publique ordinaire du mardi douze septembre deux mille dix-sept, tenue au Palais de Justice \u00e0 Anosy, a rendu l&#039;arr\u00eat dont la teneur suit :<\/p>\n<p>Apr\u00e8s en avoir d\u00e9lib\u00e9r\u00e9 conform\u00e9ment \u00e0 la loi ;<\/p>\n<p>Statuant sur le pourvoi de la Soci\u00e9t\u00e9 BIG PROTECTION repr\u00e9sent\u00e9e par B.P demeurant \u00e0 l&#039;Agriculture, Carreau V, Parcelle 14\/22 Salazamay Sud-Toamasina mais \u00e9lisant domicile en l&#039;\u00e9tude de son conseil Ma\u00eetre RAMIADAMAHEFA Elys\u00e9 lot II N 23 bis Anjanahary, contre l&#039;arr\u00eat n\u00b0 CATO-57\/SOC\/13 rendu le 25 juillet 2013 par la Chambre Sociale de la Cour d&#039;Appel de Toamasina dans l&#039;affaire l&#039;opposant \u00e0 R.B.M ;<\/p>\n<p>Vu les m\u00e9moires en demande et en d\u00e9fense ;<\/p>\n<p>Sur les deux moyens de cassation r\u00e9unis : pris de la violation de l&#039;article 26 de la loi organique n\u00b02004.036 du 1er octobre 2004 sur la Cour Supr\u00eame et de l&#039;article 12 in fine de la loi n\u00b0 2003.044 portant Code du Travail pour absence, insuffisance de motifs et g\u00e9n\u00e9ralement impossibilit\u00e9 pour la Cour Supr\u00eame d&#039;exercer son contr\u00f4le ;<\/p>\n<p>En ce que la Cour s&#039;est content\u00e9e de discuter seulement sur la cessation d&#039;activit\u00e9 et n&#039;a pas pris en consid\u00e9ration la force majeure subie par la d\u00e9fenderesse au pourvoi alors que l&#039;article 12 du Code du Travail dispose que &quot; la cessation d&#039;activit\u00e9 de l&#039;entreprise sauf en cas de force majeure, ne dispense pas l&#039;employeur de respecter les r\u00e8gles \u00e9tablies de l&#039;article 24 du Code du Travail &quot; ;<\/p>\n<p>Qu&#039;en effet, la demanderesse se trouve dans un \u00e9v\u00e8nement impr\u00e9visible et insurmontable, lequel est constitutif de force majeure notamment la r\u00e9siliation du contrat avec l&#039;Etat Malagasy sans mise en demeure ni pr\u00e9avis ;<\/p>\n<p>Vu ledit texte ;<\/p>\n<p>Attendu que le risque de l&#039;entreprise incombe \u00e0 l&#039;employeur et non \u00e0 l&#039;employ\u00e9 ; qu&#039;en tout \u00e9tat de cause l&#039;appr\u00e9ciation de la nature de la rupture du contrat rel\u00e8ve du pouvoir souverain des juges du fond et \u00e9chappe \u00e0 la censure de la Cour Supr\u00eame ; <\/p>\n<p>REJETTE le
