Il ne peut s\u2019agir que d\u2019un propri\u00e9taire inscrit sur le titre foncier, qu\u2019ainsi, le d\u00e9lai ne peut courir contre lui qu\u2019\u00e0 compter de la date de son inscription sur le livre foncier \u00bb <\/p>\n<p>H\u00e9ritiers Ra &#8211; M.<\/p>\n<p>REPUBLIQUE DE MADAGASCAR<\/p>\n<p>AU NOM DU PEUPLE MALAGASY<\/p>\n<p>La Cour de Cassation, Chambre civile Commerciale et Sociale en son audience publique ordinaire du mardi dix sept avril deux mille dix huit, tenue au palais de Justice \u00e0 Anosy, a rendu l&#039;arr\u00eat dont la teneur suit :<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi;<\/p>\n<p>Statuant sur le pourvoi des h\u00e9ritiers de Ra- M., repr\u00e9sent\u00e9s par R.P., ayant pour conseil Me Fred\u00e9ric Rakotoarivony Avocat \u00e0 la Cour, demeurant [adresse], contre un arr\u00eat n\u00b0 101 du 02 f\u00e9vrier 2005 de la Chambre civile de la Cour d&#039;Appel d&#039;Antananarivo, dans le litige l&#039;ayant oppos\u00e9 \u00e0 R. ;<\/p>\n<p>Vu les m\u00e9moires en demande et en d\u00e9fense ;<\/p>\n<p>Sur l&#039;unique moyen de cassation tir\u00e9 de l&#039;article 26 de la loi 2004-036 du 01 octobre 2004 sur la Cour Supr\u00eame, pour fausse interpr\u00e9tation de la loi,<\/p>\n<p>En ce que l&#039;arr\u00eat attaque a pris comme point de d\u00e9part du d\u00e9lai de prescription la date de l&#039;inscription des droits sur le titre foncier,<\/p>\n<p>Alors que l&#039;esprit de la prescription acquisitive est de sanctionner l&#039;abus de droit du propri\u00e9taire qui abandonne son fond sans mise en valeur ;<\/p>\n<p>Attendu que si la prescription acquisitive est la sanction d&#039;un abus de droit du propri\u00e9taire n\u00e9gligent pendant une dur\u00e9e de vingt ans, il ne peut s&#039;agir que du propri\u00e9taire inscrit sur le titre foncier qu&#039;ainsi le d\u00e9lai ne peut courir contre lui qu&#039;\u00e0 compter de la date de son inscription sur le livre foncier ; qu&#039;en effet il n&#039;est propri\u00e9taire qu&#039;\u00e0 partir de cette date ; que la Cour d&#039;Appel s&#039;est parfaitement conform\u00e9e \u00e0 cet esprit de la loi ;<\/p>\n<p>Que le moyen n&#039;est pas fond\u00e9 ;<\/p>\n<p>REJETTE le pourvoi ;<\/p>\n<p>Condamne le demandeur \u00e0 l&#039;amende et aux d\u00e9pens ;<\/p>\n<p>Ainsi jug\u00e9 et prononc\u00e9 par la Cour de Cassation, Chambre civile Commerciale et Sociale, en son audience publique, les jour, mois et an que dessus.<\/p>\n<p>O\u00f9 \u00e9taient pr\u00e9sents :<\/p>\n<p>Mesdames et Messieurs :<\/p>\n<p>La minute du pr\u00e9sent arr\u00eat a \u00e9t\u00e9 sign\u00e9e par le Pr\u00e9sident, le Rapporteur, et le Greffier.<\/p>\n<\/div>\n<hr class=\"kji-sep\" \/>\n<p class=\"kji-source-links\"><strong>Sources officielles :<\/strong> <a class=\"kji-source-link\" href=\"https:\/\/jurisprudence.justice.gov.mg\/decision\/details\/DCS68389AFFEA257\" target=\"_blank\" rel=\"noopener noreferrer\">consulter la page source<\/a> &middot; <a class=\"kji-pdf-link\" href=\"https:\/\/jurisprudence.justice.gov.mg\/decision\/print\/DCS68389AFFEA257\" target=\"_blank\" rel=\"noopener noreferrer\">PDF officiel<\/a><\/p>\n<p class=\"kji-license-note\"><em>Portail officiel du Ministere de la Justice de Madagascar.<\/em><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Mati\u00e8res : Foncier Mots cl\u00e9s : Prescription acquisitive \u2013 abus de droit \u2013 date d\u2019inscription au titre \u2013 point de d\u00e9part.
