Indivision"},"content":{"rendered":"<div class=\"kji-decision\">\n<div class=\"kji-full-text\">\n<p>Mati\u00e8res : Foncier<\/p>\n<p>Mots cl\u00e9s : INDIVISION- VENTE DE QUOTE PART : OUI- EFFETS<\/p>\n<p>En mati\u00e8re de propri\u00e9t\u00e9 indivise, la vente d\u2019une quote-part est valable, \u00e0 charge pour les autres copropri\u00e9taires d\u2019en demander, en cas de contestation, l\u2019annulation apr\u00e8s le partage.<\/p>\n<p>Cassation : Ordinaire<\/p>\n<p>Nature : Civile<\/p>\n<p>Solution : Cassation<\/p>\n<p>ARR\u00caT N\u00b0 661 du 26 septembre 2017<\/p>\n<p>Dossier : 360\/08-CO<\/p>\n<p>INDIVISION \u2013 VENTE DE QUOTE PART : OUI \u2013 EFFETS<\/p>\n<p>\u00ab En mati\u00e8re de propri\u00e9t\u00e9 indivise, la vente d\u2019une quote-part est valable, \u00e0 charge pour les autres copropri\u00e9taires d\u2019en demander, en cas de contestation, l\u2019annulation apr\u00e8s le partage. \u00bb<\/p>\n<p>Me Allain RAJOELINA<\/p>\n<p>R\u00c9PUBLIQUE DE MADAGASCAR<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;<\/p>\n<p>Cour de Cassation<\/p>\n<p>Chambre Civile Commerciale Sociale<\/p>\n<p>La Cour de Cassation, Chambre Civile Commerciale Sociale en son audience publique ordinaire du mardi vingt six septembre deux mille dix sept, tenue au Palais de Justice \u00e0 Anosy, a rendu l&#039;arr\u00eat dont la teneur suit :<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Statuant sur le pourvoi de R.L.V, domicili\u00e9e au [Adresse 1] Ampefiloha Antananarivo, ayant pour conseil Ma\u00eetre Allain RAJOELINA, avocat, contre l\u2019arr\u00eat n\u00b0 84 du 28 janvier 2008 de la Chambre Civile de la Cour d\u2019Appel d\u2019Antananarivo, rendu dans le litige l\u2019opposant \u00e0 R.E ;<\/p>\n<p>Vu le m\u00e9moire en demande ;<\/p>\n<p>Sur le moyen unique de cassation tir\u00e9 de l\u2019article 26 de la loi organique 2004.036 du 1er octobre 2004 relative \u00e0 la Cour Supr\u00eame et les trois Cours la composant, pour violation de la loi, fausse interpr\u00e9tation de la loi, d\u00e9naturation des faits, manque de base l\u00e9gale, absence de motifs en ce que la d\u00e9cision attaqu\u00e9e en confirmant le jugement entrepris qui a d\u00e9bout\u00e9 la demanderesse au pourvoi et bas\u00e9 sa d\u00e9cision sur l\u2019absence de l\u2019inscription des droits des vendeurs sur le livre foncier alors qu\u2019il a \u00e9t\u00e9 soutenu par la demanderesse que les vendeurs n\u2019ont vis\u00e9 que leur droit revenant \u00e0 la succession de R.Z, propri\u00e9taire inscrit sur le livre foncier ;<\/p>\n<p>Vu les textes de droit vis\u00e9s au moyen ;<\/p>\n<p>Attendu qu\u2019il ressort des \u00e9l\u00e9ments de la proc\u00e9dure que la Cour d\u2019Appel a fond\u00e9 sa d\u00e9cision sur le caract\u00e8re indivis de la propri\u00e9t\u00e9 litigieuse et sur l\u2019absence de partage de ce bien indivis ;<\/p>\n<p>Attendu cependant qu\u2019en mati\u00e8re de propri\u00e9t\u00e9 indivise la vente d\u2019une quote-part est valable, \u00e0 charge pour les autres copropri\u00e9taires d\u2019en demander, en cas de contestation l\u2019annulation apr\u00e8s le partage ;<\/p>\n<p>Attendu qu\u2019il s\u2019en suit que l\u2019arr\u00eat attaqu\u00e9 ayant d\u00e9bout\u00e9 la demanderesse pour d\u00e9faut de partage au moment de la conclusion de la vente encourt la cassation ;
