernant la d\u00e9livrance d&#039;un titre domanial, seule l\u2019Administration conserve la facult\u00e9 d\u2019appr\u00e9cier l&#039;opportunit\u00e9 de l\u2019attribution des terres domaniales,<\/p>\n<p>Attendu que le moyen ne contient pas le visa des textes pr\u00e9tendument viol\u00e9s et ne permet pas \u00e0 la Cour de Cassation de relever l\u2019exc\u00e8s de pouvoir qui aurait \u00e9t\u00e9 commis par la Cour d\u2019Appel,<\/p>\n<p>Que le moyen ne saurait prosp\u00e9rer ;<\/p>\n<p>Attendu que les deux moyens propos\u00e9s ne sont pas fond\u00e9s, il \u00e9chait de rejeter le pourvoi,<\/p>\n<p>REJETTE le pourvoi<\/p>\n<p>Condamne la demanderesse \u00e0 l&#039;amende et aux d\u00e9pens.<\/p>\n<p>Ainsi jug\u00e9 et prononc\u00e9 par la Cour de Cassation, Chambre civile les jour, mois et an que dessus.<\/p>\n<p>O\u00f9 \u00e9taient pr\u00e9sents,<\/p>\n<p>Mesdames et
